Praktik black campaign (kampanye hitam) merupakan strategi yang menjatuhkan reputasi pelaku usaha pesaing dengan menyebarkan fitnah, hoaks dan infomasi palsu, baik dilakukan sendiri maupun melalui pihak ketiga (buzzer) sehingga merugikan pelaku usaha pesaing. praktik ini belum diatur secara tegas dalam undang-undang nomor 5 tahun 1999 tentang larangan praktek monopoli dan persaingan usaha tidak sehat (uu no. 5 tahun 1999), meskipun demikian praktik tersebut secara implisit diatur oleh pasal 19 uu no. 5 tahun 1999 dan pasal 27 undang-undang nomor 1 tahun 2024 tentang informasi dan informasi elektronik (uu ite). hal ini menimbulkan ketidakpastian hukum bagi korban black campaign mengenai pemilihan instrumen hukum dalam menyelesaikan praktik black campaign dalam bisnis. penelitian ini bertujuan menganalisis pengaturan black campaign dalam hukum persaingan usaha, perlindugan hukum bagi pelaku usaha korban praktik black campaign berdasarkan uu no. 5 tahun 1999 dan uu ite, serta upaya hukum yang dapat ditempuh oleh korban praktik tersebut. penelitian ini merupakan penelitian hukum yuridis normatif dengan mengkaji pasal 19 uu no. 5 tahun 1999 dan pasal 27 uu ite. dengan menggunakan pendekatan perundang-undangan, pendekatan analitis, serta pendekatan perbandingan dengan hukum persaingan usaha di singapura. hasil penelitian ditunjukkan bahwa uu no. 5 tahun 1999 tidak mengatur praktik black campaign secara tegas, namun dapat dikenakan melalui penafsiran luas terhadap pasal 19 uu no. 5 tahun 1999. perlindungan hukum melalui uu no. 5 tahun 1999 diberikan secara tidak langsung melalui pasal 19 dan sangat bergantung pada penegakan hukum oleh kppu. perlindungan hukum melalui uu ite hanya berorientasi pada perlindungan individual saja dan mengabaikan unsur persaingan usaha. perlindungan hukum yang diberikan bersifat tidak langsung dan sangat bergantung pada penegakan hukum oleh komisi pengawas persaingan usaha (kppu) yang memiliki kewenangan terbatas dan sulit untuk melacak aliran dana dari pelaku usaha pendana kepada buzzer sebagai pelaku pihak ketiga. disarankan kepada pemerintah pusat untuk melakukan perubahan atas uu no. 5 tahun 1999 dengan menegaskan ketentuan mengenai black campaign dan memperkuat kewenangan penyelidikan kppu melalui pembaruan hukum tersebut.



Abstract

Abstract — Black campaign practices constitute a strategy aimed at damaging the reputation of competing business actors through the dissemination of defamatory statements, hoaxes, and false information, whether conducted directly or through third parties, such as online buzzers, thereby causing harm to competitors. Although such practices are not expressly regulated under Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition ("Law No. 5 of 1999"), they may be implicitly addressed under Article 19 of Law No. 5 of 1999 and Article 27 of Law Number 1 of 2024 concerning Electronic Information and Transactions ("EIT Law"). This regulatory gap creates legal uncertainty for business actors who become victims of black campaign practices regarding the appropriate legal framework for seeking remedies. This study aims to analyze the legal regulation of black campaign practices within Indonesian competition law, examine the legal protection available to business actors who become victims of such practices under Law No. 5 of 1999 and the EIT Law, and evaluate the legal remedies that may be pursued by affected business actors. This research employs a normative juridical legal research method by examining Article 19 of Law No. 5 of 1999 and Article 27 of the EIT Law. The study adopts a statutory approach, an analytical approach, and a comparative approach by examining competition law in Singapore. The findings demonstrate that Law No. 5 of 1999 does not explicitly regulate black campaign practices; however, such conduct may fall within the scope of Article 19 through a broad interpretation of its provisions. Legal protection under Law No. 5 of 1999 is therefore indirect, relying primarily on the enforcement authority of the Business Competition Supervisory Commission (KPPU). Likewise, protection under the EIT Law focuses primarily on safeguarding individual rights and does not adequately address the competition law dimension of black campaign practices. Consequently, the existing legal protection remains indirect and heavily dependent on KPPU's enforcement, despite its limited investigative powers, particularly in tracing financial transactions between sponsoring business actors and third-party buzzers engaged in the unlawful conduct. Accordingly, it is recommended that the Central Government amend Law No. 5 of 1999 to expressly regulate black campaign practices as a form of unfair business competition and strengthen KPPU's investigative authority through such legislative reform.
