Penelitian ini bertujuan menjelaskan pelaksanaan kontrak dan penyelesaian wanprestasi dalam kontrak kerja konstruksi antara dinas pekerjaan umum dan penataan ruang aceh dengan pt. juni karya jaya dalam pembangunan jalan sinabang-sibigo. berdasarkan hasil penelitian pelaksanaan kontrak pembangunan jalan sinabang-sibigo tidak terlaksana dengan baik sesuai dengan perjanjian yang telah disepakati dikarenakan adanya wanprestasi yang dilakukan oleh pt. juni karya jaya selaku penyedia jasa yang tidak mampu menyelesaikan pekerjaan sesuai dengan target waktu yang telah ditentukan dan upaya penyelesaian sengketa wanprestasi dilakukan dengan metode musyawarah mufakat melalui scm dimana apabila setelah dilakukannya scm ke 3 namun penyedia jasa tidak dapat menyelesaikan pekerjaannya sesuai waktu yang diberikan maka dilakukan pemutusan kontrak dan dikenakan sanksi pencantuman daftar hitam selama 2 tahun serta pencairan jaminan pelaksana. kpa untuk kedepannya harus mencantumkan terkait dewan sengketa pada kontrak kerja konstruksi dikarenakan telah diatur dalam pp no. 22 tahun 2020 namun tetap berdasarkan hasil 3 kali scm terlebih dahulu dan dalam pelaksanaan pemilihan penyedia jasa diharapkan lebih teliti dalam menyaring penyedia yang bertanggung jawab.

This research aims to analyse the implementation of the contract and the settlement of default in the construction employment contract between the Aceh Public Works and Spatial Planning Office and Juni Karya Jaya LLC in the development of the Sinabang-Sibigo Road. The results of this research showed that the implementation of the Sinabang-Sibigo Road Construction Contract was not conducted properly in accordance with the consented agreement due to the default by Juni Karya Jaya LLC as a Service Provider that is unable to complete the work in accordance with the predetermined time target and the efforts to resolve the default’s dispute are conducted through the method of deliberation and consensus through Show Cause Meeting (SCM) which acknowledge that if after the 3rd SCM has been carried out but the Service Provider is still unable to complete the work within the allotted time, there will be a termination of the contract and a sanction of blacklisting for 2 years and disbursement of the implementing guarantee. The KPA in the future should mention the Dispute Council in the Employment Contract because it has been regulated in the Government Regulation No. 22 of 2020. Nevertheless, It should be conducted based on the result of the previously three times SCM and in the implementation of the selection of Service Providers, it is hoped that they will be more thorough in screening the responsible providers.
