Abstract

ABSTRACT TIARA HAJI FARADIBA FORMING REGULATION FOR READINESS OF EMISSIONS REDUCTIONS PROGRAM IN ACEH, INDONESIA 2023 Faculty of Law, Syiah Kuala University (ix.74) pp.,tbl.,abbr.,bibl., (Dr. M. Yakub Aiyub Kadir) The government of Aceh preparing for Reducing Emission from Deforestation and Forest Degradation (REDD+) program to contribute in reducing greenhouse gas (GHG) emissions. Fulfilling Indonesia’s NDC target, Aceh will implement REDD+ program to protect forest and reduce greenhouse gas emissions. To execute the program, the local government needs to form a governor Regulation following the mandate of Presidential Regulation Number 98 of 2021 concerning the Economic Value of Carbon. Nevertheless, Aceh faces some challenges, and need appropriate regulation to support the implementation of REDD+ program. Following the purpose of this research is to analyze the challenges that will face by government and the examine the provision that should be draft as a new regulation. This study is normative legal research by collecting primary and secondary legal sources to find out the provisions that need to be formulated in the formation of regulations for the readiness of the implementation of Emissions Reductions program. These resources are logically interpreted by examining the reality of global climate change through the lens of national laws, international treaties. The findings of the study expose that the Aceh government has been preparing for the implementation of REDD+ program. Nonetheless, the Aceh government encounters several challenges in implementing this emission reduction program, including the gap between the government and indigenous peoples, and regulatory vacuum on provincial greenhouse gas emission baseline. To overcome these challenges, the Aceh government must prepare and able to interpret the REDD+ program scheme as an adaptation program from the international by conducting an FPIC program evenly. Government should draft a baseline regulation on the latest greenhouse gas emissions inventory, and based on socio-economic aspects that are in line with Aceh’s current conditions to support the implementation of emission reduction programs.
