Kewajiban alimentasi orang tua terhadap anak tercantum dalam Pasal 45 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Pasal 26 Undang-Undang Nomor 35 Tahun 2014 tentang perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Kewajiban alimentasi orang tua terhadap anak tidak akan hilang walaupun anak sudah dititipkan di yayasan. Kenyataannya di Yayasan SOS Children’s Village di Desa Lamreung ditemukan beberapa anak-anak yang ditelantarkan oleh orang tua dengan tidak pernah dikunjungi, dihubungi, dan dinafkahi sejak berada di yayasan tersebut.

Tujuan penelitian ini adalah untuk menjelaskan faktor orang tua tidak melaksanakan kewajiban alimentasi terhadap anaknya, pemenuhan kewajiban dan hak-hak anak yang diberikan oleh Yayasan SOS Children’s Village bagi anak yang diabaikan oleh orang tua, dan sanksi hukum baik secara perdata maupun pidana bagi orang tua yang menelantarkan anaknya.

Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Data diperoleh melalui penelitian kepustakaan dan lapangan. Analisis data menggunakan pendekatan kualitatif dan penyusunan hasil penelitian dilakukan dengan menggunakan metode deskriptif.

Hasil penelitian menunjukkan bahwa faktor orang tua tidak melaksanakan kewajiban terhadap anak dikarenakan faktor ekonomi dan sosial, serta faktor kurangnya kesadaran orang tua terhadap anak. Seperti: faktor kekerasan dalam rumah tangga (KDRT), perceraian orang tua (broken home), anak korban kekerasan fisik/psikis, orang tua terlibat permasalahan hukum, dan lain-lain. Pemenuhan hak-hak anak yang diberikan oleh Yayasan SOS Children’s Village di Desa Lamreung bagi anak yang diabaikan oleh orang tua yaitu hak atas tempat tinggal dan makanan, keluarga, kesehatan, pendidikan, perlindungan, dan dapat bersosialisasi dengan lingkungan sosial. Pemenuhan kewajiban yang diberikan yaitu pengasuhan untuk anak dan kewajiban atas pendidikan, keterampilan, serta bakat. Yayasan SOS Children’s Village di desa Lamreung tidak ada sanksi bagi orang tua yang menelantarkan anak seperti dalam Pasal 77B Undang-Undang tentang Perlindungan Anak dan Pasal 49 Undang-Undang tentang Penghapusan Kekerasan Dalam Rumah Tangga.

Disarankan kepada Yayasan SOS Children’s Village di Desa Lamreung untuk melanjutkan pelayanan yang telah terlaksana dan belum terlaksana, Kepada Dinas Sosial Aceh untuk meningkatkan sosialisasi, serta kepada pemerintah agar menerapkan sanksi sesuai Undang-Undang Perlindungan Anak dan UU PKDRT guna mencegah penyimpangan dan mendukung pelaksanaan sesuai dengan ketentuan hukum.

The obligation of parents to provide for their children is stipulated in Article 45 of Law Number 1 of 1974 concerning Marriage and Article 26 of Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection. A parent's obligation to provide child support does not cease even if the child is placed in a foundation. In fact, at the SOS Children's Village Foundation in Lamreung Village, several children were found to have been abandoned by their parents, who never visited, contacted, or provided financial support for them since they were placed in the foundation. The purpose of this study is to explain the factors why parents fail to fulfill their obligation to provide child support, the fulfillment of children’s rights and obligations provided by the SOS Children’s Village Foundation for children neglected by their parents, and the legal sanctions, both civil and criminal, for parents who abandon their children. The research method used in this study is legal empirical. Data was obtained through literature and field research. Data analysis used a qualitative approach, and the research results were compiled using a descriptive method. The results of the study indicate that the factors contributing to parents' failure to fulfill their obligations to their children are economic and social factors, as well as a lack of parental awareness of their children's needs. These include: domestic violence (DV), parental divorce (broken home), children who are victims of physical/psychological abuse, parents involved in legal problems, and others. The fulfillment of children's rights provided by the SOS Children's Village Foundation in Lamreung Village for children neglected by their parents includes the right to shelter and food, family, health, education, protection, and the ability to socialize with the social environment. The fulfillment of obligations includes childcare and the obligation to provide education, skills, and talents. The SOS Children’s Village Foundation in Lamreung Village does not impose sanctions on parents who abandon their children, as stipulated in Article 77B of the Child Protection Law and Article 49 of the Law on the Elimination of Domestic Violence. It is recommended that the SOS Children’s Village Foundation in Lamreung Village continue the services that have been implemented and those that have not yet been implemented. The Aceh Social Affairs Department is urged to enhance public awareness, and the government is encouraged to enforce penalties in accordance with the Child Protection Law and the Domestic Violence Elimination Law to prevent deviations and support implementation in compliance with legal provisions.
