Kepastian hukum terhadap batas gampong dapat terwujud ketika penetapan
dan penegasan batas gampong telah dilaksanakan oleh Pemerintah Kabupaten/Kota
yang sesuai dengan peraturan perundang-undangan yang berlaku. Berdasarkan
Pasal 4 ayat (2) huruf c Peraturan Menteri Dalam Negeri No. 45/2016 tentang
Pedoman Penetapan dan Penegasan Batas Desa (Permendagri Pedoman PPBDes),
Dinas Pertanahan Kabupaten Aceh Besar berwenang dalam menyelesaikan
perselisihan batas gampong berdasarkan Permendagri Pedoman PPBDes serta
Peraturan Bupati Aceh Besar No. 48 Tahun 2017 tentang Kedudukan, Susunan
Organisasi, Tugas dan Fungsi Serta Tata Kerja Dinas Pertanahan Kabupaten Aceh
Besar. Namun, dalam kenyataannya Pemerintah Kabupaten Aceh Besar belum
melaksanakan penyelesaian perselisihan batas gampong di Kemukiman Siem
Kecamatan Darussalam Kabupaten Aceh Besar. Seperti perselisihan yang terjadi
antara gampong Lamklat-Lambitra, Lambitra-Lieue, Lieue-Lambiheu Siem,
Lamreh-Siem, dan Lamreh-Lam Asan.
Penelitian ini bertujuan untuk menjelaskan pelaksanaan penyelesaian
perselisihan batas gampong yang dilakukan oleh Pemerintah Kabupaten Aceh
Besar. Serta menjelaskan hambatan dan upaya pencegahan perselisihan batas
gampong oleh Pemerintah Kabupaten Aceh Besar.
Metode yang digunakan adalah penelitian yuridis empiris yang
mengutamakan data lapangan (field research) sebagai data primer dan data
kepustakaan (library reseach) sebagai data sekunder. Pendekatan penelitian ini
dilakukan secara kualitatif. Data yang telah dikumpulkan dianalisis secara kualitatif
yang bersifat analisis deskriptif.
Hasil penelitian menunjukkan bahwa pelaksanaan penyelesaian perselisihan
batas gampong yang dilakukan oleh Pemerintah Kabupaten Aceh Besar adalah
dengan melakukan mediasi, namun Pemerintah Kabupaten Aceh Besar belum
melaksanakan kewenangannya tersebut. Hambatan pencegahan penyelesaian
perselisihan terjadi dikarenakan tidak adanya sinergisitas antara Lembaga Adat
Mukim dengan Pemerintah Kabupaten Aceh Besar, penetapan batas gampong tidak
dilakukan secara berkala, dan Imeum Mukim sebagai ketua lembaga adat mukim
tidak memahami batas gampong dalam wilayah kedudukannya. Upaya pencegahan
perselisihan batas desa oleh Pemerintah Kabupaten Aceh Besar adalah dengan
melaksanakan Penetapan dan Penegasan Batas Desa sesuai dengan pedoman yang
telah diuraikan dalam Permendagri Nomor 45 Tahun 2016 tentang Pedoman
Penetapan dan Penegasan Batas Desa.
Disarankan kepada Pemerintah Kabupaten Aceh Besar melalui Dinas
Pertanahan Kabupaten Aceh Besar untuk bertindak melaksanakan penyelesaian
perselisihan sesuai dengan ketentuan Peraturan Bupati Aceh Besar, dan
melaksanakan penetapan dan penegasan batas desa khususnya di Kemukiman Siem
Kabupaten Aceh Besar.

Legal certainty over village boundaries can be realised when the determination and affirmation of village boundaries has been carried out by the District/City Government in accordance with applicable laws and regulations. Based on Article 4 paragraph (2) letter c of the Minister of Home Affairs Regulation No. 45/2016 on Guidelines for Determining and Affirming Village Boundaries (Permendagri PPBDes Guidelines), the Aceh Besar District Land Office has the authority to resolve village boundary disputes based on the Permendagri PPBDes Guidelines and Aceh Besar Regent Regulation No. 48/2017 on the Position, Organisational Structure, Duties and Functions and Work Procedures of the Aceh Besar District Land Office. However, in reality, the Aceh Besar District Government has not implemented the settlement of village boundary disputes in Siem Settlement, Darussalam District, Aceh Besar District. Like the dispute that occurred between gampong Lamklat-Lambitra, Lambitra-Lieue, Lieue-Lambiheu Siem, Lamreh-Siem, dan Lamreh-Lam Asan. This research aims to explain the implementation of the settlement of village boundary disputes carried out by the Government of Aceh Besar District. As well as explaining the obstacles and efforts to prevent village boundary disputes by the Government of Aceh Besar District. The method used is empirical juridical research that prioritises field research as primary data and library research as secondary data. This research approach is carried out qualitatively. The data that has been collected is analysed qualitatively which is descriptive analysis. The results showed that the implementation of the settlement of village boundary disputes carried out by the Aceh Besar District Government was to conduct mediation, but the Aceh Besar District Government had not exercised its authority. The obstacles to preventing the settlement of disputes occur due to the absence of synergy between the Mukim Customary Institution and the Aceh Besar District Government, the determination of village boundaries is not carried out regularly, and Imeum Mukim as the head of the mukim customary institution does not understand the village boundaries in his domicile. Efforts to prevent village boundary disputes by the Aceh Besar District Government are to carry out the Determination and Affirmation of Village Boundaries in accordance with the guidelines outlined in Permendagri Number 45 of 2016 concerning Guidelines for Determination and Affirmation of Village Boundaries. It is recommended that the Aceh Besar District Government through the Aceh Besar District Land Office act to resolve disputes in accordance with the provisions of the Aceh Besar Regent Regulation, and carry out the determination and affirmation of village boundaries, especially in the Siem Settlement of Aceh Besar District.
