Tujuan dari penelitian ini adalah untuk mengidentifikasi kualifikasi Standar Internasional yang diinginkan oleh Perjanjian SPS dalam mengatur perdagangan dan pemanfaatan pestisida di Uni Eropa dan untuk mengidentifikasi kewajiban negara yang diturunkan dari standar internasional sebagai standar nasionalnya serta untuk menemukan solusi yang tepat sebagai alternatif pestisida berbahaya. Hasilnya berdasarkan Pasal 3 Perjanjian SPS, Anggota dapat memutuskan tindakan SPS mereka pada standar internasional, mis. Codex Alimentarius, mencocokkan ukuran SPSnya dengan standar internasional, berarti standar internasional tersebut telah diubah menjadi hukum domestik secara keseluruhan atau menyimpang dari standar internasional, artinya Anggota dapat menentukan sendiri tingkat perlindungan SPSnya tetapi pada umumnya berkewajiban untuk melegitimasinya tindakan melalui penilaian risiko dan bukti ilmiah (pasal 5.2). Pemerintah Perancis harus mencari dan mempromosikan pestisida jenis baru sebagai alternatif dan juga pemerintah harus mendukung promosi pestisida yang lebih ramah lingkungan melalui penegakan hukum di tingkat nasional atau bahkan memberikan subsidi kepada aktor swasta lokal selama pengenalan awal dan periode adaptasi.
The purpose of the research are to identify the qualification of the International Standard desired by the SPS Agreement in regulating the trading and utilization of pesticides in the European Union and to identify the obligation of the country derived from international standards as their national standard and also to find right solution as an alternative to dangerous pesticides. The results is under Article 3 of the SPS Agreement, Member may either decide their SPS measure on international standard, ex. Codex Alimentarius, match their SPS measure to international standards, means that the international standard has been changed over into domestic law in its ompletely or deviate from international standards, means that Member can decide their own level of SPS protection but is generally obliged to legitimize its measures through a risk assessment and scientific evidence (art. 5.2). France Government must find and promote a new type of pesticide as an alternative and also the government should support the promotion of more eco-friendly pesticides through law enforcement at the national level or even giving the subsidy to the private local actor during the early introduction and adaptation period.
