Pasal 54 Undang-Undang Nomor 39 Tahun 2007 Tentang Cukai menyatakan bahwa Setiap orang yang menawarkan, menyerahkan, menjual, atau menyediakan untuk dijual barang kena cukai yang tidak dikemas untuk penjualan eceran atau tidak dilekati pita cukai atau tidak dibubuhi tanda pelunasan cukai lainnya sebagaimana dimaksud dalam Pasal 29 ayat (1) dipidana dengan pidana penjara paling singkat 1 (satu) tahun dan paling lama 5 (lima) tahun dan/atau pidana denda paling sedikit 2 (dua) kali nilai cukai dan paling banyak 10 (sepuluh) kali nilai cukai yang seharusnya dibayar. Tetapi dalam praktiknya masih ada penjual rokok tanpa pita cukai di Kota Banda Aceh
Tujuan penulisan skripsi ini untuk mengetahui penegakan Hukum terhadap penjual atau pengedar Rokok tanpa pita cukai. untuk mengetahui tindak pidana penjual rokok tanpa pita cukai tidak diselesaikan dijalur pengadilan dan untuk mengetahui upaya yang dilakukan penegak hukum dalam mengatasi penyebaran rokok tanpa pita cukai
Metode penelitian dalam penelitian ini adalah yuridis empiris. Data penelitian yang digunakan diperoleh dari data primer berupa hasil wawancara dengan responden dan informan, serta data sekunder berupa literatur kepustakaan, mencakup buku teks, teori, peraturan perundang-undangan.
Hasil penelitian menunjukkan bahwa penegakan ini melibatkan operasi, sosialisasi, dan pengawasan yang intensif serta kerja sama antara berbagai pihak, termasuk masyarakat, dalam memberikan informasi yang membantu. tindak pidana penjual rokok tanpa pita cukai tidak diselesaikan dijalur pengadilan karena banyak kasus rokok ilegal diselesaikan melalui sanksi secara langsung, seperti denda dan penyitaan, karena proses ini lebih efisien dibandingkan melalui jalur pengadilan. Upaya yang dilakukan seperti upaya pre-emtif dilakukan melalui sosialisasi kepada masyarakat tentang risiko hukum dan bahaya kesehatan rokok ilegal serta pengawasan ketat terhadap produsen rokok, upaya preventif dilakukan dengan pengawasan rutin di pasar, toko, dan wilayah rawan peredaran rokok ilegal. Sementara itu, upaya represif melibatkan penindakan langsung terhadap pelanggar dengan penangkapan, penyitaan barang bukti, dan penerapan sanksi tegas untuk memberikan efek jera.
Disarankan kepada masyarakat baik sebagai penjual maupun konsumen dari rokok illegal untuk memiliki kesadaran dalam mentaati aturan yang berlaku Kepada Bea dan Cukai untuk lebih meningkatkan pengawasan terhadap peredaran rokok illegal dan Bea dan Cukai perlu mensosialisasikan tentang larangan peredaran rokok tanpa cukai kepada masyarakat secara umum

Article 54 of Law Number 39 of 2007 concerning Excise states that Any person who offers, delivers, sells, or provides for sale excise goods that are not packaged for retail sale or are not affixed with excise stamps or are not affixed with other excise payment marks as referred to in Article 29 paragraph (1) shall be punished with imprisonment of at least 1 (one) year and a maximum of 5 (five) years and/or a fine of at least 2 (two) times the excise value and a maximum of 10 (ten) times the excise value that should be paid. But in practice there are still cigarette sellers without excise stamps in Banda Aceh City The purpose of writing this thesis is to find out the enforcement of the law against sellers or distributors of cigarettes without excise stamps. to find out the criminal acts of cigarette sellers without excise stamps that have not been resolved in court and to find out the efforts made by law enforcement in overcoming the distribution of cigarettes without excise stamps The research method in this study is empirical juridical. The research data used were obtained from primary data in the form of interview results with respondents and informants, as well as secondary data in the form of library literature, including textbooks, theories, laws and regulations. The results of the study indicate that this enforcement involves intensive operations, socialization, and supervision as well as cooperation between various parties, including the community, in providing helpful information. Criminal acts of selling cigarettes without excise stamps are not resolved in court because many cases of illegal cigarettes are resolved through direct sanctions, such as fines and confiscation, because this process is more efficient than through the courts. Efforts made such as pre-emptive efforts are carried out through socialization to the community about the legal risks and health hazards of illegal cigarettes and strict supervision of cigarette producers, preventive efforts are carried out through routine supervision in markets, shops, and areas prone to the circulation of illegal cigarettes. Meanwhile, repressive efforts involve direct action against violators by arresting, confiscating evidence, and implementing strict sanctions to provide a deterrent effect. It is recommended to the public, both as sellers and consumers of illegal cigarettes, to be aware of obeying the applicable regulations. Customs and Excise need to increase supervision of the circulation of illegal cigarettes and Customs and Excise need to socialize the prohibition on the circulation of cigarettes without excise to the public in general.
