Burial at sea is the dumping of the corpse to the sea normally from a ship or boat, in the cremation form, or perhaps the whole body in a coffin or wrapped in cloth. Burial at sea is carried out because there are factors that do not allow to repatriate bodies to land. Burial by dumping into the sea is the last option to be taken by the leadership on board with various considerations. The mechanism regarding burial at sea is governed by the International Labor Organization in section 30 of Seafarer's services regulation. This study aims to explain the regulation regarding burial at sea for crew members that regulated in the ILO Seafarer's Service Regulation and to find out the implementation of burial at sea in the case of Burial at Sea Long Xin 629 Ship Cabin Crew. Another aims is to find out the role of the Indonesian government in protecting Indonesian citizens who get bad treatment while working on foreign ships based on this case. This research is in the form of normative legal research. It is legal research that examines provisions in international conventions and legislation and their application to legal events. The data collection technique used is document study which includes international law regulations and national laws related to this thesis. The results of this study indicate that there are several violations in the implementation of article 30 of the ILO Seafarer Service Regulation in the case of burial at sea of Indonesian crew members who work on the Long Xin 629 ship. The responsibility of the Indonesian government towards the citizens who work on foreign ships is contained in a number of regulations, national conventions made by the government as well as international conventions that have been ratified. The suggestion from this research the government should ratify ILO Convention No. 188 on Work In Fishing so that the protection of crew members working on foreign vessels is more optimal and to carry out stricter supervision of Indonesian labor agency distribution companies. The government must also coordinate and cooperate between ministries and related institutions to the protection of migrant workers.
