(Dr. M. Ya’kub Aiyub Kadir) Afghanistan refugees are refugees who’ve already fled their country due to protracted conflict since decades ago. Currently the Taliban is a de facto fragile government who just has succeeded from previous regime by the end of 2021. The Taliban control Afghanistan and carry out violation to human rights by massacring civilians and their enemies. This caused 7.460 Afghanistan refugees to flee to Indonesia as a transit state to reach a destination country that ratified the 1951 convention. The purpose of this study is to find out what is Indonesian responsibility under international law to Afghanistan refugee, to find out how far Indonesian government has provided educational rights granted to Afghanistan refugee, and to find out how far the cooperation between Universities and UNHCR related to the implementation of the higher education rights of Afghanistan refugee in Indonesia. The data was gathered through library research and field investigation using a normative-empirical strategy. Literature research was conducted by studying books, public files on the official UNHCR website, while field research was conducted by interviewing representatives of United Nations High Commissioner for Refugees (UNHCR), International Organization of Migration (IOM), Jesuit Refugee Service (JRS), Immigration, and the Geutanyoe Foundation. Indonesia has not ratified the 1951 Convention and the 1967 Protocol relating to the status refugees. But Indonesia has ratified the Convention on the Rights of the Child (CRC) and the International Covenant on Economic, Social and Cultural Rights (ICESCR) which means that refugees are entitled to basic rights such as the right to education. The Indonesian government deserves appreciation because in June 2019 the Ministry of Education and Culture issued a circular letter on education for school-age refugee children. However, refugee children can attend formal schools. As for higher education for refugees, the cooperation between UNHCR and Universities in Indonesia regarding higher education for refugees should also be appreciated because Afghanistan refugees have received higher education at several universities in Indonesia. It is suggested to the Indonesian government to make legal products related to the right to education for refugees, ranging from basic education to higher education.
