Perburuan Satwa yang dilindungi pada kenyataan saat ini di Provinsi Aceh dari tahun ke tahun terus bertambah seperti perburuan harimau sumatra, gajah sumatra, beruang sumatara, burung rangkong. Dalam kurung waktu Tahun 2017 S/D Tahun 2020 terdapat 24 kasus yang telah ditangani oleh Penyidik Kepolisian dan Balai Konservasi Sumber Daya Alam Aceh. Perburuan satwa yang dilindugi secara ilegal menjadi ancaman serius bagi kelestarian satwa liar di Indonesia. Satwa yang dilindungi yang diburu dan diperdagangkan secara ilegal berdasarkan berbagai fakta yang ditemukan dilapangan kebanyakan adalah hasil tangkapan dari alam, bukan dari penangkaran. Balai Konservasi Sumber Daya Alam sebagai lembaga yang mempunyai peranan penting yang strategis dalam upaya penyelamatan dan perlindungan Satwa langka berdasarkan Undang-Undang No.5 Tahun 1990 Tentang Konservasi Sumber Daya Alam Hayati Dan Ekosistemnya..
Tujuan Penelitian ini adalah untuk mengetahui dan menjelaskan Peran Penyidik Kepolisian dan Balai Konservasi Sumber Daya Alam Aceh dalam Penyidikan tindak Pidana Perburuan satwa yang dilindungi, kendala yang dihadapi oleh Penyidik Kepolisian dan Balai Konservasi Sumber Daya Alam Aceh dalam Penyidikan tindak pidana perburuan satwa yang dilindungi dan upaya yang dilakukan Penyidik Kepolisian dan Balai Konservasi Sumber Daya Alam Aceh untuk mengatasi kendala dalam Penyidikan tindak pidana perburuan satwa yang dilindungi.
Penulisan tesis ini menggunakan metode penelitian yuridis empiris. Metode atau cara analisis adalah dengan cara pengumpulan data lapangan (primer) melalui wawancara dan observasi langsung dan untuk data pendukung (sekunder) adalah melalui studi kepustakaan, peraturan Perundang-undangan, jurnal dan hasil penelitian ilmiah.

Berdasarkan hasil penelitian diketahui bahwa Balai Konservasi Sumber Daya Alam Aceh saat ini ketika ada kasus tindak pidana perburuan satwa yang dilindungi hanya sebatas penanganan barang bukti dan keterangan ahli sedangkan pada Penyidikan dilakukan oleh Penyidik Kepolisian ditingkat Polres maupun tingkat Polda Aceh. Kendala yang dihadapi oleh Penyidik Kepolisian Balai Konservasi Sumber Daya Alam Aceh terbagi menjadi lima faktor yaitu: faktor hukum, faktor Penegak Hukum, faktor fasilitas, faktor masyarakat dan faktor kebudayaan. Upaya yang dilakukan Penyidik Kepolisian dan Balai Konservasi Sumber Daya Alam Aceh untuk mengatasi kendala dalam Penyidikan tindak pidana perburuan satwa yang dilindungi adalah dengan pre-emtif (pembinaan), Preventif (pencegahan) dan represif (Penindakan).
Diharapkan kepada pihak kepolisian khususnya Ditreskrimsus Polda Aceh dan Balai Konservasi Sumber Daya Alam Aceh agar mengadakan sosialisasi, monitoring, seminar, dan penyuluhan agar masyarakat lebih paham tentang satwa-satwa yang dilindungi yang mana tidak menjadi perburuan. Disarankan kepada Pemerintah Aceh harus mendukung Instansi Penegak Hukum supaya terus menjaga dan melestarikan keanekaragaman hayati yang dimiliki Aceh dan mendukung secara penuh Penyidikan yang dilakukan Oleh Penyidik Kepolisian .

ABSTRACT

THE ROLE OF POLICE INVESTIGATIORS AND NATURAL RESOURCE CONSERVATION AGENCIES IN ENFORCING LAWS ON PROTECTED HUNTING CRIMES

Animal poaching is protected in the current reality in Aceh Province from year to year increasing such as sumatran tiger hunting, sumatran elephant, sumatara bear, hornbill. In the 2017 to 2020 period there are 24 cases that have been handled by police investigators and aceh natural resources conservation center. Article 39 paragraph (3) of Law No. 5 of 1990 on the Conservation of Biological Natural Resources and their ecosystems has given special authority to civil servant investigators of the Natural Resources Consetvasi Hall to conduct investigations into the criminal acts of hunting protected animals. However, in practice there are no more Civil Servant Investigators at aceh Natural Resources Conservation Center which in fact all cases of protected animal poaching crimes are transferred to police investigators.
The purpose of this research is to know and explain the Role of Police Investigators and Civil Servant Investigators of Aceh Natural Resources Conservation Center in the Investigation of protected animal poaching crimes, the obstacles faced by police investigators and civil servant investigators of Aceh Natural Resources Conservation Center in the investigation of protected animal poaching crimes and efforts made by police investigators and civil servant investigators of Aceh Natural Resources Conservation Center to overcome obstacles in the investigation of poaching crimes protected animals.
The writing of this thesis uses empirical juridical research methods. The method or method of analysis is by means of field data collection (primary) through interviews and direct observation and for supporting data (secondary) is through literature studies, legislation, journals and scientific research results.

Based on the results of the study it is known that the Aceh Natural Resources Conservation Center is currently when there are criminal cases of poaching protected animals only limited to the handling of evidence and expert information while in the investigation is carried out by police investigators at the police level as well as the aceh police level. The obstacles faced by police investigators and civil servant investigators of Aceh Natural Resources Conservation Center are divided into five factors: legal factors, law enforcement factors, facility factors, community factors and cultural factors. The efforts made by police investigators and civil servant investigators of Aceh Natural Resources Conservation Center to overcome obstacles in the investigation of protected animal poaching crimes are by pre-emtif (coaching), Preventive (prevention) and repressive (Suppression).
It is expected to the police, especially the Aceh Police Department and aceh Natural Resources Conservation Center, to conduct socialization, monitoring, seminars, and counseling so that the community understands more about protected animals that are not poaching. It is recommended that the Aceh Government should support law enforcement agencies in order to continue to safeguard and preserve aceh's biodiversity and fully support the investigation conducted by police investigators..
