Penelitian ini mengkaji terkait pelaksanaan program Jaminan Kecelakaan Kerja
(JKK) BPJS Ketenagakerjaan bagi pemberi kerja dan pekerja di Kota Banda Aceh
sesuai dengan Peraturan Pemerintah Nomor 44 Tahun 2015 Pasal 4 ayat (2) yang
mewajibkan pemberi kerja untuk mendaftarkan pekerjanya pada program JKK BPJS
Ketenagakerjaan. Dalam upaya untuk melindungi tenaga kerja dan memastikan
kesejahteraan pekerja, pemerintah telah mengimplementasikan program BPJS
Ketenagakerjaan yang mencakup berbagai jaminan, termasuk Jaminan Kecelakaan
Kerja (JKK). Namun, masih terdapat ketidakpatuhan dari sejumlah perusahaan dalam
melaksanakan kewajiban mereka terhadap program ini. Penelitian ini bertujuan untuk
mengetahui alasan ketidakpatuhan perusahaan dan faktor-faktor yang menjadi
penghambat ketidakpatuhan perusahaan terhadap program BPJS Ketenagakerjaan di
Kota Banda Aceh. Penelitian ini menggunakan teori tanggung jawab sosial dengan 3
indikator yaitu kesejahteraan karyawan, perlindungan hak-hak pekerja serta
keselamatan dan kesehatan kerja. Jenis penelitian yaitu pendekatan kualitatif
deskriptif dengan metode observasi, wawancara dan dokumentasi. Hasil penelitian
ini menunjukkan bahwasanya ketidakpatuhan perusahaan terhadap program Jaminan
Kecelakaan Kerja (JKK) dikarenakan kurangnya rasa tanggung jawab sosial oleh
pemberi kerja untuk berperilaku sesuai dengan aturan yang telah ditetapkan. Adapun
faktor penghambat kepatuhan perusahaan yang pertama yaitu minimnya pemahaman
pemilik perusahaan, beberapa pemilik perusahaan yang mengaku belum memahami
sepenuhnya proses pendaftaran serta manfaat yang dapat diperoleh. Kedua,
pertimbangan finansial yang sering kali menjadi kendala utama bagi pemilik
perusahaan dalam mendaftarkan pekerjanya karena merasa beban iuran BPJS
Ketenagakerjaan sulit dipenuhi dikarenakan pendapatan yang tidak stabil dan
keterbatasan anggaran. Ketiga, kurangnya kesadaran dan kepatuhan hukum,
meskipun dari segi finansial perusahaan mungkin mampu menanggung biaya iuran,
seringkali ada ketidaksediaan untuk melakukan pendaftaran, yang dapat diakibatkan
oleh minimnya informasi atau sikap tidak peduli terhadap perlindungan yang
seharusnya diberikan kepada tenaga kerja. Diharapkan BPJS Ketenagakerjaan dapat
meningkatkan edukasi dan sosialisasi serta penguatan dan penegakan hukum bagi
perusahan di Kota Banda Aceh agar meningkatnya kepesertaan program BPJS
Ketenagakerjaan.

This study examines the implementation of the BPJS Employment Accident Insurance (JKK) program for employers and workers in Banda Aceh City in accordance with Government Regulation Number 44 of 2015 Article 4 paragraph (2) which requires employers to register their workers in the BPJS Employment JKK program. In an effort to protect the workforce and ensure the welfare of workers, the government has implemented the BPJS Employment program which includes various guarantees, including Work Accident Insurance (JKK). However, there is still non-compliance from a number of companies in carrying out their obligations to this program. This study aims to determine the reasons for company non-compliance and the factors that hinder company non-compliance with the BPJS Ketenagakerjaan program in Banda Aceh City. This research uses social responsibility theory with 3 indicators, namely employee welfare, protection of workers' rights and occupational safety and health. The type of research is a descriptive qualitative approach with observation, interview and documentation methods. The results of this study indicate that company non-compliance with the Work Accident Insurance (JKK) program is due to a lack of a sense of social responsibility by employers to behave in accordance with established rules. The first inhibiting factor for company compliance is the lack of understanding of company owners, some company owners who claim not to fully understand the registration process and the benefits that can be obtained. Second, financial considerations are often the main obstacle for company owners in registering their workers because they feel that the burden of BPJS Ketenagakerjaan contributions is difficult to meet due to unstable income and budget constraints. Third, lack of awareness and legal compliance, although from a financial perspective the company may be able to bear the cost of contributions, there is often an unwillingness to register, which can be caused by a lack of information or an attitude of indifference to the protection that should be provided to the workforce. It is hoped that BPJS Ketenagakerjaan will increase education and socialization as well as strengthen and enforce the law for companies in Banda Aceh City in order to increase the participation of the BPJS Ketenagakerjaan program.
