Penelitian ini dilatarbelakangi oleh permasalahan dalam pelanggaran hak cipta yang sering terjadi di masyarakat karena sangat berkaitan dengan hak ekonomi seseorang yang dilanggar. Hak ekonomi atas suatu ciptaan dipegang oleh pencipta dan pemegang hak cipta, seperti kasus antara Deddy Fan Buntoro dan Deddy Krisniadi dalam Putusan Nomor 324/PDT.SUS-HKI/2021.

Tujuan dari penelitian ini ialah untuk mengetahui Pertimbangan Majelis Hakim Mahkamah Agung dalam menetapkan perkara Nomor 324 K/Pdt.SusHKI/2021, serta untuk mengetahui dan menjelaskan rasa keadilan dalam Putusan Mahkamah Agung dalam perkara Nomor 324 K/Pdt.Sus-HKI/202 bagi pihak yang berperkara.

Penelitian ini bersifat studi kasus, termasuk jenis penelitian yuridis
normatif. Studi yang digunakan adalah studi kepustakaan. Teknik pengumpulan data yang digunakan adalah studi dokumen hukum berupa putusan pengadilan yang berkaitan dengan permasalahan yang diteliti.

Berdasarkan hasil penelitian, yang menjadi dasar Pertimbangan Hakim Mahkamah Agung dalam memperbaiki Amar Putusan menetapkan perkara Nomor 324 K/Pdt.Sus-HKI/2021 yaitu, Hakim Mahkamah Agung menilai gugatan yang diajukan oleh penggugat tidak memiliki korelasi ataupun hubungan timbal balik yang jelas antara subjek, posita, dan petitum gugatan, sehingga keberatan dari tergugat adalah berdasar hukum dan dapat diterima. Maka dari itu penulis menilai Hakim pada Pengadilan Negeri Niaga tidak cermat, tepat, serta tidak memenuhi asas keadilan dan kepastian hukum. Selanjutnya Majelis Hakim Mahkamah Agung dalam Memutus Perkara Nomor 324 K/Pdt.Sus-HKI/2021, Hakim Mahkamah Agung telah memberikan rasa keadilan bagi kedua belah pihak, dimana setelah digali lebih dalam mengenai permasalahan yang ada, Hakim pada pengadilan tingkat kasasi telah memutuskan perkara dengan menerima eksepsi dari tergugat, serta menyatakan bahwa hak cipta motif batik Tunas Bangsa tersebut adalah milik Tergugat.

Majelis hakim Pengadilan Negeri Niaga dalam memutuskan perkara harus memperhatikan secara mendetail fakta yang terungkap dalam persidangan. Majelis hakim juga harus memperhatikan seluruh ketentuan peraturan perundang-undangan yang berkaitan dengan perkara, sehingga dalam melaksanakan pertimbangannya majelis hakim tidak melakukan suatu kekeliruan terhadap putusan yang akan diputuskan serta melakukan penafsiran hukum secara seksama sehingga rasa keadilan dapat dirasakan oleh pihak-pihak dalam perkara dan masyarakat secara luas.

This research is motivated by the problem of copyright infringement which often occurs in society because it is closely related to a person's economic rights being violated. Economic rights to a work are held by the creator and copyright holder, as in the case between Deddy Fan Buntoro and Deddy Krisniadi in Decision Number 324/PDT.SUS-HKI/2021. The purpose of this research is to find out the considerations of the Supreme Court Judges in determining case Number 324 K/Pdt.SusHKI/2021, as well as to find out and explain the sense of justice in the Supreme Court Decision in case Number 324 K/Pdt.Sus-HKI/202 for litigants. This research is a case study, including a type of juridical research normative. The study used is a literature study. The data collection technique used is the study of legal documents in the form of court decisions relating to the problems studied. Based on the results of the research, which became the basis for the consideration of the Supreme Court Judges in revising the Decree regarding case Number 324 K/Pdt.Sus-HKI/2021, namely, the Supreme Court Judge assessed that the lawsuit submitted by the plaintiff did not have a clear correlation or reciprocal relationship between the subjects. , posita and petitum of the lawsuit, so that the defendant's objections are legally based and can be accepted. Therefore, the author assesses that the judges at the Commercial District Court are not careful, precise, and do not fulfill the principles of justice and legal certainty. Furthermore, the Panel of Supreme Court Judges in deciding Case Number 324 K/Pdt.Sus-HKI/2021, the Supreme Court Judges have provided a sense of justice for both parties, where after digging deeper into the existing problems, the Judges at the cassation level court have decided the case by accepting the defendant's exception, and stating that the copyright to the Tunas Bangsa batik motif belongs to the Defendant. The panel of judges at the Commercial District Court, in deciding cases, must pay detailed attention to the facts revealed in the trial. The panel of judges must also pay attention to all provisions of laws and regulations relating to the case, so that in carrying out their considerations the panel of judges does not make any mistakes regarding the decision to be decided and interprets the law carefully so that a sense of justice can be felt by the parties in the case and the public. extensively.
