Freedom of Expression is one of the basic human rights that is attached to a human, and should not be restricted and must be respected. The standard for Freedom of Expression is regulated in Universal Declaration of Human Rights, International Covenant on Political and Civil Rights, Indonesian law which Law No. 39 Year 1999 regarding Human Rights, Indonesian Law No. 40 year 1999 regarding Press.
Issues arise for foreign journalists, how their freedom of expression is halted by Indonesia. Some problems being faced is there is currently no regulation in regards to foreign journalists’ in Indonesia, as well as bureaucracy issues. There are violations from foreign journalists as well such as using visas other than journalistic visa to enter Indonesia.
The purpose of this research is to highlight the standard on the protection of Freedom of Expression foreign journalists and to see whether Indonesia fulfils the international standard itself or not. To find the data needed, the researcher uses normative approach. This method analyse the legal rules regarding the protection on the freedom of expression in Indonesia for foreign journalists.
The results of this research have come to the conclusion that Indonesia has ensured the protection on freedom of expression through Indonesian Constitution 1945 and the enactment of Indonesian law No. 39 year 1999 regarding human rights. However, there is no article in Law no. 40 year 1999 regarding press that specifically regulate foreign journalist.
It is suggested for the Indonesian Government to create a new law that regulates the rights and obligations for foreign journalists, and the process is faster and efficient. It is also suggested for an Indonesian Government to establish a foreign press monitoring body to ensure the rights and obligation for the foreign journalist to be fulfilled whilst they are in the territory of Indonesia.
