Konstruksi yuridis pemberian hibah dari pemerintah daerah kepada pemerintah pusat rizky wirdatul husna yanis rinaldi** yusri abstrak pelaksanaan desentralisasi memberikan kewenangan kepada pemerintah daerah untuk mengatur dan mengurus urusan pemerintahan serta pengelolaan keuangan daerah melalui anggaran pendapatan dan belanja daerah (apbd), termasuk kebijakan belanja hibah. namun, pemberian hibah dari pemerintah daerah kepada pemerintah pusat, khususnya instansi vertikal termasuk lembaga penegak hukum, menimbulkan persoalan yuridis yang kompleks antara lain karena berpotensi menyempitkan ruang fiskal daerah bagi pemenuhan kewajiban prioritas serta kelemahan mekanisme pengawasan. persoalan ini bersumber dari ketidakjelasan rumusan norma dalam permendagri nomor 77 tahun 2020, khususnya frasa mengenai kemampuan keuangan daerah dan syarat pemberian hibah kepada pemerintah pusat, yang tidak dilengkapi indikator maupun tolok ukur yang rinci, sementara peraturan kepala daerah cenderung mereproduksi norma pusat tanpa penjabaran teknis yang kontekstual. kondisi ini menunjukkan persoalan konstruksi yuridis yang bersinggungan dengan moralitas hukum, kepastian hukum, hierarki peraturan perundang-undangan, pemisahan kekuasaan dan checks and balances, asas pembentukan peraturan perundang-undangan, otonomi daerah dan desentralisasi, serta tata kelola pemerintahan yang baik. penelitian ini bertujuan untuk menganalisis konstruksi yuridis pengaturan belanja hibah dari pemerintah daerah kepada pemerintah pusat dalam permendagri nomor 77 tahun 2020 dan peraturan kepala daerah di wilayah aceh, serta menganalisis implikasi hukum pengaturan belanja hibah kepada instansi vertikal. penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan perbandingan (comparative approach). bahan hukum yang digunakan meliputi bahan hukum primer, bahan hukum sekunder serta bahan hukum tersier sebagai pendukung. data yang terkumpul dianalisis secara kualitatif menggunakan metode deskriptif-analitis dan komparatif dengan membandingkan ketentuan peraturan perundang-undangan di tingkat pusat dan peraturan kepala daerah di wilayah aceh. hasil penelitian menunjukkan bahwa secara hierarkis tidak ditemukan pertentangan norma antara undang-undang pemerintahan daerah, peraturan pemerintah nomor 12 tahun 2019 tentang pengelolaan keuangan daerah, dan permendagri nomor 77 tahun 2020, namun ditemukan ketidakjelasan rumusan yaitu belum adanya indikator mengenai kemampuan keuangan daerah, batasan hibah, dan mekanisme pengawasan. selain itu, peraturan kepala daerah di aceh yang cenderung mereplikasi norma pusat tanpa penyesuaian kondisi daerah, bahkan memperluas tujuan hibah untuk menjaga hubungan antarlembaga, serta belum adanya pemisahan tegas antara sumber pendanaan hibah dari apba/apbk dan dana otonomi khusus, yang berisiko tidak sesuai dengan peruntukan dana sebagaimana dibatasi undang-undang nomor 11 tahun 2006 tentang pemerintahan aceh. implikasi hukum dari kelemahan tersebut tercermin dari temuan badan pemeriksa keuangan mengenai pemberian hibah berulang dan penggunaan dana otonomi khusus yang tidak sesuai peruntukan, alokasi hibah yang besar di tengah rendahnya kapasitas dan kemandirian fiskal daerah serta masih tingginya kemiskinan dan stunting di aceh, dan kecenderungan penyaluran hibah kepada lembaga penegak hukum sebagaimana tercatat dalam data komisi pemberantasan korupsi tahun 2023–2025 yang berpotensi menimbulkan ketergantungan finansial serta mengaburkan pemisahan kekuasaan dan mekanisme checks and balances. berdasarkan hasil penelitian, disarankan agar pemerintah pusat menetapkan indikator kuantitatif yang mengaitkan kondisi fiskal daerah dengan batas maksimal belanja hibah, memperjelas batasan operasional atas frasa “sesuai kemampuan keuangan daerah setelah memprioritaskan pemenuhan belanja urusan pemerintahan wajib dan belanja pemerintahan pilihan”, frasa “dalam rangka mendukung penyelenggaraan pemerintah daerah”, frasa “satu kali dalam tahun berkenaan”, serta memberikan pembatasan atau larangan bersyarat terhadap hibah operasional-kelembagaan kepada instansi penegak hukum. selain itu, pemerintah daerah di wilayah aceh disarankan menempatkan hibah kepada instansi vertikal sebagai kebijakan eksepsional yang baru dapat dilaksanakan setelah terpenuhinya mandatory spending dan capaian spm, merevisi ketentuan peraturan gubernur aceh yang memperluas tujuan hibah untuk menjaga hubungan antarlembaga, memastikan sumber pendanaan hibah berasal dari apba/apbk reguler dan bukan dana otonomi khusus, serta menyusun peraturan kepala daerah yang memasukkan indikator kemampuan keuangan daerah dan kapasitas fiskal daerah serta penguatan mekanisme pengawasan. kata kunci: konstruksi yuridis, belanja hibah, pemerintah daerah dan pemerintah pusat



Abstract

JURIDICAL CONSTRUCTION OF GRANT EXPENDITURES FROM REGIONAL GOVERNMENTS TO THE CENTRAL GOVERNMENT Rizky Wirdatul Husna Yanis Rinaldi** Yusri*** ABSTRACT The implementation of decentralization grants regional governments the authority to administer governmental affairs and manage regional finances through Regional Revenue and Expenditure Budgets (APBD), including policies concerning Grant Expenditures. However, the provision of grants from regional governments to the Central Government, particularly to vertical agencies and law enforcement institutions, raises complex juridical issues because it may reduce regional fiscal capacity for fulfilling mandatory public expenditure priorities while exposing weaknesses in existing oversight mechanisms. These issues stem from the ambiguity of the normative provisions contained in Minister of Home Affairs Regulation Number 77 of 2020 concerning Technical Guidelines for Regional Financial Management (Minister of Home Affairs Regulation Number 77 of 2020), particularly the phrases concerning Regional Financial Capacity and the requirements for granting assistance to the Central Government, which are not accompanied by clear indicators or measurable criteria. Moreover, regional head regulations tend merely to reproduce the central regulatory framework without providing contextual technical elaboration. This situation reflects broader concerns relating to the juridical construction of grant regulations in connection with legal morality, legal certainty, the hierarchy of laws and regulations, the separation of powers and the system of checks and balances, the principles governing legislative drafting, regional autonomy and decentralization, and the principles of good governance. This study aims to analyze the juridical construction of the regulatory framework governing Grant Expenditures from regional governments to the Central Government under Minister of Home Affairs Regulation Number 77 of 2020 and regional head regulations in Aceh, as well as to examine the legal implications of Grant Expenditures allocated to vertical government agencies. This research employs a normative legal method using statutory, conceptual, and comparative approaches. The legal materials consist of primary, secondary, and tertiary sources. The collected data were analyzed qualitatively using descriptive-analytical and comparative methods by examining the consistency between national legislation and regional head regulations in Aceh. The findings indicate that, from the perspective of the hierarchy of laws and regulations, no normative conflict exists between the Law on Regional Government, Government Regulation Number 12 of 2019 concerning Regional Financial Management, and Minister of Home Affairs Regulation Number 77 of 2020. Nevertheless, significant normative ambiguities remain, particularly the absence of measurable indicators concerning Regional Financial Capacity, limitations on Grant Expenditures, and effective oversight mechanisms. Furthermore, regional head regulations in Aceh largely replicate the national regulatory framework without adapting it to local circumstances and, in some instances, expand the objectives of grants to include maintaining intergovernmental institutional relations. The study also identifies the absence of a clear separation between grant funding derived from the Regional Revenue and Expenditure Budget (APBA/APBK) and the Special Autonomy Fund, creating a risk that such funds may be utilized inconsistently with their statutory purposes under Law Number 11 of 2006 concerning the Government of Aceh on the Governance of Aceh. These regulatory deficiencies are reflected in findings by the Audit Board of Indonesia (BPK), which identified repeated grant allocations and the misuse of Special Autonomy Funds, substantial Grant Expenditures despite Aceh's limited fiscal capacity and persistent levels of poverty and stunting, and a growing tendency to allocate grants to law enforcement institutions, as documented in the Indonesian Corruption Eradication Commission's (KPK) reports for 2023–2025. Such practices may create financial dependence and undermine the constitutional principles of the separation of powers and checks and balances. Based on these findings, this study recommends that the Central Government establish quantitative indicators linking regional fiscal conditions to maximum grant expenditure limits, clarify the operational meaning of the phrases "in accordance with regional financial capacity after prioritizing mandatory governmental affairs and optional governmental expenditures," "for the purpose of supporting regional governance," and "once within the relevant fiscal year," and impose restrictions or conditional prohibitions on institutional operational grants to law enforcement agencies. Furthermore, regional governments in Aceh should regard grants to vertical agencies as an exceptional policy that may only be implemented after mandatory spending obligations and Minimum Service Standards (SPM) have been fulfilled, revise the Aceh Governor Regulation that expands the objectives of grants to maintaining intergovernmental institutional relations, ensure that grants are financed exclusively from the regular APBA/APBK rather than the Special Autonomy Fund, and formulate regional head regulations that incorporates indicators of Regional Financial Capacity and Regional Fiscal Capacity, alongside strengthening oversight mechanisms.
