Pada pemilihan presiden dan wakil presiden, legislatif menetapkan peraturan persyaratan kandidat calon presiden dan wakil presiden melalui pasal 6a ayat (2) uud bedasarkan data observasi lapangan. keberadaan pasal tersebut dinilai telah memberikan batasan kepada masyarakat dalam pencalonan diri sebagai presiden dan wakil presiden secara individual, keberadaan pasal tersebut telah membatasi nilai penjabaran dari demokrasi. untuk meninjau lebih detail hak warga negara menjadi calon presiden dan wakil presiden dan perbedaan peraturan pemerintah tentang calon kepala daerah berdasarkan undang-undang dasar negara republik indonesia tahun 1945 (uud 1945). mengkaji kebaradaan pasal 6a ayat (2) uud 1945, pasal tersebut mengamanatkan hak eksklusif terhadap partai politik yang kemudian menjadi penghalang bagi warga negara untuk menjadi presiden dan wakil presiden perseorangan atau individual. teori demokrasi dan juga konsep undang-undang, deskriptif kualitatif yaitu hasil penelitian dideskripsikan secara konkret sesuai dengan peristiwa yang terjadi pada objek penelitian. penjabaran pengertian demokrasi negara harus mengupayakan kepentingan masyarakat diatas segalanya, adanya aturan hukum yang telah di pergunakan untuk mengatur calon independen presiden dan wakil presiden tidak melihat dari isi kepentingan masyarakat merupakan kepentingan elit. perbedaan persyaratan antara pemilihan presiden dan pemilihan kepala daerah didasarkan pada perbedaan peraturan. hal tersebut dikarenakan wilayah provinsi atau kabupaten/kota diberikan kebebasan dalam mengatur wilayahnya masing-masing, secara nasional pembatasan kepada kandidat dikarenakan perbedaan sistem politik dan berpengaruh kepada politik nasional. keberadaan pasal berdampak posistif dan negatif terhadap keberlangsungan demokrasi indonesia. adanya pasal tersebut dinilai menurunkan kualitas demokrasi serta memperkuat kekuasaan ketua-ketua partai hal ini terjadi karena sistem demokrasi yang dibatasi dan menutup akses bagi masyarakat dalam melaksanakan kebebasan hak sebagai warga negara yaitu dipilih secara personal tanpa melibatkan partai. kata kunci: presiden dan wakil presiden independen, demokrasi, pasal 6a ayat (2)



Abstract

In the presidential and vice-presidential elections, the legislature establishes regulations for the candidacy requirements for the president and vice president through Article 6A paragraph (2) of the Constitution. Based on field observation data, the existence of this article is considered to have imposed limitations on the public in self-nominating as presidential and vice-presidential candidates individually. The presence of this article has restricted the realization of democratic values. To examine in more detail the rights of citizens to become candidates for President and Vice President and the differences in government regulations on regional leader candidates based on the 1945 Constitution of the Republic of Indonesia (UUD 1945), the existence of Article 6A paragraph (2) of UUD 1945 is analyzed. This article mandates exclusive rights to political parties, which then become obstacles for citizens to run for President and Vice President as individuals. The theory of democracy and legal concepts, through descriptive qualitative analysis, interprets research results concretely based on events occurring in the research object. The interpretation of the concept of democracy implies that the State must prioritize the interests of the public above all else. However, the legal rules used to regulate independent presidential and vice-presidential candidates do not consider the interests of the public as paramount; instead, they prioritize elite interests. The differences in requirements between presidential and local elections are based on variations in regulations. This is because provinces or regencies/cities are given autonomy in managing their respective areas. Nationally, restrictions on candidates arise due to differences in the political system, which influences national politics. The existence of this article has both positive and negative impacts on the sustainability of Indonesian democracy. It is perceived to diminish the quality of democracy and strengthen the power of party leaders. This occurs because the limited democratic system closes off access for the public to exercise their freedom as citizens, namely being chosen personally without party involvement.
