(LENA FARSIA, S.H., M.H., LL.M.) Human rights are the fundamental rights of human from their birth as a gift from God to the end of their life. Children with disabilities need special attention to fulfill their rights, especially the right to education. In the implementation of the rights of persons with disabilities, the Convention on the Rights of Persons with Disabilities was issued, which Indonesia later ratified into the Act No. 19 of 2011. After a few years, the Indonesian government also passed the Law on Persons with Disabilities, Law Number 8 of 2016, which adopted the CRPD. The Aceh provincial government passed Aceh Governor Regulation No. 4 of 2011 and Aceh Governor Regulation No. 92 of 2012 on the subject of inclusive education to ensure that students with disabilities to have access to a quality education. The aims of this research are to analyze how the Banda Aceh government fulfils the right to education of disabled children in Banda Aceh, what the challenges faced by the Banda Aceh Government in ensuring that children with disabilities have the right of education and what the obstacle faced by the Banda Aceh Government in ensuring disabled children to have education. The research method used is empirical-juridical. Data in this thesis research is obtained from library research and field research. Library research is carried out by reading books, journals, court judgments, texts and laws that are secondary data, while field research is done by interviewing respondents who are primary data; sampling methods are done by total sample analysis and data analysis is qualitative data analysis. From the results shows that the government of Banda Aceh has supported the existences of the special school for disabled children, issuing the regulations add also providing a special education training for teachers. Besides, the Banda Aceh government also provides education funds and provides autism therapy facilities. However, there are obstacles to the implementation of this policy, including financial constraints, inadequate infrastructure, a shortage of teachers, public misunderstandings, and insufficient specialized training. It is recommended that the Banda Aceh government should pay attention to the fulfillment of the needs of means and benefits for people with disabilities, focusing on eliminating discrimination and promoting equal access to education for children with disabilities. Emphasize implementing and enforcing regulations effectively, providing specialized training for educators, enhancing funding and infrastructure, and fostering community awareness. Banda Aceh government should provide socialization to the society about importance to get education for disable children.
