Peraturan menteri merupakan bagian dari sistem peraturan perundang-undangan yang diakui keberadaannya berdasarkan pasal 8 undang-undang nomor 12 tahun 2011 tentang pembentukan peraturan perundang-undangan. dalam praktik ketatanegaraan, kewenangan pencabutan suatu peraturan melekat pada pejabat pembentuknya, atau pada pejabat yang secara sah diberi delegasi oleh peraturan yang lebih tinggi. namun, fenomena yang tidak lazim terjadi ketika peraturan menteri hukum dan hak asasi manusia nomor 14 tahun 2019 tentang pengesahan koperasi mencabut peraturan menteri koperasi dan usaha kecil dan menengah nomor 9 tahun 2018 tentang penyelenggaraan dan pembinaan perkoperasian. hal ini menimbulkan persoalan mengenai batas kewenangan antar kementerian serta potensi kekosongan hukum dalam pengaturan koperasi. penelitian ini bertujuan untuk menganalisis kewenangan menteri hukum dan hak asasi manusia dalam mencabut peraturan menteri lain, menganalisis dampak yuridis dari pencabutan tersebut, serta mengkaji kedudukan hukum peraturan menteri yang dicabut. metode yang digunakan adalah penelitian hukum yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan historis, menggunakan bahan hukum primer dan sekunder. bahan hukum tersebut dianalisis secara kualitatif dengan metode penafsiran hukum untuk memperoleh jawaban atas rumusan masalah penelitian. hasil penelitian menunjukkan bahwa kewenangan menteri hukum dan hak asasi manusia dalam melakukan pencabutan peraturan menteri koperasi dan umkm menimbulkan perdebatan yuridis karena kedua peraturan tersebut berada pada tingkatan yang sama. meskipun menteri hukum dan ham memiliki kewenangan harmonisasi, kewenangan tersebut pada dasarnya bersifat administratif dan koordinatif serta tidak ditemukan dasar kewenangan yang secara eksplisit memberikan atribusi untuk mencabut peraturan menteri lain yang setingkat. pasal 8 undang-undang nomor 12 tahun 2011 beserta perubahannya mengakui peraturan menteri sebagai peraturan perundang-undangan yang dibentuk berdasarkan kewenangan atau atas perintah peraturan perundang-undangan yang lebih tinggi, sehingga perubahan atau pencabutannya pada prinsipnya harus dilakukan oleh pejabat yang memiliki kewenangan berdasarkan peraturan perundang-undangan. pencabutan tersebut juga menimbulkan potensi kekosongan hukum dan disharmoni regulasi dalam penyelenggaraan koperasi. hasil penelitian ini menyimpulkan bahwa pencabutan peraturan menteri koperasi dan umkm oleh menteri hukum dan hak asasi manusia menimbulkan persoalan dari perspektif asas legalitas karena tidak ditemukan dasar hukum yang secara tegas memberikan kewenangan untuk melakukan pencabutan terhadap peraturan menteri kementerian lain. selain itu, pengujian peraturan perundang-undangan di bawah undang-undang merupakan kewenangan mahkamah agung. oleh karena itu, diperlukan penguatan mekanisme harmonisasi serta kejelasan batas kewenangan antar kementerian guna menjamin kepastian hukum dan mencegah konflik kewenangan.



Abstract

ABSTRACT Ministerial Regulations constitute an integral part of Indonesia's statutory regulatory framework, as recognized under Article 8 of Law Number 12 of 2011 on the Formation of Laws and Regulations. In constitutional and administrative practice, the authority to revoke a regulation is vested in the official who enacted it or in an official lawfully delegated such authority pursuant to a higher legislative instrument. However, an unusual legal phenomenon arose when the Regulation of the Minister of Law and Human Rights Number 14 of 2019 concerning the Ratification of Cooperatives revoked the Regulation of the Minister of Cooperatives and Small and Medium Enterprises Number 9 of 2018 concerning the Administration and Development of Cooperatives. This situation raises legal issues concerning the limits of authority among ministries and the potential emergence of a legal vacuum in the regulation of cooperatives. This research aims to analyze the authority of the Minister of Law and Human Rights to revoke a ministerial regulation issued by another minister, to examine the juridical implications of such revocation and to assess the legal status of the revoked ministerial regulation. This study employs normative juridical legal research using statutory, conceptual, and historical approaches. Primary and secondary legal materials were analyzed qualitatively through legal interpretation to answer the research questions. The findings reveal that the authority exercised by the Minister of Law and Human Rights in revoking the Regulation of the Minister of Cooperatives and Small and Medium Enterprises has generated juridical debate because both ministerial regulations occupy the same hierarchical level within the statutory regulatory system. Although the Minister of Law and Human Rights is entrusted with the authority to harmonize laws and regulations, such authority is fundamentally administrative and coordinative in nature, and no explicit legal basis confers attributive authority to revoke a ministerial regulation issued by another ministry at the same hierarchical level. Article 8 of Law Number 12 of 2011, as amended, recognizes Ministerial Regulations as statutory regulations enacted pursuant to statutory authority or by virtue of a higher legislative mandate. Accordingly, the amendment or revocation of a Ministerial Regulation should, in principle, be undertaken only by the competent authority as prescribed by laws and regulations. Such revocation also gives rise to the potential for a legal vacuum and regulatory disharmony in the administration of cooperatives. This research concludes that the revocation of the Regulation of the Minister of Cooperatives and Small and Medium Enterprises by the Minister of Law and Human Rights gives rise to legal issues from the perspective of the principle of legality, as there is no explicit legal basis conferring the authority to revoke a ministerial regulation issued by another ministry. Furthermore, the judicial review of laws and regulations subordinate to statutes falls within the jurisdiction of the Supreme Court. Therefore, strengthening the regulatory harmonization mechanism and clarifying the limits of authority among ministries are essential to ensure legal certainty and prevent conflicts of authority.
