Berdasarkan Pasal 98 ayat (2) Undang-Undang Nomor 11 Tahun&#13;
2006 tentang Pemerintahan Aceh, Aceh diberikan kewenangan untuk&#13;
menyelesaikan masalah sosial kemasyarakatan secara adat dan ditempuh&#13;
melalui Lembaga Adat. Pasal 13 ayat (1) Qanun Aceh Nomor 9 Tahun 2008&#13;
tentang Pembinaan Kehidupan Adat dan Adat Istiadat mengatur jenis&#13;
sengketa/perselisihan adat antara lain perselisihan tentang hak milik dan harta&#13;
bersama (seuhareukat). Namun kenyataannya di Kabupaten Aceh Besar  &#13;
keputusan peradilan adat tidak menyelesaikan sengketa secara final, dan&#13;
putusannya tidak mengikat para pihak sehingga perkaranya diajukan kembali&#13;
melalui peradilan umum dan peradilan lainnya. &#13;
Penelitian ini bertujuan untuk menjelaskan dan menganalisis proses&#13;
penyelesaian sengketa hak milik atas tanah dan harta bersama (seuhareukat)&#13;
melalui peradilan adat di Kabupaten Aceh Besar, pelaksanaan putusan&#13;
peradilan adat dalam menyelesaikan sengketa hak milik dan harta bersama&#13;
(seuhareukat) di Kabupaten Aceh Besar, dan penerimaan para pihak terhadap&#13;
putusan peradilan adat dalam menyelesaikan sengketa hak milik dan harta&#13;
bersama (seuhareukat) di Kabupaten Aceh Besar. &#13;
Penelitian ini merupakan penelitian hukum dengan jenis yuridis&#13;
empiris atau sosiologi hukum. Instrumen pengumpulan data dilakukan melalui&#13;
penelitian kepustakaan dan penelitian lapangan untuk memperoleh data&#13;
sekunder dan data primer. Data diolah dengan tahapan memberikan kode pada&#13;
data (coding), pemeriksaan data (editing), dan menggambarkan jawaban &#13;
(tabulasi), selanjutnya dianalisis melalui pendekatan kualitatif dan bersifat &#13;
deskriptif analitis.&#13;
Berdasarkan hasil penelitian diketahui bahwa proses penyelesaian &#13;
sengketa hak milik dan harta bersama (seuhareukat) melalui peradilan adat di&#13;
Kabupaten Aceh Besar pada umumnya belum mengacu pada pedoman&#13;
penyelenggaraan dan penyelesaian perselisihan/sengketa adat yang dibuat oleh&#13;
MAA, proses peradilan tidak terdokumentasi dengan baik sehingga dapat&#13;
dengan mudah diajukan kembali ke peradilan peradilan umum dan peradilan&#13;
lainnya oleh salah satu pihak. Pelaksanaan putusan peradilan adat dalam &#13;

Kabupaten Aceh Besar sangat tergantung kepada itikad baik para pihak,&#13;
apabila pihak beritikad baik akan melaksanakan dengan segera (serta-merta)&#13;
sesuai keputusan yang dicapai, dan sebaliknya akan enggan atau dapat&#13;
dibatalkan oleh salah satu pihak karena putusan tidak memiliki upaya paksa&#13;
dan hakim formal tidak dapat menolak perkara yang telah diselesaikan melalui&#13;
peradilan adat. Penerimaan para pihak terhadap putusan peradilan adat dalam&#13;
penyelesaian sengketa hak milik atas tanah dan harta bersama (seuhareukat) di&#13;
Kabupaten Aceh Besar pada umumnya belum bersifat mutlak dan mengikat&#13;
untuk dilaksanakan oleh para pihak karena ada pihak yang tidak puas dengan&#13;
putusan yang telah dihasilkannya dan mengajukan kembali ke peradilan&#13;
formal. Disarankan kepada Majelis Adat Aceh (MAA) Kabupaten Aceh Besar&#13;
agar bersinergi dengan Pemerintah Kabupaten Aceh Besar, dan Kepolisian&#13;
Resort Aceh Besar, untuk bersama-sama memberikan bimbingan teknis secara&#13;
berkala kepada perangkat adat Gampong dan Mukim, sehingga mampu secara&#13;
maksimal dan berkualitas dalam menyelesaikan sengketa hak milik atas tanah&#13;
dan harta bersama (seuhareukat) yang timbul dalam masyarakat. Kepada&#13;
Legislatif agar membuat aturan yang memuat mekanisme pengawasan dan&#13;
sanksi bagi para pihak yang mengabaikan atau lalai melaksanakan putusan&#13;
sehingga menjamin putusan peradilan adat bersifat final dan mengikat serta&#13;
tidak diajukan lagi ke peradilan formal lainnya. Kepada para pihak hendaknya&#13;
mentaati dan melaksanakan putusan peradilan adat dengan sukarela dan&#13;
beritikad baik dan menjadikan peradilan adat sebagai alternatif penyelesaian&#13;
sengketa yang bermartabat (cepat, adil, dan netral) untuk melindungi segala&#13;
kepentingan masyarakat.    &#13;

 Based on Article 98 paragraph (2) of Law Number 11 of 2006 concerning&#13;
the Government of Aceh, Aceh is given the authority to settle social problems&#13;
through the customary court in customary institutions. Article 13 paragraph (1) of&#13;
Aceh Qanun Number 9 of 2008 concerning the development of customary life and&#13;
customs has governed several types of customary disputes, including disputes&#13;
over land rights and joint property (seuhareukat). However, in reality, in Aceh&#13;
Besar Regency, the customary court decision did not resolve the dispute&#13;
completely, and the decision is not binding on the parties so that the case could be&#13;
re-submitted to general and other courts.&#13;
 This study aims to explain and analyze the process of resolving land rights&#13;
and joint property (seuhareukat) disputes through customary courts in Aceh Besar&#13;
Regency, the implementation of customary court decisions in resolving disputes&#13;
over land rights and joint property (seuhareukat) in Aceh Besar Regency, and the&#13;
acceptance of the parties to customary court decisions in the resolution of&#13;
disputes over land rights and joint property (seuhareukat) in Aceh Besar Regency.&#13;
 This research is socio-legal research that used an empirical juridical&#13;
approach. The instruments of this research were library research and field&#13;
research that were used to obtain secondary and primary data. The data were&#13;
processed through several stages, that is data coding, data examination (editing),&#13;
and data description (tabulation). Then, the data were analyzed using a&#13;
qualitative approach and descriptive analytics method.&#13;
 Based on the results of the study, it was found that the process of resolving&#13;
disputes over land rights and joint property (seuhareukat) through customary&#13;
court in Aceh Besar Regency generally did not refer to the guidelines for the&#13;
settlement of existing customary disputes made by Aceh Customary Council&#13;
(MAA) and was not well documented. These issues made the case easily be&#13;
resubmitted to general courts or other types of courts by one of the parties. The&#13;
implementation of customary court decisions in the resolution of disputes over&#13;
land rights and joint property (seuhareukat) in Aceh Besar Regency was very&#13;
dependent on the good faith of the parties. If the parties have a good faith, they&#13;
will follow the results of decisions that have been reached immediately. Without&#13;
good faith, the parties might be reluctant to follow the decision, or one party&#13;
might cancel the decision because the court has no coercive efforts, and the &#13;

formal judge cannot refuse a case that has been settled through a customary&#13;
court. The acceptance of the parties to the customary court's decision in settling&#13;
disputes over land rights and joint property (seuhareukat) in Aceh Besar Regency&#13;
was generally not absolute, and the decision was not binding to be carried out by&#13;
the parties because there were parties who were dissatisfied with the decision that&#13;
had been generated and resubmitted the case to a formal court. It is recommended&#13;
that the Aceh Customary Council (MAA) of Aceh Besar Regency synergize with&#13;
the Aceh Besar Regency Government, and the Aceh Besar Police Precinct, to&#13;
jointly provide periodic technical guidance to the Gampong and Mukim&#13;
customary apparatus so that they can maximally and with quality resolve disputes&#13;
over land rights and joint property (seuhareukat) that arise in the community. To&#13;
the legislatures, it is suggested to create a regulation that contains the mechanism&#13;
of supervision and sanctions for parties who ignore the implementation of the&#13;
customary court’s decision to ensure that the decision is final and binding and&#13;
cannot be resubmitted to other formal courts. The parties should obey and&#13;
implement the customary court's decision voluntarily and in good faith and make&#13;
the customary court as an alternative in settling disputes with dignity (fast, fair,&#13;
and neutral) to protect all the interests of the community.&#13;
