Hak korban disabilitas diatur dalam pasal 5 ayat (3) uu nomor 8 tahun 2016 tentang penyandang disabilitas dan diperkuat oleh pasal 6 pp nomor 39 tahun 2020 tentang akomodasi yang layak untuk penyandang disabilitas dalam proses peradilan menegaskan bahwa proses pembuktian yang dilakukan oleh jaksa penuntut umum harus menjamin hak korban disabilitas serta menyediakan akomodasi yang layak selama proses peradilan. namun, dalam praktiknya jaksa penutut umum kurang optimal dalam membuktikan dakwaan pertamanya terkait pemerkosaan serta tidak adanya pendamping ahli sebagaimana yang terjadi di meuredu dan di jantho. penulisan ini bertujuan untuk mengetahui proses, kendala serta upaya jaksa penuntut umum dalam pembuktian perkara tindak pidana kekerasan seksual terhadap perempuan penyandang disabilitas. penelitian ini menggunakan metode penelitian yuridis empiris dengan menggunakan data yang didapatkan dilapangan dan literasi hukum seperti peraturan perundang-undangan dan teori-teori. data lalu dianalisis menggunakan penedekatan kualitatif untuk menghasilan pemahaman yang mendalam terkait permasalahan ini. hasil penelitian menunjukkan bahwa pembuktian yang dilakukan oleh jaksa penuntut umum kurang optimal dikarenakan lemahnya alat bukti dan proses peradilan yang belum sepenuhnya melindungi hak korban penyandang disabilitas sesuai ketentuan uu nomor 8 tahun 2016 dan pp nomor 39 tahun 2020. hambatan yang dijelaskan selama proses pembuktian yakni keterbatasan komunikasi korban, keterlambatan visum et repertum, ketiadaan pendamping ahli, serta lemahnya koordinasi antar lembaga terkait. disarankan kepada kejari meuredu dan kejari jantho untuk bekerjasama dengan pemerintah daerah, kepolisian, dan rumah sakit untuk membangun mekanisme koordinasi terpadu dalam penanganan korban disabilitas agar korban dapat mengakses keadilan secara penuh, setara, dan bermartabat.



Abstract

The rights of victims with disabilities are regulated under Article 5 paragraph (3) of Law Number 8 of 2016 on Persons with Disabilities and are further reinforced by Article 6 of Government Regulation Number 39 of 2020 on Reasonable Accommodation for Persons with Disabilities in judicial proceedings, which emphasizes that the evidentiary process conducted by the public prosecutor must guarantee the rights of victims with disabilities and provide reasonable accommodation throughout the judicial process. However, in practice, public prosecutors have been less than optimal in proving the first charge related to rape and have failed to provide expert assistance, as occurred in cases in Meureudu and Jantho. This study aims to examine the process, obstacles, and efforts of Public Prosecutors in proving cases of sexual violence against women with disabilities. This research employs an empirical juridical research method, utilizing data obtained from field research and legal literature, such as statutory regulations and legal theories. The data are then analyzed using a qualitative approach to produce an in-depth understanding of the issues under study. The results of the study indicate that the evidentiary process carried out by public prosecutors has been suboptimal due to weak evidence and judicial proceedings that have not fully protected the rights of victims with disabilities in accordance with Law Number 8 of 2016 and Government Regulation Number 39 of 2020. The obstacles identified during the evidentiary process include limitations in victim communication, delays in obtaining the visum et repertum, the absence of expert companions, and weak coordination among relevant institutions. It is recommended that the Meureudu District Prosecutor’s Office and the Jantho District Prosecutor’s Office cooperate with local governments, the police, and hospitals to establish an integrated coordination mechanism in handling victims with disabilities, so that victims can fully, equally, and dignifiedly access justice.
