Pasal 1338 Ayat (1) KUHPerdata menyebutkan bahwa para pihak harus mematuhi perjanjian yang dibuatnya karena perjanjian tersebut merupakan undang undang bagi kedua belah pihak. Namun, dalam kenyataannya masih ditemukan pihak-pihak yang melanggar dan/atau tidak mematuhi isi perjanjian yang telah disepakati oleh mereka, seperti terjadinya wanprestasi dalam perjanjian jual beli mobil bekas di Kota Lhokseumawe.

Tujuan penelitian ini adalah untuk menjelaskan pelaksanaan perjanjian jual beli mobil bekas di Kota Lhokseumawe, menjelaskan bentuk-bentuk wanprestasi dalam perjanjian jual beli mobil bekas di Kota Lhokseumawe, dan menjelaskan penyelesaian wanprestasi dalam perjanjian jual beli mobil bekas di Kota Lhokseumawe.

Metode penelitian yang digunakan dalam penulisan skripsi ini adalah penelitian empiris. Data dalam penelitian ini diproleh melalui dari data lapangan (field research) hal ini menggunakan dari hasil wawancara dengan responden, dan juga melalui penelusuran kepustakaan (library research). Dari hasil penelitian tersebut kemudian dianalisis yang sebagaimana bentuk yang terjadi di lapangan.

Hasil penelitian menunjukan bahwa perjanjian jual beli mobil bekas antara pembeli dan penjual dilakukan melalui perjanjian secara tertulis maupun lisan melalui pihak ketiga, yaitu perusahaan leasing namun tidak sesuai dengan pelaksanaannya. Bentuk wanprestasi dalam perjanjian jual beli mobil bekas yang dilakukan oleh dua orang penjual adalah tidak menyerahkan BPKP kepada pembeli sesuai dengan apa yang telah diperjanjikan, bentuk wanprestasi yang dilakukan oleh dua orang pembeli adalah terlambat melakukan pembayaran cicilan mobil kepada pihak penjual sesuai apa yang telah diperjanjikan oleh penjual maupun pembeli. Penyelesaian terhadap wanprestasi kepada penjual yang tidak menyerahkan BPKB kepada pembeli setelah dilunasinya cicilan mobil dan pengiriman surat somasi kepada penjual adalah penjual harus mengembalikan sejumlah uang oleh pembeli.

Disarankan kepada para pihak untuk mencantumkan point-point yang detail dan teliti agar terhindar dari kekaburan dalam pemenuhan perjanjian tersebut. Disarankan kepada para pihak untuk mentaati perjanjian yang telah disepakati, dan beriktikad baik dalam pemenuhan perjanjian yang telah disepakati oleh kedua belah pihak.

Article 1338 Paragraph (1) of the Civil Code states that the parties must comply with the agreement they made because the agreement is a law for both parties. However, in reality there are still parties who violate and/or do not comply with the contents of the agreement that has been agreed upon by them, such as the default in the used car sale and purchase agreement in Lhokseumawe City. The purpose of this study is to explain the implementation of the used car sale and purchase agreement in Lhokseumawe City, explain the forms of default in the used car sale and purchase agreement in Lhokseumawe City, and explain the settlement of default in the used car sale and purchase agreement in Lhokseumawe City. The research method used in writing this thesis is empirical research. The data in this research is obtained through field data (field research) this uses the results of interviews with respondents, and also through library research. From the results of this research, it is then analyzed in the form that occurs in the field. The results showed that the used car sale and purchase agreement between the buyer and the seller was carried out through a written or oral agreement through a third party, namely a leasing company but not in accordance with its implementation. The form of default in the used car sale and purchase agreement carried out by two sellers is not delivering the BPKP to the buyer in accordance with what has been agreed, the form of default committed by two buyers is late in making car installment payments to the seller according to what has been agreed by the seller and the buyer. The settlement of default to the seller who did not submit the BPKB to the buyer after the repayment of the car installments and the sending of a summons to the seller is that the seller must return some money by the buyer. It is recommended to the parties to include detailed and thorough points in order to avoid obscurity in the fulfillment of the agreement. It is recommended that the parties comply with the agreed agreement, and make good faith in the fulfillment of the agreement that has been agreed upon by both parties.
