ABSTRAK&#13;
Perkembangan penerbangan yang semakin pesat membuat kompetisi antar&#13;
perusahan jasa transportasi udara semakin bersaing ketat. Salah satu persaingan yang&#13;
diperaktekkan adalah dengan cara memberikan penawaran tarif tiket yang murah,&#13;
dengan maksud dapat menarik penumpang sebanyak-banyaknya. Dilihat dari sisi&#13;
lain, dengan tarif yang murah tersebut dapat menurunnya kualitas pelayanan yang&#13;
diberikan sehingga berujung kepada terjadinya pelanggaran terhadap hak-hak&#13;
penumpang. Salah satu maskapai penerbangan yang menawarkan tiket dengan tarif&#13;
murah adalah Lion Air. Oleh karena itu penelitian ini bertujuan untuk mengetahui&#13;
tanggung jawab perusahaan penerbangan niaga domestik PT Lion Air terhadap&#13;
penumpangnya di Indonesia.&#13;
Jenis penelitian ini merupakan penelitian yuridis normatif yaitu dilakukan&#13;
dengan cara meneliti bahan pustaka sebagai data sekunder. Selanjutnya data yang&#13;
diperoleh dari penelitian, baik penelitian kepustakaan maupun penelitian lapangan,&#13;
dianalisis dengan menggunakan teknik analisis kualitatif kemudian disajikan dengan&#13;
teknik deskriptif.&#13;
Peraturan perundang-undangan yang memberikan perlindungan hukum&#13;
terhadap penumpang perusahaan penerbangan niaga domestik, antara lain UndangUndang&#13;
&#13;
Nomor 1 Tahun 2009 tentang Penerbangan, Undang-Undang Nomor 8&#13;
Tahun 1999 tentang Perlindungan  Konsumen dan beberapa Peraturan Pemerintah&#13;
serta bebarapa peraturan Menteri Perhubungan. Materi hukum yang diatur di dalam&#13;
peraturan perundang-undangan tersebut menyangkut tanggung jawab perusahaan&#13;
penerbangan, perlindungan hukum dan jumlah ganti rugi terhadap penumpang yang&#13;
dirugikan. Berdasarkan pengamatan penulis, perusahaan penerbangan niaga&#13;
domestik PT Lion Air belum menjalankan sepenuhnya aturan terkait tanggung jawab&#13;
terhadap penumpang dalam hal terjadinya keterlambatan dan pembatalan&#13;
penerbangan.&#13;
Penumpang transportasi udara yang merasa atau mengalami kerugian dapat&#13;
mengajukan gugatan atau klaim kepada perusahaan penerbangan, Penyelesaian&#13;
sengketa dapat ditempuh melalui dua jalur yaitu jalur pengadilan dan jalur di luar&#13;
pengadilan. Disarankan kepada Kementerian Perhubungan untuk meningkatkan&#13;
pengawasan dan menindak tegas maskapai yang melanggar Peraturan Perundangundangan&#13;
dan&#13;
kepada pihak berwenang untuk melakukan perbaikan atau peninjauan&#13;
kembali mengenai jumlah nilai ganti rugi bagi penumpang yang merasa dirugikan.&#13;

PASSENGER PROTECTIONS of PT LION AIR DOMESTIC COMMERCIAL&#13;
AIRLINE IN INDONESIA&#13;

ABSTRACT&#13;
The rapid growth in aviation industry has caused an increased competition&#13;
among airline companies. One of the competitions practiced was to offer cheap&#13;
tickets in order to attract as many passengers as possible. On the other hand, these&#13;
low-cost flight offers, however, often led to the decrease of the service quality,&#13;
which then lead to the occurrence of violations toward the rights of passengers. One&#13;
of the Indonesian airline companies offering a low-cost domestic air travel is Lion&#13;
Air. Therefore, this study aims to evaluate the responsibility of PT Lion Air&#13;
domestic commercial airline toward its passengers in Indonesia.&#13;
This study is a normative juridical study for it was carried out by conducting&#13;
a literature review to obtain the secondary data. All the data collected, both from the&#13;
literature review and field studies, was analyzed qualitatively and presented&#13;
descriptively.&#13;
Laws and regulations providing legal protections toward the passengers of&#13;
domestic commercial airlines include Law No. 1 of 2009 on Aviation, Law No. 8 of&#13;
1999 on Consumer Protection, some Government Regulations, and several&#13;
regulations of the Minister of Transportation. The legal materials regulated in the&#13;
laws include the responsibility of the airlines, legal protections, and the amount of&#13;
compensation for the injured passengers. Based on the author's observations, PT&#13;
Lion Air domestic commercial airline has not fully implemented the rules regarding&#13;
liability for passengers in the event of delays and flight cancellations.&#13;
Violated passengers of air travels may take legal actions or claim to the&#13;
airline. Dispute can be settled either in court or out-of-court. It is suggested to the&#13;
Ministry of Transport to enhance control and take firm measures against the airlines&#13;
violating the laws and regulations. Furthermore, it is suggested as well to the&#13;
authorities to do some improvements or reconsiderations on the amount of&#13;
compensation for the injured passengers.&#13;
