Narapidana lanjut usia berhak mendapatkan pemenuhan hak pelayanan kesehatan secara khusus. Hal ini diatur di dalam Pasal 6 Peraturan Menteri Hukum dan HAM Nomor 32 Tahun 2018 tentang Perlakuan Bagi Tahanan dan Narapidana Lanjut Usia. Namun pemenuhan hak pelayanan kesehatan secara khusus bagi narapidana lanjut usia belum dapat terpenuhi secara komprehensif untuk dapat terlaksanakan secara optimal.
Penelitian ini bertujuan untuk mengkaji praktik pemenuhan hak pelayanan kesehatan dalam rangka peningkatan kesejahteraan narapidana lanjut usia. Juga untuk mengetahui dan menjelaskan upaya yang dilakukan untuk terpenuhinya hak pelayanan kesehatan narapidana lanjut usia serta mengembangkan teori hak asasi manusia, teori pemidanaan, dan teori pembinaan narapidana.
Metode penelitian menggunakan yuridis empiris. Penelitian terhadap peranan Lembaga Pemasyarakatan dalam melaksanakan fungsinya serta membahas bagaimana bekerjanya hukum terhadap narapidana. Data yang digunakan adalah data primer, data sekunder dan data tersier. Teknik pengumpulan data menggunakan teknik wawancara dan menelaah dokumen serta Undang-Undang terkait. Selanjutnya data diolah dan dianalisa dengan teknik analisis deskriptif kualitatif.
Hasil penelitian yaitu pertama, pemenuhan hak pelayanan kesehatan bagi narapidana lanjut usia belum berjalan dengan optimal sesuai dengan amanat Peraturan Menteri Hukum dan HAM Nomor 32 Tahun 2018 Tentang Perlakuan Bagi Tahanan dan Narapidana Lanjut Usia. Hal ini terlihat dari tidak adanya perlakuan khusus dalam hal pemenuhan hak kesehatan bagi narapidana lanjut usia, serta tidak tersedianya dokter yang memiliki kualifikasi untuk menangani narapidana lanjut usia. Kedua, upaya yang dilakukan untuk terpenuhinya hak pelayanan kesehatan bagi narapidana lanjut usia adalah melalui pelayanan kesehatan berupa pelayanan promotif, pelayanan preventif, pelayanan kuratif, dan pelayanan rehabilitatif. Disamping itu, perlu adanya aturan turunan dan kuantitas dan kualitas petugas pemasyarakatan agar pemenuhan hak pelayanan kesehatan narapidana lanjut usia dapat berjalan dengan baik.
Disarankan, agar pihak RUTAN Kelas IIB Banda Aceh menambah kuantitas dan kualitas tenaga medis RUTAN, penyediaan obat-obatan serta peralatan medis yang lebih lengkap dan bermutu.

Elderly convicts have the right to fulfill their rights to special health services. This is regulated in Article 6 of the Minister of Law and Human Rights Regulation Number 32 of 2018 concerning the Treatment of Prisoners and Elderly Convicts. Fulfillment of the right to health services specifically for elderly prisoners is often neglected and has not been fully implemented properly and optimally. This research aims to examine the practice of fulfillment the right to health services order to improve the welfare of elderly prisoners. Also to find out and explain the efforts made to fulfill the rights to health services for elderly prisoners and to develop human rights theory, punishment theory, and prisoner development theory. The research method uses empirical juridical. Research on the role of Correctional Institutions in carrying out their functions and discussing how the law works against prisoners. The data used are primary data, secondary data and tertiary data. Data collection techniques use interview techniques and reviewing related documents and laws. Next, the data is processed and analyzed using qualitative descriptive analysis techniques. The research result is first, the fulfillment of the right to health services for elderly prisoners has not been carried out optimally in accordance with the mandate of Minister of Law and Human Rights Regulation Number 32 of 2018 concerning the Treatment of Elderly Prisoners and Prisoners. This can be seen from the lack of special treatment in terms of fulfillment the right to health for elderly prisoners, as well as the unavailability of doctors who are qualified to treat elderly prisoners. Second, efforts made to fulfill the right to health services for elderly prisoners are through health services in the form of promotive services, preventive services, curative services and rehabilitative services. Apart from that, there is a need for derivative regulations and the quantity/quality of correctional officers so that the fulfillment of the rights to health services for elderly prisoners can run well. The recommended for Banda Aceh Class IIB State Detention Center increase the quantity and quality of detention center medical personnel, provide more complete and quality medicines and medical equipment.
