KEDUDUKAN NOTARIS SEBAGAI PEJABAT UMUM DITINJAU DARI KONSEP EQUALITY BEFORE THE LAW

ABSTRAK
Notaris adalah pejabat umum selaku pembuat akta notaris dan dalam melaksanakan tugas nya apabila terjadi permasalahaan hukum maka sesuai dengan Pasal 66 ayat (1) Undang-Undang Nomor 2 Tahun 2014 Tentang perubahan atas Undang-Undang Nomor 30 taun 2004 Tentang Jabatan Notaris bahwa Untuk kepentingan proses peradilan, penyidik, penuntut umum, atau hakim dengan persetujuan majelis kehormatan Notaris., Namun dengan keluarnya Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris Pasal 66 ayat (1) MPD diganti dengan MKN artinya untuk pemangilan notaris oleh aparat hukum harus izin dari MKN yang menimbulkan adanya diskriminasi hukum atau tidak adanya persamaan dimata hukum sesuai dengan Undang-Undang Dasar 1945.
Permasalahannya yang dikaji adalah Bagaimanakah kedudukan notaris sebagai saksi terkait dengan akta atau surat dibawah tangan yang dibuatnya terhadap proses peradilan.
Tujuannya adalah Untuk mengetahui bagaimana kedudukan Notaris sebagai saksi terkait dengan akta atau surat dibawah tangan yang dibuatnya terhadap proses peradilan. Hasil penelitiannya adalah kedudukan notaries sebagai saksi terkait dengan akta yang dibuatnya berdasarkan Undang-Undan Jabatan Notaris mengakibatkan proses hukum terhambat akibat menunggu izin dari Majelis Kehormatan Notaris.
Sehubungan dengan prosedur tersebut diatas menunjukkan bahwa pemanggilan notaris oleh penegak hukum harus izin dari Majelis Kehormatan Notaris tidak sesuai dengan Konsep equality before the law

POSITION OF NOTARY AS A GENERAL OFFICIAL REVIEWED FROM THE EQUALITY BEFORE THE LAW CONCEPT

ABSTRACT
Notary is a general official as the maker of a notary deed and in carrying out his duties in the event of a legal problem then in accordance with Article 66 paragraph (1) of Law Number 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning the Position of Notary that for the sake of the process the judiciary, investigator, public prosecutor, or judge with the approval of the Notary Honorary Assembly. However, with the issuance of Law Number 2 of 2014 concerning Notary Position Article 66 Paragraph (1) the MPD is replaced by MKN, meaning that the legal apparatus must be granted permission from the Constitutional Court which creates legal discrimination or lack of equality in the eyes of the law in accordance with the 1945 Constitution.
The problem examined is how the position of the notary as a witness is related the deed or letter under the hand made by him to the judicial process.
The aim is find out how the position of the Notary a witness is related the deed or letter under his hand made against the judicial process. The results his research were the position of the notary a witness related to deed he made based on the Notary Position
Law resulting in legal proceedings being hampered due to waiting for permission from the Honorary Board of Notaries. In connection with the above procedure, it is indicated that the calling of a notary by law enforcers must be licensed by the Honorary Board of Notaries not accordance with the concept of equality before the law
