Pasal 2 Agreement on Safeguard memungkinkan negara anggota untuk melindungi industri dalam negerinya dari kerugian serius atau ancaman serius yang diakibatkan oleh lonjakan impor. Sementara itu, pada masa Pandemi Covid-19, empat sektor industri di Indonesia, yaitu industri karpet dan tekstil penutup lantai lainnya, industri pakaian dan aksesoris pakaian, industri kertas sigaret, serta industri expansible polystyrene mengalami kerugian serius atau ancaman serius sebagai akibat dari lonjakan impor barang sejenis atau barang yang secara langsung bersaing dengan barang yang diproduksi oleh industri dalam negeri tersebut.
Penelitian ini bertujuan untuk menganalisis akibat lonjakan impor terhadap industri dalam negeri Indonesia dan mengkaji penerapan bea masuk safeguard selama pandemi covid 19 di Indonesia.
Penelitian ini menggunakan metode hukum empiris. Sumber data yang digunakan terdiri dari sumber hukum primer dan sekunder. Sumber hukum primer didapatkan dengan mewawancarai lembaga atau otoritas hukum terkait. Sumber hukum sekunder didapatkan melalui analisis hukum internasional dan nasional, serta meninjau literatur. Semua data yang terkumpul dianalisis dengan menggunakan analisis kualitatif.
Hasil penelitian ini menunjukkan bahwa selama masa pandemi Covid-19, terdapat empat sektor industri domestik Indonesia yang mengalami kerugian serius atau ancaman kerugian serius akibat lonjakan impor barang sejenis atau secara langsung bersaing. Keempat sektor industri domestik ini mengajukan permohonan penerapan safeguard dan terbukti industri tersebut memenuhi syarat penerapan safeguards. Oleh karena itu, Kementerian Keuangan Republik Indonesia mengeluarkan peraturan untuk pelaksanaan safeguard.
Penelitian ini menyarankan agar Pemerintah Indonesia sebagai negara anggota WTO memaksimalkan penggunaan tindakan pengamanan dan fungsi Komite Keamanan Perdagangan Indonesia untuk melindungi industri dalam negeri dari kerugian serius atau ancaman kerugian serius, mengingat sebagian besar industri dalam negeri Indonesia masih membutuhkan perlindungan.

Article 2 of Agreement on Safeguard allow member state to protect its domestic industry from serious injury or threat thereof which cause by surge of import. Meanwhile, in Covid-19 Pandemic, four industrial sectors in Indonesia, namely the carpet and other textile floor covering industry, apparel and clothing accessories industry, cigarette and plug wrap non-porous paper industry, and expansible polystyrene industry, suffered serious injury or threat as a result of rapidly rising imports of similar or directly competitive goods with goods produced by these domestic industries. This research is aimed to analyze the consequences of the surge of imports to the Indonesian domestic industries and to scrutinize the application of safeguard import duties during covid 19 pandemic in Indonesia. This study uses empirical legal methods. The data consist of primary and secondary legal resources. Primary legal resources were found by interviewing relevant institutions or legal authorities. Secondary legal resources were found through analyzing both international and national laws, and reviewed literature. All collected data were analyzed by applying qualitative analysis. The result showed that during the Covid-19 pandemic, there were four Indonesian domestic industrial sectors that submitted applications for the application of safeguards which experienced serious injury and thread of serious injury due to surge in imports of similar or directly competitive goods with their products. In these four industrial sectors, it has been proven these industries satisfies the conditions for the application of safeguards. Thus, the Indonesian Ministry of Finance issued regulations for the implementation of safeguard. It is suggested that the Indonesian government, as a member state of the WTO, should maximize the use of safeguard measures and the function of the Indonesian Trade Security Committee to protect the domestic industry from serious losses or the threat of serious losses, considering that the majority of Indonesia's domestic industries still require protection.
