ABSTRAK

Sengketa tanah merupakan fenomena yang kerap terjadi dalam kehidupan masyarakat. Maka tidak dapat di pungkiri bahwa setiap keperluan tanah memerlukan jaminan kepastian hukum, perlindungan hukum dan penguasaan, kepemilikan, penggunaan maupun pemanfaatan tanah. Permasalahan antara masyarakat gampong Cot dan gampong Kulee dengan PT. SCA di Pidie merupakan konflik sengketa lahan yang telah berlanngsung sejak tahun 1993. Sengketa ini terjadi atas pembangunan PT. SIA oleh PT. SCA di duga memakai tanah masyarakat setempat. Fokus penelitian ini yaitu terhadap konflik sengketa lahan antara masyarakat gampong Cot dan gampong Kulee dengan PT. SCA dan upaya penyelesaian dari pemerintah Pidie. Tujuan penelitian ini untuk mengetahui permasalahan sengketa lahan masyarakat gampong Cot dan gampong Kulee dengan PT. SCA dan penyelesaian oleh pemerintah terhadap konflik tersebut. Pendekatan dalam penelitian ini menggunakan pendekatan Kualitatif deskriptif, dimana menguraikan secara rinci penemuan fakta di lapangan dan hasil penelitian. Teknik pengumpulan data yang digunakan yaitu wawancara, observasi dan dokumentasi. Hasil penelitian ini menunjukkan bahwa konflik yang terjadi antara masyarakat gampong Cot dan gampong Kulee dengan PT. SCA semakin meluas dari konflik perusahaan dengan masyrakat menyebar hingga konflik perusahaan dengan pihak pemerintah. upaya penyelesaian dari pihak pemerintah yaitu pada masa jabatan H. Sarjani Abdulllah pernah membentuk tim fasilitator untuk penyelesaian berupa mediasi antara perusahaan dan masyarakat, tetapi tidak ada hasil yang memuaskan, hasil penelitian akhir saya yaitu pembanguan PT. SIA di tutup sementara dikarenakan konflik yang semakin panas dengan adanya pihak ketiga. Kondisi saat ini masyarakat dan perusahaan menunggu keputusan atau tindak lanjuti dari pemerintah setempat.

ABSTRACT

The land dispute is the phenomena that often happening in the community life. Will not get in pungkiri that every land needs come need a guarantee of legal certainty, the protection of the law and mastery of, ownership of, the use of and land use. Problem that happens between the community gampong to a cot and gampong kulee with PT. Samana image of the great in kabupaten Pidie conflict dispute is land that has been berlanngsung since 1993. The focus of this study namely, on conflict land disputes between the community gampong to a Cot and gampong PT. The purpose of this research to know the problem of land disputes the community gampong to a Cot and gampong Kulee with PT. Samana image by a government against the great and settlement of the conflict. This approach in this study adopted qualitative approaches descriptive, where gives a detailed the discovery of the fact in the field and the results of the study. Data collection techniques used namely interview, observation and documentation. This research result indicates that conflicts that have occurred between the community gampong to a Cot and gampong Kulee with PT. The great samana prevent the widespread image of the conflict company with People spread until conflict company with the government. Administrations are dissatisfied with the resolution on the term of office H. Sarjani Abdulllah team never form a facilitator for the settlement of the problem in the form of mediation between the company and the community, but there was no satisfactory result, the results of the study my end of the construction of the PT. Cement Indonesia Aceh in the cap while due to the conflict that it is getting hotter by the presence of a third party.The current state of the community and companies waiting for a decision or will immediately follow up from local authorities.
