Penerbitan hak pakai untuk pemerintah daerah kabupaten pidie atas tanah yang telah bersertipikat hak milik imam mauzal, 1 ilyas ismail, 2 siti rahmah 3 abstrak berdasarkan pasal 52 ayat (2) pp nomor 18 tahun 2021, hak pakai selama dipergunakan diberikan tanpa batas waktu sepanjang dimanfaatkan sesuai peruntukannya. hak pakai selama dipergunakan ditujukan untuk penggunaan atas tanah yang dikuasai langsung oleh negara, bukan atas tanah hak milik perorangan. namun, di kabupaten pidie, hak pakai pemerintah diterbitkan di atas tanah hak milik perorangan yang tidak diperbolehkan menurut ketentuan hukum yang berlaku. penelitian ini membahas penerbitan hak pakai terhadap tanah yang telah bersertipikat hak milik bukan di berikan atas tanah negara, faktor-faktor penyebab diterbitkannya sertipikat hak pakai atas nama pemerintah kabupaten pidie di atas tanah hak milik dan penelitian juga mengkaji upaya penyelesaian sengketa yang dilakukan oleh kantor pertanahan kabupaten pidie terhadap terjadinya tumpang tindih antara sertipikat hak milik dan sertipikat hak pakai selama dipergunakan. metode penelitian yang digunakan adalah yuridis empiris, dengan pendekatan sosial. data primer diperoleh melalui wawancara dengan pejabat kantor pertanahan kabupaten pidie, data sekunder dan data tersier di proses melalui analisis data dilakukan secara deskriptif analitis untuk memberikan gambaran komprehensif mengenai permasalahan yang diteliti. hasil penelitian menunjukkan bahwa penerbitan hak pakai selama dipergunakan di atas tanah hak milik di kabupaten pidie belum sepenuhnya didukung kepastian spasial, akibat keterbatasan data fisik dan pemetaan pertanahan yang belum terintegrasi. pembuatan sertipikat hak pakai dipengaruhi kendala yuridis, administratif, dan teknis, khususnya arsip pertanahan dan verifikasi lapangan, yang ditangani kantor pertanahan kabupaten pidie melalui penelitian warkah, verifikasi data, dan mediasi. sengketa tumpang tindih sertipikat hak milik dan hak pakai disebabkan kelemahan administrasi pendaftaran tanah, yang diselesaikan melalui mekanisme administratif, non-litigasi, dan litigasi guna menjamin kepastian hukum. disarankan agar kantor pertanahan kabupaten pidie memperketat penerbitan sertipikat hak pakai melalui penelitian yuridis–fisik yang cermat serta percepatan digitalisasi dan pemetaan data pertanahan terintegrasi guna mencegah tumpang tindih dan menjamin kepastian hukum. kata kunci: hak milik, hak pakai selama dipergunakan, sertipikat

Abstract
ISSUANCE OF RIGHT OF USE FOR THE LOCAL GOVERNMENT OF PIDIE DISTRICT FOR LAND THAT HAS BEEN CERTIFIED AS OWNERSHIP RIGHTS Imam Mauzal, Ilyas Ismail, Siti Rahmah ABSTRACT Based on Article 52 paragraph (2) of Government Regulation Number 18 of 2021, the Right of Use is granted indefinitely as long as it is used according to its intended purpose. The Right of Use is intended for the use of land directly controlled by the State, not land owned by individuals. However, in Pidie Regency, the Government's Right of Use is issued on land owned by individuals, which is prohibited by applicable law. This study discusses the issuance of Right of Use on land with a Land Ownership Certificate granted on state land. The factors causing the issuance of a Right of Use Certificate in the name of the Pidie Regency Government on land encumbered with a Land Ownership Right are also examined. The study also examines the dispute resolution efforts undertaken by the Pidie Regency National Land Agency regarding the overlap between Ownership Certificates and Right of Use Certificates. The research method used was empirical juridical, with a socialization approach. Primary data was obtained through interviews with officials at the Pidie Regency Land Office. Secondary and tertiary data were processed through descriptive analytical analysis to provide a comprehensive overview of the problem under study. The research results indicate that the issuance of Right of Use Certificates for the duration of use on freehold land in Pidie Regency is not fully supported by spatial certainty, due to limited physical data and incompletely integrated land mapping. The issuance of Right of Use Certificates is affected by legal, administrative, and technical constraints, particularly land archives and field verification, which are handled by the Pidie Regency Land Office through document research, data verification, and mediation. Overlapping disputes over Right of Use and Right of Use Certificates are caused by weaknesses in land registration administration, which are resolved through administrative, non-litigation, and litigation mechanisms to ensure legal certainty. It is recommended that the Pidie Regency Land Office tighten the issuance of Right of Use Certificates through careful legal-physical research and accelerated digitization and integrated land data mapping to prevent overlap and ensure legal certainty.
