ABSTRAK
Pasal 16 Undang-Undang Jabatan Notaris ayat (1) huruf (a) mengatakan “notaris wajib bertindak amanah, jujur, saksama, mandiri, tidak berpihak dan menjaga kepentingan pihak yang terkait dalam perbuatan hukum, Jika notaris tidak menerapkan sikap kehati-hatian akan menimbulkan masalah sebagaimana sengketa pada nomor 18/Pdt.G/2021/Pn.Bna, dimana notaris telah melakukan permufakatan atau persekonggolan jahat yaitu merekayasa jual beli yang belum lunas dan membuat akta jual beli, akta tersebut dijadikah jaminan utang ke Bank.
Penelitian ini bertujuan untuk menjelaskan dan menganalisis pertimbangan hakim serta tanggung jawab notaris terhadap pembatalan sertifikat hak milik yang dibebani hak tanggungan dalam putusan No 18/Pdt.G/2021/Pn.Bna, menganalisis dan mejelaskan akibat hukum serta perlindungan hukum terhadap bank atas pembatalan sertipikat yang dibebani hak tangggungan pada putusan pengadilan No 18/Pdt.G/2021/Pn.Bna.
Penelitian ini merupakan penelitian hukum normatif, yang mengandalkan data sekunder dan wawancara dengan narasumber. Selanjutnya dilakukan analisis kualitatif melalui tahapan-tahapan pengumpulan data, mengklasifikasikan, menghubungkan dengan teori, peraturan perundang-undangan yang berlaku dan permaasalahan pada penelitian tesis ini.
Hasil dari penelitian ini adalah pertimbangan hakim dari putusan No 18/Pdt.G/2021/Pn.Bna adalah hakim membatalkan Akta Jual Beli berdasarkan Pasal 1321 KUHPerdata dan Pasal 1328 KUHPerdata dan akta tersebut mengandung unsur perbuatan melawan hukum dan melanggar ketentuan Pasal 1320 KUHPerdata. Tanggung jawab notaris dalam Putusan ini yaitu hakim tidak meminta pertanggungjawaban dari notaris, namun akta yang telah dibuat olehnya dinyatakan batal dan tidak memiliki kekuatan hukum tetap. Akibat hukum yang timbul adalah Akta Perjanjian Perikatan Jual Beli dan Akta Jual Beli serta proses balik nama sertipikat tidak sah dan tidak memiliki kekuatan hukun, maka Hak tanggungan juga ikut batal, dan bank tidak lagi memiliki hak preferennya dalam peluasan hutang debitor. Perlindungan hukum terhadap Bank yaitu berdasarkan Pasal 1131 KUHPerdata dengan jaminan umum dimana kreditor dapat melakukan suatu gugatan tambahan penyitaan yang sebelumnya didahului dengan gugatan pokok perkara wanprestasi.
Saran terhadap penelitian ini adalah perlu adanya hukuman tegas bagi para tergugat karena adanya persekongkolan jahat dan ada unsur penipuan, untuk Notaris/PPAT haruslah menerapkan sikap kehati-hatian sebagaimana telah dijelaskan dalam Undang-Undang Jabatan Notaris. Dari pihak Bank yang telah dirugikan dapat menuntut kembali debitur, agar kedudukannya sebagai kreditur konkuren menjadi kreditor preferen kembali. Kemudian perlu suatu peraturan perundang-undangan yang secara khusus dan tegas mengatur perlindungan hukum bagi kreditur yang kehilangan jaminannya khususnya jaminan hak tanggungan.

BANK LOSSES DUE TO NOTARY CONSPIRACY WITH THE DEFENDANTS IN THE LAND SALE AND PURCHASE CASE (Study Of Decision Number 18/Pdt.G/2021/Pn.Bna) Hayatun Nufus Prof. Dr. Eddy Purnama S.H., M.Hum Dr. Teuku Saiful, S.H., M.Hum ABSTRACT Based on Article 16 of the Notary Position Law paragraph (1) letter (a) "a notary is obliged to act in a trustworthy, honest, thorough, independent, impartial manner and safeguard the interests of the parties involved in legal actions." Thoroughly in this article can be interpreted as (meticulous, careful and careful). If the notary does not apply a careful attitude, it will cause problems such as the dispute in number 18/Pdt.G/2021/Pn.Bna, where the notary has entered into a conspiracy or conspiracy. evil, namely manipulating a sale and purchase that has not been paid off and making a sale and purchase deed, the deed being used as collateral for a debt to the bank, which is then canceled by the judge. This research discusses bank losses due to notary collusion with defendants in land sale and purchase cases, a case study based on district court decision number 18/Ptd.G/2021/Pn.Bna, which aims to explain and analyze the judge's considerations and the notary's responsibilities towards cancellation of property rights certificates which are encumbered with mortgage rights in decision No. 18/Pdt.G/2021/Pn.Bna, analyzing and explaining the legal consequences and legal protection for banks for the cancellation of certificates which are encumbered with mortgage rights in court decision No. 18/Pdt.G/ 2021/Pn.Bna. This research is normative legal research, which relies on secondary data and interviews with sources. Next, qualitative analysis was carried out through the stages of data collection, classifying, connecting with theory, applicable regulations and problems in this thesis research. The result of this research is that the judge's consideration of decision No. 18/Pdt.G/2021/Pn.Bna is that the judge canceled the Deed of Sale and Purchase based on Article 1321 of the Civil Code and Article 1328 of the Civil Code and that the deed contained elements of an unlawful act and violated the provisions of Article 1320 of the Civil Code. The responsibility of the notary in this decision is that the judge does not ask the notary to be responsible, but the deed he has made is declared void and has no permanent legal force. The legal consequences that arise are that the Deed of Sale Purchase Agreement and Sale and Purchase Deed as well as the process of changing the name of the certificate are invalid and have no legal force, so the mortgage right is also cancelled, and the bank no longer has preferential rights in expanding the debtor's debt. Legal protection for banks is based on Article 1131 of the Civil Code with a general guarantee where creditors can carry out an additional lawsuit for confiscation which was previously preceded by the main lawsuit for default. The suggestion for this research is that there needs to be strict punishment for the defendants because there is an evil conspiracy and there is an element of fraud. Notaries/PPATs must apply a careful attitude as explained in the Notary Public Position Act. The bank that has suffered a loss can sue the debtor again, so that its position as a concurrent creditor becomes a preferred creditor again. Then there is a need for legislation that specifically and firmly regulates legal protection for creditors who lose their collateral, especially mortgage collateral.
