Keberadaan sertifikat ganda hak atas tanah menimbulkan permasalahan terkait kedudukan hukum dari Akta Jual Beli (AJB) yang telah dibuat oleh PPAT. Permasalahan ini sering menjadi perkara di pengadilan yang mana Akta Jual Beli (AJB) hak atas tanah dijadikan dasar gugatan pada masalah sertifikat ganda tersebut. Salah satu fungsi dibuatnya Akta Jual Beli (AJB) oleh PPAT adalah untuk alat bukti apabila adanya sengketa, namun terhadap putusan pengadilan yang menyatakan tidak sah dan tidak berkekuatan hukum sebuah Akta Jual Beli (AJB) maka akan dipertanyakan kedudukan hukum dari Akta Jual Beli (AJB) yang menjadi kewenangan PPAT tersebut.
Penelitian ini bertujuan untuk menganalisis dan menjelaskan kepastian hukum terhadap Akta Jual Beli (AJB) bersertifikat ganda, akibat hukum terhadap Akta Jual Beli (AJB) bersertifikat ganda, dan tanggung jawab PPAT terhadap Akta Jual Beli (AJB) yang dinyatakan tidak sah oleh putusan pengadilan.
Metode penelitian yang digunakan adalah penelitian yuridis empiris. Data primer untuk penelitian ini diperoleh dari data lapangan (field research) dengan teknik pengumpulan data berupa wawancara. Data tersebut dianalisis dengan pendekatan kualitatif yang menghasilkan data deskriptif analisis.
Hasil penelitian menunjukkan bahwa kepastian hukum Akta Jual Beli (AJB) yang dibuat oleh PPAT dinilai dari kesesuaian dan kepatuhan PPAT terhadap prosedur yang berlaku. Sebelum ada putusan pengadilan yang berkekuatan hukum tetap, maka akta tersebut tetap harus dianggap sah. Dalam hal ini proses pembuktian di persidangan menjadi hal penting untuk putusan hakim. Akibat hukum sebelum ada putusan pengadilan berupa keraguan terkait keabsahan dan legalitas akta, penurunan atau kehilangan kekuatan hukum terhadap akta, pembeli beritikad baik mengalami kerugian karena tidak dapat memanfaatkan tanah yang sudah dibeli, dan berkurangnya kepercayaan masyarakat terhadap PPAT. Akibat hukum setelah ada putusan pengadilan yaitu Akta Jual Beli (AJB) bersertifikat ganda dapat dibatalkan dan batal demi hukum. Tanggung jawab PPAT terhadap Akta Jual Beli (AJB) yang dibuatnya adalah tanggung jawab berdasarkan kesalahan. Bentuk tanggung jawabnya terdiri atas tanggung jawab etik, tanggung jawab administratif, tanggung jawab perdata, dan tanggung jawab pidana.
Disarankan kepada PPAT untuk selalu mematuhi prosedur dan ketentuan hukum dalam membuat Akta Jual Beli (AJB), Kantor Pertanahan senantiasa menerapkan prinsip kehati-hatian sehingga hanya akan menimbulkan akibat hukum yang dikehendaki terhadap Akta Jual Beli (AJB) maupun sertifikat, serta PPAT harus teliti dengan bertindak sesuai peraturan dan kode etik untuk meminimalisir kesalahan yang mengharuskannya bertanggungjawab.

The existence of duplicate land title certificates gives rise to legal issues concerning the legal status of a Deed of Sale and Purchase executed by a Land Deed Official. This issue frequently becomes the subject of litigation, in which the Deed of Sale and Purchase of land rights serve as the basis of a claim involving duplicate land certificates. One of the primary functions of a Deed of Sale and Purchase executed by a Land Deed Official is to serve as evidence in the event of a legal dispute. However, where a court decision declares the Deed of Sale and Purchase invalid and without legal force, the legal standing of the Deed of Sale and Purchase, which falls within the authority of the Land Deed Official, becomes questionable. This study aims to analyze and explain the legal certainty of a Deed of Sale and Purchase involving duplicate land certificates, the legal consequences of a Deed of Sale and Purchase involving duplicate land certificates, and the liability of the Land Deed Official for a Deed of Sale and Purchase that has been declared invalid by a court decision. This study adopts an empirical juridical research method. Primary data were collected through field research using interviews as the primary data collection method. The data were analyzed using a qualitative approach to produce a descriptive analysis. The results of this study indicate that the legal certainty of a Deed of Sale and Purchase executed by a Land Deed Official is determined by the official’s compliance with the applicable legal procedures and requirements. Until a court decision with final and binding legal force has been issued, the deed must continue to be regarded as legally valid. In this regard, the evidentiary process during court proceedings plays a crucial role in the judge’s determination. Prior to a court decision, the legal consequences include uncertainty regarding the validity and legality of the deed, a reduction or loss of its legal force, financial losses suffered by a bona fide purchaser who is unable to utilize the purchased land, and a decline in public confidence in the Land Deed Official. Following a court decision, a Deed of Sale and Purchase involving duplicate land certificates may be declared void or void ab initio. The liability of the Land Deed Official for the Deed of Sale and Purchase executed by the official is fault-based liability. Such liability may take the form of ethical, administrative, civil, and criminal liability. It is recommended that Land Deed Officials consistently comply with the applicable legal procedures and regulations in executing Deeds of Sale and Purchase. The Land Office should continuously apply the principle of prudence to ensure the Deed of Sale and Purchase and land certificates produce only their intended legal consequences. Furthermore, Land Deed Officials must exercise due diligence by acting in accordance with the applicable laws and professional code of ethics in order to minimize errors that may give rise to legal liability.
