PERANAN BALAI KONSERVASI SUMBER DAYA ALAM (BKSDA) DALAM PERLINDUNGAN HUKUM TERHADAP SATWA GAJAH DI KABUPATEN ACEH JAYA

ABSTRAK

Peranan Balai Konservasi Sumber Daya Alam (BKSDA) secara ideal dalam perlindungan hukum terhadap satwa gajah diatur pada Pasal 2 dan 3 sebagaimana dalam Peraturan Menteri Kehutanan Nomor: P. 02/Menhut-II/2007 tentang Organisasi dan Tata Kerja Unit Pelaksana Teknis Konservasi Sumber Daya Alam. Kenyataan yang terjadi peranan BKSDA tersebut belum terlaksanakan semestinya di wilayah Kabupaten Aceh Jaya. Masalah pokok penelitian ialah: (1) Apa saja perlindungan hukum yang diberikan pemerintah terhadap satwa gajah di wilayah hukum Kabupaten Aceh Jaya? (2) Bagaimana peran BKSDA dalam perlindungan hukum terhadap satwa gajah di wilayah hukum Kabupaten Aceh Jaya? (3) Bagaimana peran ideal BKSDA dalam perlindungan hukum terhadap satwa gajah di Kabupaten Aceh Jaya?
Penelitian dan pengkajian ini bertujuan, menemukan dan mengembangkan teori mengenai keadilan, peran dan perlindungan hukum. Dimana peneliti mengembangkan konsepsi mengenai wilayah hukum yang menegakkan keadilan, melaksanakan peran sesuai tugas wewenang berdasarkan ketentuan berlaku sehingga dapat terwujudnya perlindungan hukum pada satwa- satwa yang dilindungi negara.
Jenis Penelitian ini penelitian hukum empiris, menggunakan pendekatan sosiologis hukum. Dengan sumber data adalah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier (penunjang). Data yang diperoleh, baik dari bahan hukum primer, sekunder, tersier, serta informasi dari para ahli atau akademisi, maka analisis data dilakukan dengan pendekatan kualitatif dan kuantitatif yaitu analisis isi dan analisi angka- angka kemudian uraian penjelasan.
Penelitian ini menunjukkan bahwasanya Pertama, perlindungan hukum terhadap satwa gajah di wilayah hukum Kabupaten Aceh Jaya yaitu berlandaskan pada Qanun Nomor 11 Tahun 2019 Tentang Pengelolaan Satwa Liar. Perlindungan tersebut dijamin pada setiap kawasan di Aceh Khususnya pada Kabupaten Aceh Jaya. Dimana Pemerintah terlibat langsung dalam menangani permasalahan mengenai konflik gajah. Kedua, peran BKSDA Provinsi Aceh maupun Kabupaten Aceh Jaya dalam perlindungan hukum terhadap satwa gajah yaitu sesuai berdasarkan peraturan perundang- undangan yang berlaku. Akan tetapi peran tersebut belum maksimal pencapaian dalam pelaksanaannya, dimana terdapat hambatan dan kendala dalam menjalani tugas dan peran dari BKSDA. Ketiga, peran ideal BKSDA dalam perlindungan hukum terhadap satwa gajah di Kabupaten Aceh Jaya ialah menjalani kegiatan, tugas dan perannya berlandaskan pada PERMENHUT Nomor: P. 02/Menhut-II/2007 dan juga Qanun No. 11 Tahun 2019. Sebagaimana diperlukan keikutsertaan aktif dari masyarakat dalam Pengelolaan Satwa Liar agar dapat hidup secara berdampingan tanpa terjadinya konflik.
Disarankan pertama, untuk merevisi isi dari Qanun Nomor 11 Tahun 2019 tentang Pengelolaan satwa liar agar mendapatkan perlindungan hukum yang lebih terjamin. Kedua, disarankan BKSDA Provinsi dan Kabupaten/ Kota Khususnya Kabupaten Aceh Jaya untuk memaksimal peran dan tugasnya dalam meminimalisir konflik gajah dan manusia yang terjadi di setiap kawasan. Perlu ditambahnya jumlah anggota tim gugus CRU pada setiap kawasan rawan konflik kemudian diadakan evaluasi berskala setiap mingguan atau bulanan pada tim gugus CRU dan berikan sanksi tertentu pada tim bertugas apabila lalai melaksanakan tugasnya. Ketiga, disarankan BKSDA Provinsi, Kabupaten/ Kota khususnya Kabupaten Aceh Jaya untuk mengimplementasikan peran idealnya berdasarkan PERMENHUT Nomor: P. 02/Menhut-II/2007 dan Qanun No. 11 Tahun 2019.

THE ROLE OF THE NATURAL RESOURCES CONSERVATION CENTER (BKSDA) IN THE LEGAL PROTECTION OF ELEPHANTS IN ACEH JAYA REGENCY Erwo Guntoro Yanis Rinaldi Sulaiman Tripa ABSTRACT The Natural Resources Conservation Center (BKSDA) role ideally in the legal protection of elephants has been regulated in Articles 2 and 3 as stipulated in the Regulation of the Minister of Forestry Number: P. 02/ Menhut-II / 2007 concerning the Organization and Working Procedures of the Technical Implementation Unit of Natural Resources Conservation. The fact that the role of BKSDA has not been implemented properly in the Aceh Jaya Regency area. The main research problems are: (1) What are the legal protections provided by the government for elephants in the jurisdiction of Aceh Jaya Regency? (2) What is the role of BKSDA in the legal protection of elephants in the jurisdiction of Aceh Jaya Regency? (3) What is the ideal role of BKSDA in the legal protection of elephants in Aceh Jaya Regency? This study aims to find and develop theories regarding the justice, role, and protection of the law. Researchers developed a conception of a legal area that enforces justice and carries out roles according to authority's duties based on applicable regulations so that legal protection can be realized for animals protected by the state. This research was empirical legal research, using a legal, sociological approach. The data sources of this research were secondary data in the form of primary, secondary, and tertiary (supporting) legal materials. The data obtained from primary, secondary, tertiary legal materials and information from experts or academics were analyzed with qualitative and quantitative approaches consisting of content analysis and analysis of figures accompanied by descriptions of explanations. This research shows that, first, the legal protection of elephants in the jurisdiction of Aceh Jaya Regency was based on Qanun Number 11 of 2019 concerning Wildlife Management. This protection was guaranteed in Aceh, especially in Aceh Jaya Regency where the Government is directly involved in dealing with elephant conflicts. Second, the role of the BKSDA of Aceh Province and Aceh Jaya Regency in the legal protection of elephants was carried out in accordance with applicable laws and regulations. However, the implementation of this role was not maximal due to obstacles in carrying out the BKSDA duties and roles. Third, the ideal role of BKSDA in the legal protection of elephants in Aceh Jaya Regency was to carry out its activities, duties, and roles based on Regulation of the Ministry of the Forestry Number: P. 02/Menhut-II/2007 and Qanun No. 11 of 2019. Therefore, it is necessary to have active participation from the community in Wildlife Management so that humans and elephants can live side by side without conflict. First, it is recommended to revise the contents of Qanun Number 11 of 2019 concerning Wildlife Management to get more secure legal protection. Second, it is recommended that the Provincial and Regency/City BKSDA, especially Aceh Jaya Regency, maximize their roles and duties in minimizing elephant and human conflicts in each region. It is necessary to increase the number of Conservation Response Unit (CRU) cluster team members in each conflict-prone area. Then periodic evaluations every week or month on the CRU cluster team need to be carried out, and certain sanctions need to be given to the team on duty if they are negligent in carrying out their duties. Third, it is recommended that the Provincial, Regency/City BKSDA, especially Aceh Jaya Regency implement its ideal role based on Regulation of the Ministry of the Forestry Number: P. 02/Menhut-II/2007 and Qanun No. 11 of 2019.
