This study analyses the similarities and differences of maternity protection under
Indonesia and Malaysia Labor Law. The method used in this research is normative legal
research and comparative approach. The results of this study shows several differences
of maternity protection from both laws such as the duration of maternity leave and the
provision of breastfeeding entitlement. Also few similarities such as both law provided
the social protection for health protection under the law for the worker. The
recommendation for Malaysian’s lawmakers is to revise the Employment Act 1955
relate the work protection and breastfeeding term and both countries should ratified the
Convention on Maternity Protection 2000 for better protection women worker in the
employment world
