Abstract

Ya’kub Aiyub Kadir) With the ease of the internet, cyberspace has become the main focus of international relations. Every state competes to improve its cybersecurity using cyber diplomacy. Indonesia has established an institution on cybersecurity and cyber diplomacy, BSSN (Badan Siber dan Sandi Negara) through Presidential Decree No. 28 of 2021. However, cyber diplomacy practices in Indonesia do not have a specific law, so Indonesia relies on the Vienna Convention on Diplomatic Relations (VCDR) 1961 and Law No. 37 of 1999 concerning Foreign Relations. Since Indonesia does not yet have specific laws that regulate cyber diplomacy, so, this research aims to investigate cyber diplomacy in Indonesia under the VCDR 1961 and Law No 37 of 1999, further to understand the impact of cyber diplomacy in improving cybersecurity, as well as to provide an explanation on how far does BSSN take part in cyber diplomacy issues. This study is normative legal research by collecting primary and secondary legal sources to examine the importance of cyber diplomacy law under the VCDR 1961 and Law No. 37 of 1999 and BSSN in improving cybersecurity in Indonesia. The sources were interpreted logically by looking at the phenomena in diplomatic relations with national law, international conventions, and other conceptual approaches. The findings of the study reveal that BSSN has been in line with VCDR 1961 as it is stated in Art. 2 and Art.3 as well as Law No 37 of 1999. It also found that participating in cyber diplomacy forums would help Indonesia acquire technology transfer for instruments used to improve cyber security. So far, BSSN actively participates in cybersecurity forums and cooperates (MoU) with 7 states. Realizing that Indonesia actively engages in cyber diplomacy, it urged that the government of Indonesia establish a specific law that regulates the procedures for conducting cyber diplomacy, to ensure that cyber diplomacy can run effectively and efficiently.
