Pasal 102 Undang-Undang Nomor 17 Tahun 2006 adalah perubahan atas UU No. 10 Tahun 1995 tentang Kepabeanan menyatakan bahwa sanksi melakukan penyelundupan di bidang impor dengan pidana penjara paling singkat 1 (satu) tahun dan pidana penjara paling lama 10 (sepuluh) tahun dan pidana denda paling sedikit Rp50.000.000,00 (lima puluh juta rupiah) dan paling banyak Rp5.000.000.000,00 (lima miliar rupiah). Tetapi dalam praktiknya, masih terdapat penyeludupan rokok tanpa pita cukai di Aceh.

Tujuan penulisan skripsi ini untuk menjelaskan pengawasan, faktor penghambat dan strategi pencegahan yang efektif untuk menekan angka penyelundupan rokok tanpa pita cukai di Aceh.

Metode penelitian dalam penelitian ini adalah yuridis empiris. Data penelitian yang digunakan diperoleh dari data primer berupa hasil wawancara dengan responden dan informan, serta data sekunder berupa literatur kepustakaan, mencakup buku teks, teori, peraturan Perundang-Undangan.

Hasil penelitian menunjukkan bahwa pengawasan terhadap penyelundupan rokok tanpa pita cukai di Aceh melalui sistem pengawasan yang terstruktur dengan mengombinasikan pendekatan preventif dan represif, didukung intelijen, patroli darat dan laut, teknologi, serta sinergi lintas instansi. Pengawasan terhadap penyelundupan rokok tanpa pita cukai di Aceh terutama terhambat oleh kondisi geografis yang luas dan kompleks, keterbatasan sumber daya manusia, sarana prasarana, dan teknologi, serta modus pelaku yang semakin adaptif, rendahnya partisipasi masyarakat, dan kuatnya jaringan peredaran rokok ilegal. Strategi pencegahan penyelundupan rokok tanpa pita cukai di Aceh memerlukan strategi yang komprehensif dan berkelanjutan dengan menekankan sinergi lintas instansi, keterlibatan aktif masyarakat, serta penguatan penegakan hukum. Kondisi geografis yang rawan menjadikan kolaborasi antara DJBC Aceh, TNI, kepolisian, Satpol PP, dan instansi terkait sebagai kunci pengawasan yang terkoordinasi dan responsif, sementara pemanfaatan dana pengawasan, teknologi modern, dan peningkatan kapasitas penyidik berperan penting dalam menciptakan efek jera.

Disarankan kepada Direktorat Jenderal Bea dan Cukai Aceh harus lebih meningkatkan pengawasan terhadap peredaran rokok ilegal dan meningkatkan pengawasan dengan melakukan penambahan jumlah SDM serta masyarakat harus melaporkan apabila ditemukan adanya penyeludupan rokok tanpa pita cukai.

Article 102 of Law Number 17 of 2006, which amends Law Number 10 of 1995 on Customs concerning Customs, stipulates that any person committing smuggling in the import sector shall be subject to criminal sanctions in the form of imprisonment for a minimum of 1 (one) year and a maximum of 10 (ten) years, and a fine of not less than IDR 50,000,000 (fifty million rupiah) and not more than IDR 5,000,000,000 (five billion rupiah). Nevertheless, in practice, the smuggling of cigarettes without excise stamps continues to occur in Aceh. The purpose of this undergraduate thesis is to examine the supervision mechanisms, inhibiting factors, and effective prevention strategies to reduce the incidence of cigarette smuggling without excise stamps in Aceh. The research method employed in this study is an empirical juridical approach. The research data consist of primary data obtained through interviews with respondents and informants, as well as secondary data derived from library research, including textbooks, legal theories, and statutory regulations. The results of the study indicate that supervision of cigarette smuggling without excise stamps in Aceh is conducted through a structured monitoring system combining preventive and repressive approaches, supported by intelligence operations, land and sea patrols, technological utilization, and inter-agency synergy. The supervision is primarily hindered by the vast and complex geographical conditions, limited human resources, infrastructure, and technology, increasingly adaptive modus operandi of perpetrators, low public participation, and strong networks in the distribution of illegal cigarettes. Effective prevention strategies require a comprehensive and sustainable approach emphasizing inter-agency coordination, active community involvement, and strengthened law enforcement. The geographically vulnerable conditions make collaboration between the Directorate General of Customs and Excise of Aceh, the Indonesian National Armed Forces (TNI), the Police, the Civil Service Police Unit (Satpol PP), and related institutions crucial for coordinated and responsive supervision. The allocation of supervisory funds, the use of modern technology, and the enhancement of investigators’ capacity play a significant role in creating a deterrent effect. It is recommended that the Directorate General of Customs and Excise of Aceh intensify supervision over the circulation of illegal cigarettes by increasing the number of personnel, and that the public actively report any instances of cigarette smuggling without excise stamps.
