Penyaluran bantuan sosial covid-19 kepada masyarakat pada masa pandemi yang tidak tepat sasaran (suatu penelitian di kabupaten aceh barat) munandar* husni** ilyas ismail*** abstrak pasal 9 peraturan bupati nomor 17 tahun 2021 tentang petunjuk teknis penyaluran bantuan sosial jaring pengamanan sosial dampak covid-19 bagi masyarakat menengah ke bawah di kabupaten aceh barat, memuat landasan yuridis dalam pelaksanaan bantuan sosial covid-19 yaitu: “bantuan diserahkan oleh dinas sosial kepada para keuchik dan akan disalurkan kepada masyarakat menegah ke bawah di masing-masing gampong dengan membuat surat pernyataan”. terkait tangung jawab pengawasan sesuai dengan ketentuan peraturan tersebut pada pasal 10 menjelaskan bahwa “pelaksanaan penyaluran bantuan menjadi tugas dan tanggung jawab keuchik”. pada tahun 2020 diketahui sebanyak 10.270 keluarga kurang mampu atau masyarakat miskin di kabupaten aceh barat. penyaluran bantuan sosial covid-19 di kabupaten aceh barat masih belum berjalan secara maksimal salah satunya berkaitan penyaluran bantuan covid-19 seperti proses pendataan calon penerima tidak transparan sehingga memunculkan konflik sosial saat hendak penyaluran bansos. tujuan dari penelitian ini adalah untuk mengetahui dan menjelaskan pelaksanaan penyaluran bantuan sosial di kabupaten aceh barat, untuk mengetahui dan menjelaskan faktor yang membuat bantuan sosial covid-19 tidak sampai kepada masyarakat yang berhak dan untuk mengetahui dan menjelaskan upaya hukum yang dapat dilakukan oleh pihak yang merasa dirugikan akibat tidak adanya transparansi dalam penyaluran bansos covid-19. jenis penelitian yang digunakan dalam penelitian ini adalah dengan yuridis- empirik yaitu penelitian dengan melakukan kajian yang komprehensif dengan melakukan pengamatan dan wawancara langsung dilokasi penelitian. untuk melengkapi penelitian ini juga dilakukan penelaahan secara kepustakaan seperti mengkaji beberapa peraturan perundang-undangan terkait masalah yang diteliti yang menjadi bahan sekunder dalam penelitian ini. *mahasiswa **ketua komisi pembimbing ***anggota komisi pembimbing penyaluran bantuan sosial covid-19 di kabupaten aceh barat adalah berdasarkan peraturan bupati aceh barat nomor 17 tahun 2020 tentang petunjuk teknis penyaluran bantuan sosial jaring pengamanan sosial dampak covid-19 bagi masyarakat menegah ke bawah di kabupaten aceh barat. dalam pertimbanganya bahwa dengan merebaknya wabah corona virus disease 2019 (covid-19) di indonesia sangat berdampak pada pendapatan masyarakat kalangan menengah ke bawah yang berimbas pada berkurangnya pendaparan mereka dikarenakan penetapan pembatasan sosial berskala besar. terdapat dua jenis bantuan sosial covid-19 di kabupaten aceh barat yaitu bantuan sosial tunai covid-19 (bst) dan bantuan sosial non-tunai covid-19 (bsnt). kebijakan bantuan sosial diharapkan dapat membantu masyarakat yang terdampak ppkm. upaya hukum yang dapat dilakukan oleh pihak yang merasa dirugikan akibat tidak adanya transparansi dalam penyaluran bansos covid-19. adalah dengan mengikuti mekanisme yang terdapat pada pasal 22 undang-undang nomor 14 tahun 2008 tentang keterbukaan informasi publik, yaitu mengajukan permintaan untuk memperoleh informasi publik kepada badan publik terkait yakni dinas sosial kabupaten aceh barat secara tertulis atau tidak tertulis, kemudian badan publik tersebut mencatat nama dan alamat pemohon informasi publik, subjek dan format informasi serta cara penyampaian informasi yang diminta oleh pemohon informasi publik, selanjutnya diberikan nomor pendaftaran pada saat permintaan diterima dan paling lambat selama 10 hari kerja sejak tanggal diterimanya permintaan, badan publik yang bersangkutan wajib menyampaikan pemberitahuan tertulis diketahui ada lima faktor yang membuat bantuan sosial covid-19 tidak sampai kepada masyarakat yang berhak, yaitu pertama akibat persoalan pendataan bantuan sosial covid-19, kedua, akibat potensi korupsi bantuan sosial covid-19, ketiga distribusi pengawasan bantuan sosial covid-19 yang masih lemah, keempat transparansi data penerima bansos bantuan sosial covid-19, kelima kanal pengaduan masyarakat bantuan sosial covid-19 yang belum jelas. diharapkan kepada pemerintah kabupaten aceh barat untuk membentuk tim penegakan hukum terkait bansos, apabila ditemukan penyelewenagan baik secara administratif maupun secara pidana, diharapkan untuk membentuk tim pengaduan terkait bantuan sosial covid-19 di kabupaten aceh barat, lengkap dengan alur dan standar operasional prosedur (sop) pengaduan yang mudah dipahami oleh masyarakat dengan diiringi transparansi informasi program bansos dan diharapkan kepada dinas sosial kabupaten aceh barat meningkatkan sosialisasi terkait bansos dengan menyediakan media yang berisi informasi program bansos, apa yang diterima, item bansos, jadwal penerimaan bansos, distribusi bansos melalu peran aparatur gampong setempat. kata kunci: bantuan sosial, covid-19



Abstract

DISTRIBUTION OF COVID-19 SOCIAL ASSISTANCE TO THE COMMUNITY DURING PANDEMIC TIMES WHICH IS NOT APPROPRIATELY TARGETED (A Research in Aceh Barat Regency) Munandar* Husni** Ilyas Ismail*** ABSTRACT Article 9 of the Regent's Regulation Number 17 of 2021 concerning Technical Guidelines for the Distribution of Social Aid Social Safety Nets for the Impact of Covid-19 for the Lower Middle Communities in West Aceh Regency, contains the juridical basis for the implementation of Covid-19 social assistance, namely: "assistance is handed over by the Social Service to the keuchik and will be distributed to the middle and lower communities in each gampong by making a statement”. Regarding the supervisory responsibilities in accordance with the provisions of the regulation, Article 10 explains that "the implementation of the distribution of aid is the duty and responsibility of the Keuchik". In 2020, it is known that there are 10,270 underprivileged families or poor communities in Aceh Barat Regency. The distribution of Covid-19 social assistance in West Aceh Regency is still not running optimally, one of which is related to the distribution of Covid-19 assistance, such as the non-transparent data collection process for prospective recipients, causing social conflicts when they want to distribute social assistance. The purpose of this research is to find out and explain the effectiveness of distributing sosial assistance in Aceh BaratRegency, to find out and explain what factors prevent Covid-19 sosial assistance from reaching the people who are entitled to it and to find out and explain legal remedies that can be taken by the parties. who feel disadvantaged due to the lack of transparency in the distribution of the Covid-19 sosial assistance assistance. The type of research used in this study is juridical-empirical, namely research by conducting a comprehensive study by conducting direct observations and interviews at the research location. To complete this research, a literature review was also carried out such as reviewing several laws and regulations related to the problem under study which became secondary material in this research. *Postgraduate Student of Syiah Kuala Law School **The Head of Supervision Commission ***The Members of Commission The distribution of Covid-19 social assistance in West Aceh Regency is based on West Aceh Regent Regulation Number 17 of 2020 concerning Technical Instructions for Distribution of Social Security Net Social Assistance for the Impact of Covid-19 for Middle and Lower Communities in West Aceh Regency. In his consideration that the outbreak of the Corona Virus Disease 2019 (Covid-19) outbreak in Indonesia had a major impact on the incomes of the lower middle class which resulted in a reduction in their income due to the stipulation of large-scale social restrictions. There are two types of Covid-19 social assistance in West Aceh Regency, namely Covid-19 Cash Social Assistance (BST) and Covid-19 Non-Cash Social Assistance (BSNT). The social assistance policy is expected to help communities affected by PPKM. So based on the results of research on several respondents and informants in West Aceh District, social assistance provided to the community has not been effective. Legal remedies that can be taken by parties who feel disadvantaged due to the lack of transparency in the distribution of the Covid- 19 social assistance assistance. This is to follow the mechanism contained in Article 22 of Law Number 14 of 2008 concerning Openness of Public Information, which is to submit a request to obtain public information to the relevant public agency, namely the Social Service of West Aceh Regency in writing or unwritten, then the public body records the name and the address of the Applicant for Public Information, the subject and format of the information as well as the method of submitting the information requested by the Applicant for Public Information, then given a registration number when the request is received and within 10 working days at the latest from the date of receipt of the request, the relevant public agency must submit a written notification. There are five factors that prevent Covid-19 social assistance from reaching the people who are entitled to it, namely first due to the problem of collecting data on Covid-19 social assistance, second, Due to the Potential Corruption of Covid-19 Social Assistance, thirdly the distribution of Covid-19 Social Assistance Supervision which is still ongoing. weak, the fourth is the Transparency of the Data for the Recipients of the Covid-19 Social Aid Bansos, the fifth the Covid-19 Social Aid Community Complaint Channels which are not yet clear. It is hoped that the West Aceh Regency Government will form a law enforcement team related to social assistance, if violations are found both administratively and criminally it is expected to form a complaint team related to the Covid-19 social assistance in West Aceh Regency, complete with flow and Standard Operating Procedures (SOP) complaints that are easy to understand by the public with transparency social assistance program information and it is hoped that the West Aceh District Social Service will increase socialization related to social assistance by providing media containing information about the social assistance program, what is received, social assistance items, schedule for receiving social assistance, distribution of social assistance through the role of the local Gampong Apparatus Keywords: Sosial Assistance, Covid-19
