Penyidikan tindak pidana penyebaran konten pornografi melalui media sosial merupakan bagian penting dalam penegakan hukum terhadap kejahatan berbasis teknologi informasi. Berdasarkan Pasal 1 angka (2) KUHAP, penyidikan adalah serangkaian tindakan untuk mencari dan mengumpulkan bukti guna membuat terang suatu tindak pidana. Namun dalam praktiknya, pelaksanaan penyidikan tindak pidana pornografi masih menghadapi beberapa kendala, khususnya terkait kecukupan alat bukti digital, perbedaan penafsiran antara konten asusila dan pornografi, serta kebutuhan dukungan keterangan ahli dalam proses pembuktian. Karakteristiknya yang berbasis sistem elektronik menjadikan proses penyidikan lebih kompleks, khususnya dalam pembuktian berbasis alat bukti digital.

Penelitian ini bertujuan untuk menjelaskan pelaksanaan penyidikan tindak pidana penyebaran konten pornografi melalui media sosial, hambatan yang dihadapi dalam proses penyidikan, serta upaya penanggulangan yang dilakukan oleh aparat penegak hukum.

Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan lapangan melalui wawancara terhadap penyidik Siber dan pihak terkait di Kepolisian Daerah Aceh, serta didukung dengan studi kepustakaan.

Hasil penelitian menunjukkan bahwa penyidikan dilakukan melalui tahapan laporan atau temuan patroli siber, pemanggilan saksi, penyitaan barang bukti elektronik, serta penggunaan digital forensik. Hambatan penyidikan meliputi kendala teknis seperti ketidakkooperatifan pelaku, penghapusan bukti elektronik, penggunaan identitas anonim dan teknologi penyamaran jaringan, rendahnya keberanian korban untuk melapor, serta keterbatasan sumber daya. Penanggulangan tindak pidana tersebut dilakukan oleh aparat penegak hukum menggunakan dua pendekatan, yaitu pendekatan preventif melalui sosialisasi, edukasi, dan patroli siber, serta pendekatan represif melalui penegakan hukum dengan pemanfaatan teknologi digital forensik dan koordinasi antarinstansi.

Disarankan agar aparat penegak hukum meningkatkan kapasitas sumber daya manusia di bidang teknologi informasi dan digital forensik, serta memperkuat sarana dan koordinasi lintas sektor dengan instansi terkait untuk mempercepat proses pembuktian. Masyarakat juga diharapkan menimgkatkan kesadaran hukum dan berhati-hati dalam menggunakan media sosial guna mencegah terjadinya tindak pidana penyebaran konten pornografi.

The investigation of criminal offences involving the dissemination of pornographic content through social media constitutes an essential aspect of law enforcement against technology-based crimes. Pursuant to Article 1 point (2) of the Indonesian Criminal Procedure Code (Kitab Undang-Undang Hukum Acara Pidana/KUHAP), an investigation is a series of actions undertaken to search for and collect evidence in order to clarify the occurrence of a criminal offence and identify the suspect. In practice, however, the investigation of pornography-related offences continues to encounter several challenges, particularly with respect to the sufficiency of digital evidence, differing interpretations between indecent content and legally defined pornography, and the need for expert testimony during the evidentiary process. The electronic nature of these offences renders the investigation process more complex, especially in relation to the authentication and admissibility of digital evidence. This study aims to examine the implementation of criminal investigations into the dissemination of pornographic content through social media, to identify the obstacles encountered during the investigative process, and to analyse the measures adopted by law enforcement authorities to address such challenges. This research employs an empirical juridical method, using a field-based approach through interviews with Cyber Crime investigators and other relevant officials at the Aceh Regional Police, supported by library research involving statutory regulations and relevant legal literature. The findings indicate that investigations are conducted through several stages, including the receipt of public reports or findings from cyber patrol activities, the examination of witnesses, the seizure of electronic evidence, and the application of digital forensic techniques. The principal obstacles encountered during investigations include technical challenges, such as uncooperative suspects, deletion of electronic evidence, the use of anonymous identities and network obfuscation technologies, the reluctance of victims to report offences, and limited institutional resources. To address these challenges, law enforcement authorities employ both preventive and repressive approaches. Preventive measures include public awareness campaigns, legal education, and cyber patrol activities, while repressive measures involve criminal law enforcement through the utilization of digital forensic technology and inter-agency coordination. Accordingly, it is recommended that law enforcement authorities strengthen human resource capacity in the fields of information technology and digital forensics, while enhancing investigative facilities and cross-sector coordination with relevant institutions to expedite the evidentiary process. Furthermore, the public is encouraged to improve legal awareness and exercise greater caution in the use of social media in order to prevent the dissemination of pornographic content.
