Pemilihan umum di Aceh memiliki kekhususan berdasarkan Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh, salah satunya dalam mekanisme rekrutmen keanggotaan Komisi Independen Pemilihan (KIP) Aceh. Rekrutmen tersebut dilakukan oleh Tim Independen (tim seleksi) yang dibentuk oleh DPRA sebagaimana diatur dalam Pasal 10 Qanun Aceh Nomor 6 Tahun 2018 tentang Penyelenggara Pemilihan Umum dan Pemilihan di Aceh. Namun, pelaksanaan rekrutmen anggota KIP Aceh periode 2023–2028 masih menimbulkan persoalan terkait objektivitas, transparansi, dan independensi proses seleksi, termasuk adanya perbedaan antara hasil nilai Computer Assisted Test (CAT) dengan hasil penetapan calon anggota KIP Aceh terpilih yang dipengaruhi oleh belum adanya pengaturan yang jelas mengenai standar penilaian setiap tahapan seleksi, mekanisme pemeringkatan hasil akhir, serta keterbukaan hasil penilaian. Di samping itu, pembentukan Tim Independen oleh DPRA dan penentuan akhir calon anggota KIP Aceh melalui mekanisme fit and proper test di Komisi I DPRA turut membuka ruang terjadinya intervensi politik dalam proses rekrutmen.
Penelitian ini bertujuan untuk menjelaskan pembentukan Tim Seleksi dalam rekrutmen keanggotaan Komisi Independen Pemilihan (KIP) Aceh periode Tahun 2023–2028, menganalisis pelaksanaan proses dan prosedur rekrutmen keanggotaan Komisi Independen Pemilihan (KIP) Aceh oleh Tim Seleksi, serta menganalisis akibat hukum terhadap pelaksanaan rekrutmen keanggotaan Komisi Independen Pemilihan (KIP) Aceh yang bertentangan dengan ketentuan peraturan perundang-undangan.
Penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif. Data primer diperoleh melalui wawancara, sedangkan data sekunder diperoleh melalui studi kepustakaan. Data dianalisis secara deskriptif dan preskriptif untuk menggambarkan pelaksanaan rekrutmen keanggotaan KIP Aceh serta menilai kesesuaiannya dengan ketentuan peraturan perundang-undangan.
Hasil penelitian menunjukkan bahwa Tim Independen telah dibentuk berdasarkan kewenangan yang diatur dalam Pasal 10 dan Pasal 11 Qanun Aceh Nomor 6 Tahun 2018. Namun, dalam pelaksanaan rekrutmen masih ditemukan kelemahan dalam penerapan asas transparansi, independensi, dan akuntabilitas yang dipengaruhi oleh adanya legal gap dalam Qanun Aceh Nomor 6 Tahun 2018, yaitu belum diaturnya secara jelas standar transparansi penilaian, mekanisme pemeringkatan hasil akhir, serta keterbukaan hasil setiap tahapan seleksi. Kondisi tersebut berpotensi mengakibatkan keputusan pengangkatan anggota KIP Aceh dapat dibatalkan apabila terbukti terdapat pelanggaran terhadap kewenangan, prosedur, atau persyaratan substantif sesuai dengan ketentuan peraturan perundang-undangan, serta dapat memengaruhi legitimasi dan kepercayaan publik terhadap independensi KIP Aceh sebagai penyelenggara pemilu.
Saran penelitian ini adalah agar Tim Independen meningkatkan penerapan prinsip transparansi, independensi, dan akuntabilitas melalui keterbukaan hasil penilaian pada setiap tahapan seleksi serta penerapan mekanisme penilaian yang objektif dan dapat dipertanggungjawabkan. Selain itu, Pemerintah Aceh diharapkan melakukan evaluasi dan penyempurnaan terhadap Qanun Aceh Nomor 6 Tahun 2018, khususnya mengenai pengaturan standar transparansi penilaian, mekanisme pemeringkatan hasil akhir, dan keterbukaan hasil setiap tahapan seleksi guna memberikan kepastian hukum. Selanjutnya, masyarakat, akademisi, dan lembaga pengawas diharapkan berperan aktif dalam melakukan pengawasan terhadap pelaksanaan rekrutmen anggota KIP Aceh agar proses seleksi berlangsung secara objektif, transparan, akuntabel, serta meminimalkan potensi terjadinya cacat hukum.

Elections in Aceh are subject to special provisions under Law Number 11 of 2006 concerning the Government of Aceh, particularly regarding the recruitment mechanism for members of the Aceh Independent Election Commission (KIP Aceh). This recruitment is conducted by an Independent Team (selection team) established by the Aceh House of Representatives (DPRA), as stipulated in Article 10 of Aceh Qanun Number 6 of 2018 concerning Election and General Election Organizers in Aceh. However, the recruitment process for KIP Aceh members for the 2023–2028 term has raised concerns regarding the objectivity, transparency, and independence of the selection process. Issues include discrepancies between Computer Assisted Test (CAT) scores and the final selection of candidates—stemming from a lack of clear regulations on assessment standards for each selection stage, final ranking mechanisms, and the disclosure of assessment results. Furthermore, the formation of the Independent Team by the DPRA and the final determination of candidates through a "fit and proper test" conducted by Commission I of the DPRA create opportunities for political interference in the recruitment process. This study aims to explain the formation of the Selection Team for the recruitment of members of the Aceh Independent Election Commission (KIP) for the 2023–2028 period, analyze the implementation of the Selection Team's recruitment process and procedures for membership of the Aceh Independent Election Commission (KIP), and analyze the legal consequences of the implementation of the Aceh Independent Election Commission (KIP) membership recruitment that violates statutory provisions. This research is an empirical legal study using a qualitative approach. Primary data was obtained through interviews, while secondary data was obtained through literature review. Data were analyzed descriptively and prescriptively to describe the implementation of the Aceh KIP membership recruitment and assess its compliance with statutory provisions. The research results indicate that the Independent Team was established based on the authority stipulated in Articles 10 and 11 of Aceh Qanun Number 6 of 2018. However, weaknesses in the implementation of the principles of transparency, independence, and accountability were still found in the recruitment process, influenced by legal gaps in Aceh Qanun Number 6 of 2018. These include the lack of clear regulations on assessment transparency standards, the final ranking mechanism, and the transparency of the results of each selection stage. This situation has the potential to result in the revocation of the appointment of Aceh KIP members if there is evidence of a violation of authority, procedures, or substantive requirements in accordance with statutory provisions. It can also impact the legitimacy and public trust in the independence of the Aceh KIP as an election organizer. This research recommends that the Independent Team improve its implementation of the principles of transparency, independence, and accountability by disclosing assessment results at each selection stage and implementing an objective and accountable assessment mechanism. In addition, the Aceh Government is expected to evaluate and refine Aceh Qanun Number 6 of 2018, particularly regarding the regulation of assessment transparency standards, the final ranking mechanism, and the transparency of the results of each selection stage to provide legal certainty. Furthermore, the public, academics, and supervisory institutions are expected to play an active role in overseeing the recruitment of Aceh KIP members to ensure that the selection process is objective, transparent, and accountable, and minimizes the potential for legal flaws.
