Berdasarkan Pasal 8 ayat (1) huruf g, i, dan j Undang-Undang Perlindungan Konsumen, pelaku usaha dilarang memperdagangkan barang yang tidak mencantumkan label, tanggal kedaluwarsa, maupun informasi penggunaan sesuai peraturan perundang-undangan. Selain itu, Pada Pasal 2 ayat (1) Peraturan Menteri Perdagangan Republik Indonesia Nomor 36 Tahun 2020 tentang Minyak Goreng Sawit Wajib Kemasan mewajibkan produsen, pengemas, dan pelaku usaha memperdagangkan minyak goreng sawit dalam kemasan guna menjamin mutu, keamanan,serta memberikan informasi yang benar kepada konsumen. Namun, dalam praktiknya minyak goreng curah tanpa label masih banyak beredar di Pasar Simpang Limun, sehingga hak konsumen atas informasi dan keamanan produk belum terpenuhi secara optimal

Penelitian ini bertujuan untuk menjelaskan perlindungan konsumen terhadap peredaran minyak goreng curah tanpa label, menjelaskan tanggung jawab pelaku usaha terhadap peredaran minyak goreng curah tanpa label, serta menjelaskan kendala dalam melindungi hak-hak konsumen terkait penjualan minyak goreng curah tanpa label di Pasar Tradisional Simpang Limun Kota Medan

Metode penelitian yang digunakan adalah metode penelitian kualitatif dengan pendekatan yuridis empiris, dimana data lapangan menjadi sumber utama serta didukung dengan bahan kepustakaan yakni dengan mempelajari peraturan perundangan-undangan, buku dan jurnal ilmiah.

Hasil penelitian menunjukkan bahwa perlindungan konsumen terhadap peredaran minyak goreng curah tanpa label di Pasar Tradisional Simpang Limun Kota Medan belum terlaksana secara optimal. Perlindungan yang diberikan pelaku usaha masih terbatas pada upaya menjaga kebersihan minyak goreng selama proses penyimpanan dan penjualan, sedangkan informasi mengenai identitas produk tidak diberikan kepada konsumen. Tanggung jawab pelaku usaha juga belum terlaksana secara optimal karena hanya sebagian pelaku usaha yang bersedia memberikan ganti rugi apabila terjadi kerugian, sementara konsumen yang mengalami kerugian tidak pernah mengajukan keluhan maupun tuntutan. Kendala dalam perlindungan konsumen berasal dari pengawasan pemerintah yang belum dilakukan secara berkelanjutan, keterbatasan kewenangan pengelola pasar, rendahnya pemahaman pelaku usaha mengenai pentingnya pelabelan produk, serta rendahnya kesadaran hukum konsumen sehingga praktik penjualan minyak goreng curah tanpa label masih terus berlangsung.

Disarankan kepada Dinas Perindustrian dan Perdagangan Provinsi Sumatera agar meningkatkan pengawasan terhadap peredaran minyak goreng curah tanpa label secara berkelanjutan, kepada pelaku usaha agar lebih memperhatikan penyampaian informasi mengenai produk yang diperdagangkan serta meningkatkan tanggung jawab terhadap konsumen, dan kepada masyarakat agar lebih memahami hak-haknya sebagai konsumen serta lebih aktif menyampaikan pengaduan apabila mengalami kerugian sehingga perlindungan konsumen terlaksana secara lebih efektif.

Pursuant to Article 8 paragraph (1) letters g, i, and j of the Consumer Protection Law, business actors are prohibited from distributing goods that do not contain labels, expiration dates, or instructions for use as required by the applicable laws and regulations. Furthermore, Article 2 paragraph (1) of Regulation of the Minister of Trade of the Republic of Indonesia Number 36 of 2020 concerning the Mandatory Packaging of Palm Cooking Oil requires producers, packagers, and business actors to market palm cooking oil in packaged form in order to ensure its quality and safety and to provide consumers with accurate and adequate product information. In practice, however, unpackaged and unlabeled bulk cooking oil remains widely distributed at Simpang Limun Market, resulting in the rights of consumers to product information and safety not being optimally fulfilled. This research aims to examine consumer protection in relation to the distribution of unlabeled bulk cooking oil, examine the liability of business actors for the distribution of unlabeled bulk cooking oil, and identify the obstacles to protecting consumer rights in relation to the sale of unlabeled bulk cooking oil at Simpang Limun Traditional Market in Medan City. This research employs a qualitative research method with an empirical juridical approach, in which field data constitute the primary source of information, supported by library research involving the examination of laws and regulations, books, and scholarly journals. The results of the research indicate that consumer protection against the distribution of unlabeled bulk cooking oil at Simpang Limun Traditional Market in Medan City has not been implemented optimally. The protection provided by business actors remains limited to maintaining the cleanliness of cooking oil during its storage and sale, while information concerning the identity and characteristics of the product is not provided to consumers. The liability of business actors has likewise not been optimally implemented, as only some business actors are willing to provide compensation in the event of losses, while consumers who suffer losses have never submitted complaints or pursued claims. Obstacles to consumer protection include the lack of continuous government supervision, the limited authority of market management, the low level of business actors’ understanding of the importance of product labeling, and consumers’ limited legal awareness. Consequently, the practice of selling unlabeled bulk cooking oil continues to occur. It is recommended that the Provincial Office of Industry and Trade of North Sumatra strengthen continuous supervision over the distribution of unlabeled bulk cooking oil. Business actors are encouraged to provide more adequate information regarding the products they market and to enhance their accountability towards consumers. The public is also encouraged to gain a better understanding of their rights as consumers and to actively submit complaints in the event of losses, thereby enabling consumer protection to be implemented more effectively.
