ABSTRAK Cambuk merupakan salah satu hukuman yang diatur dalam Qanun Aceh No. 6 Tahun 2014. Esensi dari pelaksanaan hukum cambuk adalah untuk memberikan efek jera. Di mana pelaksanaannya dilakukan di depan khalayak ramai yang bertujuan memberi kesadaran pada pelaku dan sekaligus menjadi peringatan bagi masyarakat agar tidak melakukan perbuatan yang dilarang dalam Qanun Jinayat. Namun demikian, pelaksanaan hukuman cambuk di Kota Banda Aceh belum memberi efek jera. Hal tersebut terbukti berdasarkan data dari Mahkamah Syariyah Aceh, dimana jumlah pelanggar Qanun Jinayat terus mengalami peningkatan dari tahun 2014- 2019. Penelitian ini bertujuan untuk mengetahui proses pelaksanaan hukum cambuk di Banda Aceh. Kemudian, untuk mengetahui efek jera dari penerapan hukum cambuk. Selanjutnya, untuk mengetahui faktor yang menyebabkan peningkatan pelanggar syariat Islam di Banda Aceh. Penulis menggunakan jenis penelitian deskriptif dengan pendekatan kualitatif. Teknik pengambilan data menggunakan teknik purposive sampling. Data diperoleh melalui wawancara mendalam dengan informan yang memenuhi kriteria subjek penelitian serta memberikan informasi relevan yang dibutuhkan dalam penelitian. Hasil penelitian menunjukkan bahwa, adanya hukuman cambuk belum membuat masyarakat jera untuk tidak melanggar aturan yang ada dalam Qanun Jinayat. Penyebab masyarakat tidak mematuhi hukuman itu, disebabkan oleh beberapa faktor. Mulai dari faktor Qanun itu sendiri, kurangnya jumlah aparat penegak hukum, sarana dan fasilitas penegakan hukum yang kurang memadai dan kurangnya kesadaran masyarakat terhadap isi hukum itu. The essence of the implementation of the whip law is to provide a deterrent effect. Where the implementation is carried out in front of a large crowd aimed at giving awareness to the perpetrators and at the same time a warning to the public not to commit acts prohibited in Qanun Jinayat. However, the implementation of flogging in Banda Aceh has not had a deterrent effect. This is evident based on data from the Aceh Syariyah Court, where the number of Qanun Jinayat violators continues to increase from 2014-2019. This research aims to find out the process of implementing the flogging law in Banda Aceh. Then, to find out the deterrent effect of the application of the whip law. Furthermore, to find out the factors that led to the increase of Islamic sharia violators in Banda Aceh. The author uses a descriptive type of research with a qualitative approach. Data retrieval techniques using purposive sampling techniques. The data was obtained through in-depth interviews with informants who met the criteria of the research subject as well as providing the relevant information needed in the study. The results showed that, the existence of whip punishment has not made the public deterrent not to violate the rules in Qanun Jinayat. The cause of society not complying with the punishment, is caused by several factors. Starting from the Qanun factor itself, the lack of number of law enforcement officers, inadequate law enforcement facilities and facilities and lack of public awareness of the content of the law.
