Analisis terhadap penafsiran kampanye di luar jadwal yang telah ditetapkan oleh kpu, kpu provinsi dan kpu kabupaten/kota ahmad yani mohd. din zahratul idami abstrak penegakan hukum terhadap pimpinan/pengurus partai politik menjadi prioritas lembaga sentra penegakan hukum terpadu dalam menyelesaikan persoalan pelaksanaan kampanye di luar jadwal. sebagaimana kasus iklan partai solidaritas indonesia pada 23 april 2018. psi yang memasang iklan alternatif cawapres dan kabinet jokowi 2019-2024 pada koran jawa pos, pada iklan tersebut psi menampilkan 12 foto dan nama cawapres alternatif untuk jokowi. implementasi penegakan hukum oleh instansi dalam sentra penegakan hukum terpadu terjadi perbedaan penafsiran pasal 492 undang-undang nomor 7 tahun 2017 tentang pemilihan umum yang berakibat pada dikeluarkannya perintah penghentian penyidikan (sp3) oleh bareskrim polri. penelitian ini bertujuan, untuk mengetahui dan menganalisis penafsiran kampanye di luar jadwal yang dilakukan oleh gakkumdu dan untuk mengetahui serta menganalisis sanksi yang dapat diterapkan terhadap partai politik yang melaksanakan kampanye di luar jadwal yang telah ditetapkan oleh kpu. penelitian ini merupakan penelitian yuridis empiris, sumber data dalam penelitian ini merupakan data yang diperoleh dari lapangan yang dilakukan dengan observasi dan wawancara (nondirective interview), dan juga dibutuhkan data kepustakaan (library research). metode tersebut didukung dengan penggunaan teori penegakan huku, teori pertangungjawaban pidana dan teori kepastian hukum. hasil penelitian menunjukkan bahwa perbedaan penafsiran pasal 492 undang-undang nomor 7 tahun 2017 tentang pemilihan umum dan tidak ada singkronisasi antar lembaga sentra penegakan hukum terpadu (gakkumdu) dalam penafsiran ketentuan yang ada berakibat pada tidak adanya kepastian hukum. menurut bawaslu unsur “di luar jadwal” adalah ketika kampanye dilaksanakan tidak berdasarkan jadwal, sedangkan kepolisian dan kejaksaan menganggap bahwa unsur kampanye “di luar jadwal” harus berpedoman pada asas legalitas yakni pkpu nomor 23 tahun 2018 tentang kampanye, selama belum ada jadwal kampanye dari kpu yang mengatur terkait kampanye maka tindakan tersebut tidak termasuk dalam kamapnye di luar jadwal dan bentuk sanksi untuk partai politik yang melaksanakan kampanye di luar jadwal dikenai sanksi administrasi, berupa peringatan tertulis, penurunan atau pembersihan bahan kampanye atau alat peraga kampanye dan penghentian iklan kampanye di media cetak, media elektronik, media dalam jaringan, media sosial, dan lembaga penyiaran yang ditindak langsung oleh kpu. disarankan kepada sentra penegakan hukum terpadu (gakkumdu) agar mengedepankan persamaan persepsi dalam penyelesiaan tindak pidana pemilu terutama dalam penafsiran pasal 492 undang-undang nomor 7 tahun 2017 tentang pemilihan umum, untuk memberikan kepastian hukum bagi pelanggarnya. sehingga sentra penegakan hukum terpadu berjalan lebih efektif sebagaimana tujuan sentra penegakan hukum terpadu dibentuk. kata kunci: penegakan hukum, pimpinan partai politik, kampanye di luar jadwal. the analysis of the interpretation set up by central kpu, center of law enforcement agencies in resolving the implementation of the campaign outside the schedule. as the case of the indonesian solidarity party advertisement on 23 april 2018. psi that put the advertisement of alternative her and the cabinet of 2019-2024, in the newspaper jawa pos, on the advertisement of the psi displays 12 photos and names of alternative her to the implementation of law enforcement by the agencies in the integrated law enforcement center there is a difference in interpretation of article 492 act no. 7 of 2017 on the general elections which resulted in a discontinuation of the order to stop investigation (sp3) by bareskrim polri. the research aims to determine and analyse the interpretation of the campaign outside the schedule conducted by gakkumdu and to acknowledge and analyse sanctions that can be applied to political parties that carry out campaigns that have been set out by the kpu. this research is an empirical research study, the data source in this research is the data obtained from the field that is done by observation and interview (nondirective interview), and also needed libraries data (library research). the method is supported by the use of the theory of law enforcement, criminal response theory and the theory of legal certainty. the results showed that the difference in interpretation of article 492 act no. 7 of 2017 on general elections and no syncronization between institutions of integrated law enforcement center (gakkumdu) in the interpretation of existing provisions resulted in the absence of legal certainty. according to the "off-schedule" element bawaslu is when the campaign was carried out not on schedule, while the police and prosecutors considered that the campaign element "out of schedule" should be guided on the legality principle of pkpu number 23 year 2018 about the campaign, as long as there is no scheduled campaign of the kpu governing the campaign, such action is not included in the outside schedule and form of sanctions for political parties conducting campaigns outside of administration sanctions, in the form of written warnings, decline or cleansing of campaign materials or campaign props and the termination of campaign advertising in print, electronic media, networked media, social media, and broadcasting agencies directly acted upon by the kpu. it is recommended to the integrated law enforcement center (gakkumdu) to put forward the similarity of perception in the settlement of election crimes, especially in the interpretation of article 492 act no. 7 of 2017 on general elections, to provide legal certainty for the customer. so that the integrated law enforcement center runs more effectively as the purpose of integrated law enforcement center is established.
