Peraturan menteri agraria dan tata ruang/kepala badan pertanahan nasional nomor 2 tahun 2018 mengatur bahwa pengawasan pejabat pembuat akta tanah (ppat) di daerah dilaksanakan oleh kepala kantor wilayah bpn dan kepala kantor pertanahan melalui pemeriksaan akta agar pelaksanaan tugas ppat sesuai dengan peraturan perundang-undangan dan kode etik. namun, pengawasan tersebut belum sepenuhnya dijalankan secara optimal sehingga masih terjadi pelanggaran dalam pembuatan akta pemindahan hak atas tanah yang menimbulkan ketidakpastian hukum atas akta yang dibuat. penelitian ini bertujuan untuk memperoleh data pelaksanaan pengawasan oleh kantor pertanahan kota banda aceh terhadap tugas ppat, hambatan yang dihadapi, serta penerapan sanksi terhadap ppat yang melakukan pelanggaran. penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif yang bersifat deskriptif. data diperoleh melalui wawancara, dokumentasi, dan penelitian kepustakaan terhadap buku, peraturan perundang-undangan, serta putusan pengadilan yang berkaitan dengan objek penelitian. hasil penelitian menunjukkan bahwa pengawasan yang dilaksanakan oleh kantor pertanahan kota banda aceh dalam kurun waktu terakhir berupa kegiatan monitoring ke kantor ppat, meliputi pemeriksaan buku repertorium ppat, administrasi kantor, serta bentuk akta jual beli. namun, pelaksanaan pengawasan tersebut belum berjalan sebagaimana mestinya, disebabkan oleh minimnya laporan yang masuk dan terbatasnya jumlah anggota majelis pembina dan pengawas ppat daerah (mppd), yang hanya beranggotakan 7 orang untuk mengawasi 58 ppat dan 5 ppat sementara (ppats) di kota banda aceh. selain itu, tingginya beban kerja, rendahnya partisipasi masyarakat, serta kendala teknis pada sistem pelaporan elektronik turut menjadi penghambat pengawasan. adapun penerapan sanksi hingga saat ini masih terbatas pada pelanggaran ringan. disarankan agar kantor pertanahan kota banda aceh menambah personel pengawas dan meningkatkan sosialisasi mekanisme pengaduan. ppat perlu lebih teliti dalam memeriksa dokumen serta tertib menyampaikan laporan bulanan akta, sedangkan masyarakat diharapkan lebih proaktif melaporkan dugaan pelanggaran kepada kantor pertanahan atau mppd sebelum menempuh jalur kepolisian maupun pengadilan



Abstract

Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 2 of 2018 stipulates that the supervision of Land Deed Officials (Pejabat Pembuat Akta Tanah or PPAT) at the regional level shall be conducted by the Head of the Regional Office of the National Land Agency and the Head of the Land Office through the examination of land deeds to ensure that PPATs perform their duties in accordance with prevailing laws and regulations as well as the professional code of ethics. However, such supervisory functions have not been implemented optimally, resulting in continuing violations in the preparation of land title transfer deeds, which may undermine the legal certainty of the deeds concerned. This study aims to examine the implementation of supervision exercised by the Banda Aceh Land Office over the duties of PPATs, identify the obstacles encountered in the supervisory process, and analyze the imposition of sanctions against PPATs who commit violations. This research employs an empirical juridical method with a descriptive qualitative approach. Data were collected through interviews, documentation, and library research involving books, statutory regulations, and court decisions relevant to the research subject. The findings indicate that, in recent years, the Banda Aceh Land Office has conducted supervisory activities through monitoring visits to PPAT offices, including examinations of PPAT repertory books, office administrative records, and the format of Sale and Purchase Deeds (Akta Jual Beli). Nevertheless, the implementation of such supervision has not been fully effective due to the limited number of public complaints received and the insufficient membership of the Regional Supervisory and Advisory Council for PPATs (Majelis Pembina dan Pengawas PPAT Daerah or MPPD), consisting of only seven members responsible for supervising 58 PPATs and five Acting Land Deed Officials (PPAT Sementara or PPATS) in Banda Aceh. Furthermore, the heavy workload of supervisory personnel, low public participation, and technical constraints within the electronic reporting system have further impeded effective supervision. To date, the sanctions imposed have been limited to minor violations. This study recommends that the Banda Aceh Land Office increase the number of supervisory personnel and strengthen public outreach regarding complaint mechanisms. PPATs are encouraged to exercise greater diligence in verifying legal documents and to consistently submit monthly deed reports. In addition, members of the public are expected to take a more proactive role in reporting alleged violations to the Land Office or the MPPD before pursuing legal remedies through the police or the courts.
