[skripsi. universitas syiah kuala]. dibawah bimbingan dr. muhammad yunus, s.pd., m.pd., dan yusrijal abdar s.pd., m.h. mahar perkawinan umumnya menggunakan emas murni sebagai standar perkawinan di kecamatan indrajaya kabupaten pidie. hal ini selaras dengan budaya masyarakat setempat. penelitian ini bertujuan untuk (1) mendeskripsikan penentuan mahar menggunakan emas berdasarkan hukum adat; (2) dan mendeskripsikan ketentuan atau kesepakatan adat yang mengatur standar mahar emas di kecamatan indrajaya kabupaten pidie. metode yang digunakan adalah pendekatan kualitatif dengan jenis penelitian deskriptif. teknik pengumpulan dengan mengunakan wawancara. subjek penelitian ini berjumlah lima belas informan yang terdiri dari 5 orang keuchik, 5 orang imum meunasah dan 5 orang tuha peut. hasil penelitian menunjukkan bahwa; (1) masyarakat di kecamatan indrajaya, kabupaten pidie, secara konsisten menggunakan emas sebagai mahar dalam prosesi pernikahan. hal ini menunjukkan kuatnya pengaruh adat yang diwariskan dari generasi ke generasi. tidak pernah ditemukan praktik penggantian mahar dengan bentuk lain. (2) penggunaan emas menjadi simbol kesungguhan dan kehormatan bagi calon pengantin perempuan, sekaligus menjaga kelestarian tradisi lokal. ketentuan atau kesepakatan adat yang mengatur standar mahar emas di kecamatan indrajaya sangat jelas dan terstruktur melalui musyawarah keluarga. proses penentuan dimulai dari musyawarah internal keluarga masing-masing calon pengantin. kesimpulan dari penelitian ini adalah; (1) penentuan mahar menggunakan emas berdasarkan hukum adat di kecamatan indrajaya kabupaten pidie dilakukan melalui proses musyawarah antara keluarga kedua calon pengantin dengan bentuk mahar harus berupa emas dan masyarakat tidak pernah menggunakan bentuk lain. konsekuensi untuk masyarakat yang tidak menggunakan mahar berupa emas tidak diatur secara tertulis karena dianggap sesuai dengan syariat islam. (2) ketentuan atau kesepakatan adat yang mengatur standar mahar emas di kecamatan indrajaya sangat jelas dan terstruktur melalui musyawarah keluarga. saran dari penelitian ini adalah; (1) bagi tokoh adat disarankan agar kesepakatan adat mengenai standar mahar emas didokumentasikan secara tertulis oleh lembaga adat di kecamatan indrajaya. (2) bagi peneliti selanjutnya, disarankan untuk memperluas cakupan penelitian dengan membandingkan ketentuan mahar emas di kecamatan indrajaya dengan kecamatan lain di kabupaten pidie. kata kunci: penentuan mahar, emas, hukum adat, tokoh adat

Supervised by Dr. Muhammad Yunus, S.Pd., M.Pd., and Yusrijal Abdar, S.Pd., M.H. Marriage dowries generally use pure gold as the standard in wedding practices in Indrajaya Subdistrict, Pidie Regency. This practice is in line with the local community’s cultural traditions. This study aims to (1) describe the determination of dowries using gold based on customary law, and (2) explain the customary provisions or agreements that regulate the standard of gold dowries in Indrajaya Subdistrict, Pidie Regency. The research employed a qualitative approach with a descriptive research design. Data were collected through interview techniques. The research subjects consisted of fifteen informants, selected purposively, comprising five keuchik, five imum meunasah, and five tuha peut. The results of the study indicate that: (1) the community in Indrajaya Subdistrict, Pidie Regency, consistently uses gold as the dowry in marriage ceremonies. This reflects the strong influence of customary traditions that have been passed down from generation to generation. No practices of substituting gold dowries with other forms were found. (2) The use of gold serves as a symbol of sincerity and honor for the bride, while also preserving local traditions. The customary provisions or agreements regulating the standard of gold dowries in Indrajaya Subdistrict are very clear and well- structured through family deliberations. The determination process begins with internal discussions within each prospective bride’s and groom’s families. The conclusions of this study are as follows: (1) the determination of dowries in Indrajaya Subdistrict, Pidie Regency, is conducted through deliberation between the families of both prospective spouses, with gold being the mandatory form of dowry, and the community has never used other forms. The consequences for not using gold as a dowry are not regulated in written form, as the practice is considered to be in accordance with Islamic law. (2) The customary provisions or agreements governing the standard of gold dowries in Indrajaya Subdistrict are clearly defined and systematically organized through family deliberations. The recommendations of this study are: (1) customary leaders are advised to formally document the customary agreements regarding the standard of gold dowries through the customary institutions in Indrajaya Subdistrict; and (2) future researchers are encouraged to expand the scope of research by comparing the provisions of gold dowries in Indrajaya Subdistrict with those in other subdistricts within Pidie Regency.
