KONTRIBUSI RETRIBUSI PERIZINAN TERTENTU TERHADAP PENDAPATAN ASLI DAERAH DI KABUPATEN PIDIE JAYA

ABSTRAK

Dalam upaya Pemerintah Kabupaten Pidie Jaya meningkatkan Pendapatan Asli Daerah, Pemerintah Kabupaten Pidie Jaya telah melakukan berbagai pungutan retribusi daerah, salah satu bentuk retribusi daerah tersebut adalah Retribusi Perizinan Tertentu yang diatur dalam Qanun Kabupaten Pidie Jaya Nomor 2 Tahun 2013 tentang Retribusi Perizinan Tertentu di Kabupaten Pidie Jaya sebagaimana telah diubah dengan Qanun Kabupaten Pidie Jaya Nomor 5 Tahun 2018 tentang Perubahan Atas Qanun Kabupaten Pidie Jaya Nomor 2 Tahun 2013 tentang Retribusi Perizinan Tertentu di Kabupaten Pidie Jaya. Namun demikian, kontribusi Pendapatan Asli Daerah dari Retribusi Perizinan Tertentu di Kabupaten Pidie Jaya selama 5 (lima) tahun terakhir terjadi penurunan.
Penelitian ini bertujuan, untuk mengetahui dan menganalisis kontribusi retribusi perizinan tertentu terhadap pendapatan asli daerah di kabupaten pidie jaya, untuk mengetahui dan menganalisis faktor-faktor apa saja yang menjadi penghambat kontribusi penerimaan retribusi perizinan tertentu terhadap pendapatan asli daerah di kabupaten pidie jaya, dan untuk mengetahui dan menganalisis upaya yang dilakukan oleh pemerintah kabupaten pidie jaya untuk meningkatkan pendapatan asli daerah dari sektor retribusi perizinan tertentu.
Metode penelitian yang digunakan adalah penelitian hukum yuridis empiris. Dengan sumber data adalah bahan pustaka yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Analisis data yang digunakan dalam penelitian ini adalah deskriptif kualitatif.
Hasil penelitian menunjukkan kontribusi Retribusi Perizinan Tertentu terhadap Pendapatan Asli Daerah di Kabupaten Pidie Jaya sangat kurang jika dilihat dari target PAD yang telah ditetapkan oleh Pemerintah Kabupaten Pidie Jaya. Faktor-faktor yang menjadi penghambat kontribusi penerimaan retribusi Perizinan Tertentu terhadap Pendapatan Asli Daerah di Kabupaten Pidie Jaya adalah Kurangnya pengawasan dari Dinas Teknis terhadap izin-izin yang menjadi kewenangannya, kurang adanya kesadaran masyarakat dalam mengurus izin, Masih terdapat pegawai yang kurang memahami perhitungan retribusi, Tingkat pendidikan pegawai kurang relevan dengan masalah sehingga tingkat penerimaan kurang mencapai hasil yang maksimal, dan belum adanya Standar Pelayanan pada Dinas Penanaman Modal dan Pelayanan Terpadu Pintu. Upaya yang dilakukan oleh Pemerintah Kabupaten Pidie Jaya untuk meningkatkan Pendapatan Asli Daerah dari sektor Retribusi Perizinan Tertentu adalah meningkatkan basis data objek retribusi perizinan tertentu yaitu mendata kembali objek retribusi yang sudah ada dengan keadaan yang rill di lapangan dengan data yang telah dimiliki sebelumnya.
Diharapkan kepada Pemerintah Kabupaten Pidie Jaya agar bisa memaksimalkan retribusi Perizinan tertentu dengan cara mengevaluasi kembali tarif retribusi yang ada pada Qanun Kabupaten Pidie Jaya Nomor 2 Tahun 2013. Diharapkan kepada Pemerintah Kabupaten Pidie Jaya agar dapat meningkatkan sumber daya manusia pada sektor pelayanan dan juga menyediakan sarana dan prasana guna mengatasi hambatan-hambatan dalam penerimaan retribusi dari sektor perizinan tertentu. Diharapkan kepada Pemerintah Kabupaten Pidie Jaya agar membuat peraturan untuk masing-masing izin pada perizinan tertentu mengenai tata cara pengurusan izin agar lebih memudahkan penyelenggara pelayanan perizinan dalam menjalankan tugasnya dan juga memudahkan masyarakat dalam mengurus perizinan.

THE CONTRIBUTION OF RETRIBUTION OF SPECIFIC LISENCING FOR LOCAL OWN-SOURCE REVENUE IN PIDIE JAYA REGENCY

ABSTRACT

In the effort of the Government of Pidie Jaya Regency to increase Local Own-Source Revenue, the Government of Pidie Jaya Regency has made various regional retributions, one of the forms of the regional retribution is the Specific Licensing Retributions regulated in the Pidie Jaya Regency Qanun Number 2 of 2013 concerning Specific Licensing Retributions in Pidie Jaya Regency as amended by Qanun of Pidie Jaya Regency Number 5 of 2018 concerning Amendments to Qanun of Pidie Jaya Regency Number 2 of 2013 concerning Specific Licensing Retributions in Pidie Jaya Regency. However, the contribution of Local Own-source Revenues from Specific Licensing Retribution in Pidie Jaya Regency during the last 5 (five) years has decreased.
This study aims to find out and to analyze the contribution of specific licensing retribution on regional own-source revenues in Pidie Jaya regency, to find out and analyze what factors that become the obstacles of the contribution of the acceptance from certain licensing retribution towards the local own-source revenue in Pidie Jaya regency, and to find out and analyze the efforts made by the government of Pidie Jaya regency in order to increase local own-source revenue from Specific Licensing Retribution.
The method used in this research is an empirical juridical research. The data source is library materials consisting of primary legal materials, secondary legal materials and tertiary legal materials. The analysis of the data that is used in this research is descriptive qualitative.
The results of this research indicate that the contribution of Specific Licensing Retribution to the Local Own-source Revenues in Pidie Jaya Regency was very less, if we see from the target of PAD (Local Own-source Revenue) that has been set by the Government of Pidie Jaya Regency. The factors which become the obstacles the contribution of the acceptance from Specific Licensing Retribution on Local Own-source Revenue in Pidie Jaya Regency are the lack of supervision from the Technical Department on the licenses under its authority, the lack of public awareness in administering the permits, there are still employess who do not understand the calculation of retribution, the education level of employees is less relevant to the problem so that the level of the acceptance does not achieve a maximum results, and The absence of Service Standards at Department of Investment and One-Stop Integrated Services. The effort made by the Government of Pidie Jaya Regency in order to increase the Regional Local Own-source Revenue from the Specific Licensing Retribution is by increasing the database of objects for specific licensing Retribution, which is by re-record the existing retribution with the actual conditions in the field and with the data that was previously owned.
It is expected that the Pidie Jaya Regency Government can maximize specific licensing retribution by re-evaluating the existing retribution rates in Qanun of Pidie Jaya Regency Number 2 of 2013. The Government of Pidie Jaya Regency is expected to be able to increase human resources in the service sector and also provide facilities and infrastructures to overcome the obstacles in the acceptance of retribution from certain licensing sectors. It is expected that the Government of Pidie Jaya Regency will make regulations for each permit in specific licensing regarding the procedure for obtaining permits so that it will be easier for the licensing service providers to carry out their duties and also make it easier for the community to administer the licenses.
