Peraturan Presiden No 54 Tahun 2010 tentang Pengadaan Barang/Jasa Pemerintah dan
perubahannya bahwa dalam Pasal 17 ayat
Tujuan penelitian untuk mengetahui implementasi struktur dan kedudukan kelompok
kerja pada unit layanan pengadaan Aceh sudah sesuai dengan Perpres No 54 tahun 2010
berserta perubahannya, untuk mengetahui konsekuensi yuridis jika penempatan kelompok
kerja dalam struktur dan kedudukan unit layanan pengadaan Aceh belum sesuai
sebagaimana yang diamanahkan oleh Perpres No 54 tahun 2010 berserta perubahannya
Metode penelitian yang digunakan adalah jenis penelitian hukum normatif
Hasil penelitian menunjukan Struktur dan kedudukan kelompok kerja pada unit
layanan pengadaan Pemerintah Aceh belum sesuai dengan Perpres nomor 54 tahun 2010
berserta perubahannya dan Undang-Undang nomor 5 tahun 2014 tentang Aparatur Sipil
Negara dalam Pasal 75 menyebutkan Penilaian kinerja PNS bertujuan untuk menjamin
objektivitas pembinaan PNS yang didasarkan sistem prestasi dan sistem karier. Pegawai
pokja adalah Aparatur Sipil Negara
satuan organisasi sesuai dengan Sasaran Kerja Pegawai

apabila terjadi pelanggaran, kecurangan dalam proses pengadaan barang/jasa, oknum pokja
ULP dikenakan sanksi administrasi, ganti rugi dan/atau dilaporkan secara pidana dalam
Peraturan Gubernur Aceh nomor 4 tahun 2015 Pasal 12 huruf
Disarankan Perlunya revisi terhadap Peraturan Gubernur Nomor 4 Tahun 2015 tentang
Pengadaan Barang/Jasa di Pemerintah Aceh, revisi ini bermaksud untuk mengubah Pokja
ULP Aceh menjadi sepenuhnya berada dibawah Unit Layanan Pengadaan

Presidential Regulation number 54, 2010 on the concerning Procurement of
Government Goods and Services and amendments that in Article 17
This research aims to know the implementation of structure and the position of
working group at the unit of Aceh Procurements whether has been in according with the
Presidential Regulation Number 54, 2010 together its changes, to know the juridical
consequences if the imposition of the working group in the structure and the Aceh’s
Service Procurement has not been in accordance with the Presidential Regulation
Number 54, 2010 together its changes.
This is juridical normative legal research. This research applies secondary as legal
material while primary and tertiary data as additional material.
The research shows The structure and position of the working group on the procurement
unit of the Government of Aceh has not been in accordance with Presidential Decree
Number 54, 2010 along with its amendment and Law number 5, 2014 on the State Civil
Apparatus in Article 75 mentioning the performance of civil servants aimed at ensuring
the objectivity of civil servant development based on achievement system and career
systems. A civil servant is a State Civil Apparatus under the Procurement Services Unit
as per Presidential Regulation number 54, 2010 concerning Procurement of Government
Goods / Services and amendments that in Article 17,
the organization unit in accordance with Employee Work Objecti ves
number. 5, 2014 on State Civil Apparatus
sanctions up to termination in accordance with the provisions of legislation so that they have not
been complied with as mandated by Presidential Regulation number 54, 2010 and their
amendments.
It is recommended that the Aceh Governor’s Regulation Number 4, 2015 on the
goods/services procurement state that the procurement of goods/services should be
revised. It is aimed at changing the position of the group that is under ULP based on
Presidential Regulation Number 54, 2010 together with the changes namely from the
implementation of the task of tender until the performance appraisal as the State Civil
Apparatus
