This thesis examines the comparison of social security protection for migrant workers in Indonesia and Malaysia, by looking at the current law. In Indonesia has already regulated social security for foreign workers provided under state organizations, which is regulated in law number 24 of 2011 concerning the social security administering bodies (BPJS). While Malaysia only introduced social security for foreign workers provided under state organizations in 2019 under Employees Social Security Act 1969 (Act 4) concerning social security organization (SOCSO) .
The purpose of this research is to find out how the social security legal arrangements that apply in Indonesia and Malaysia, and to find out whether the similarities and differences between the two social security protection provided by the two countries.
This research uses normative legal research or also known as library research, in which to achieve the objectives of this study an analysis of both countries law and international legal instruments is carried out and uses comparative approach to compare both of law in this research.
The results of this study found that since early 2019 the Malaysian government has provided social security for foreign workers under a government organization, namely SOCSO, while Indonesia has already enacted a social
security protection for foreign workers under a government organization, namely BPJS in 2011. From this research it is also found that Indonesia has similarities and differences in legal arrangements regarding social security for foreign workers, namely placing social security for Migrant workers under state organizations, and equally not providing pension security to foreign workers. While there are also found 3 differences, the first lies in the type of social security provided to Migrant workers, the second is seen during the working period for migrant workers to be able to register in the social security program, and the third is the provision of sanctions to employers who do not enroll workers in social security programs.
BPJS and SOSCO are government organizations that provide social
security for all workers including migrant workers in Indonesia and Malaysia. The similarities and differences in the social security provided by two countries should be a benchmark for the government to continue to develop social security for migrant workers.
