Perkembangan teknologi informasi telah membawa dampak signifikan terhadap perlindungan Hak Cipta, khususnya dalam bentuk ciptaan digital seperti video games. Maraknya kasus penggandaan ilegal video games melalui website download games menunjukkan masih lemahnya efektivitas perlindungan hukum di era digital. Padahal, video games telah diakui sebagai ciptaan yang dilindungi menurut Pasal 40 ayat (1) huruf r Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC). Tindakan penggandaan tanpa izin pencipta bukan hanya merugikan secara ekonomi, tetapi juga merusak ekosistem industri kreatif digital.

Penelitian ini bertujuan untuk menjelaskan perlindungan hukum Hak Cipta video games terhadap penggandaan tanpa izin pencipta, menjelaskan persoalan pengaturan di dalam UUHC yang menyebabkan masih terjadinya penggandaan video games tanpa izin pencipta, serta menjelaskan penegakan hukum Hak Cipta terhadap penggandaan video games tanpa izin pencipta.

Jenis penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Data dikumpulkan melalui studi kepustakaan terhadap bahan hukum primer seperti UUHC, TRIPS Agreement, dan Konvensi Bern, serta bahan hukum sekunder berupa literatur hukum, jurnal, dan artikel yang relevan.

Hasil penelitian menunjukkan bahwa perlindungan hukum Hak Cipta terbagi menjadi preventif dan represif. Secara preventif, negara memberikan hak eksklusif kepada pencipta serta mengakui perlindungan otomatis melalui UUHC pasal 1 angka 1 dan konvensi internasional. Secara represif, penegakan hukum dilakukan melalui jalur perdata yaitu diatur di dalam pasal 99 UUHC, pidana dalam pasal 113 hingga pasal 118 UUHC, maupun administratif diatur dalam Pasal 66 hingga Pasal 73 UUHC. Namun dalam praktiknya, pelaksanaan UUHC masih menghadapi kendala seperti keterbatasan teknologi, sumber daya manusia, dan yurisdiksi terhadap situs ilegal luar negeri, yang menyebabkan penggandaan ilegal tetap marak terjadi.

Disarankan kepada pemerintah agar memperbarui regulasi yang lebih akurat dalam menjamin hak pencipta dan terjalankannya akibat hukum apabila dilanggar, untuk meningkatkan kapasitas aparat penegak hukum, memperkuat sinergi antar lembaga terkait, serta mendorong kerja sama internasional untuk menindak pelanggaran lintas negara. Disarankan kepada pencipta/pemegang Hak Cipta secara aktif melaporkan pelanggaran kepada otoritas dan memanfaatkan jalur hukum yang tersedia, baik perdata maupun pidana. Disarankan kepada masyarakat untuk meningkatkan edukasi sejak dini tentang pentingnya menghargai karya cipta dan konsekuensi hukum pembajakan.

The development of information technology has had a significant impact on copyright protection, particularly for digital creations such as video games. The widespread illegal duplication of video games through download websites reflects the continuing ineffectiveness of legal protection in the digital era. This is despite the fact that video games are recognized as protected works under Article 40 paragraph (1) letter r of Law Number 28 of 2014 concerning Copyright (Indonesian Copyright Law). Unauthorized reproduction not only causes economic losses but also undermines the digital creative industry ecosystem. This research aims to explain the legal protection of video game copyrights against unauthorized duplication, identify the legal shortcomings within the Indonesian Copyright Law that contribute to ongoing unauthorized reproduction of video games, and analyze the enforcement of copyright law against such violations. The research employs a normative juridical method using statutory and conceptual approaches. Data were collected through literature studies involving primary legal materials such as the Indonesian Copyright Law, the TRIPS Agreement, and the Berne Convention, as well as secondary legal materials including legal literature, journals, and relevant articles. The findings indicate that copyright protection is divided into preventive and repressive measures. Preventively, the state grants exclusive rights to creators and recognizes automatic protection under Article 1 point 1 of the Indonesian Copyright Law and relevant international conventions. Repressively, legal enforcement can be pursued through civil remedies, as stipulated in Article 99, criminal sanctions under Articles 113 to 118, and administrative measures under Articles 66 to 73 of the Indonesian Copyright Law. However, the implementation of these laws faces several challenges, such as limitations in technology, human resources, and jurisdiction over foreign illegal websites, which allow illegal duplication to persist. It is recommended that the government revise the regulations to more accurately safeguard creators' rights and ensure legal consequences for violations. It is also necessary to enhance the capacity of law enforcement agencies, strengthen inter-agency cooperation, and promote international collaboration to address cross-border infringements. Creators or copyright holders are encouraged to actively report infringements to authorities and utilize available legal remedies, both civil and criminal. Furthermore, the public should be educated from an early age on the importance of respecting intellectual property and the legal consequences of piracy.
