TANGGUNG JAWAB NOTARIS SETELAH BERAKHIR MASA JABATANNYA TERHADAP KESALAHAN KETIK

ABSTRAK

Berdasarkan Pasal 8 Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris, tanggung jawab dari tugas dan kewenangan tetap melekat walaupun masa jabatan Notaris telah berakhir hingga Notaris meninggal dunia. Dalam praktiknya ditemukan Notaris yang telah berakhir masa jabatannya dan akta yang pernah dibuat oleh Notaris tersebut mengalami kesalahan ketik sehingga harus diajukan perbaikan ke Pengadilan oleh Notaris yang bersangkutan.
Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dan bersumber pada data sekunder yaitu studi kepustakaan. Metode Analisis yang digunakan adalah metode analisis kualitatif.
Tujuan dari penelitian ini adalah untuk menjelaskan tanggung jawab notaris setelah berakhir masa jabatannya terhadap kesalahan ketik pembuatan akta otentik, untuk menjelaskan upaya yang dilakukan dan yang melakukan perubahan terhadap kesalahan ketik akta otentik yang notarisnya sudah pensiun.
Berdasarkan hasil penelitian ditemukan Pertanggungjawaban Notaris yang telah berakhir masa jabatanya tetap bertanggung jawab terhadap kesalahan ketik walaupun Notaris tersebut telah berakhir masa jabatannya, upaya yang dilakukan yaitu klien dapat meminta kepada Notaris yang telah berakhir masa jabatannya untuk mengajukan permohonan izin kepada Pengadilan Negeri untuk memberikan izin pada pemegang Protokol Notaris memperbaiki akta. Apabila sudah diperbaiki, maka akta tersebut dapat diperbaiki dengan membuat Akta Berita Acara Pembetulan dan salinannya wajib disampaikan kepada para pihak.
Disarankan kepada Pemerintah dan Ikatan Notaris Indonesia untuk mengatur dalam Undang-Undang Jabatan Notaris terkait batasan tanggung jawab hukum terhadap notaris yang sudah werda atau pensiun dikarenakan tidak adanya aturan yang mengatur terkait hal tersebut dan kepada Pemerintah dan Ikatan Notaris Indonesia untuk membuat aturan baru terkait perlindungan hukum terhadap notaris yang sudah werda atau pensiun.

NOTARY'S RESPONSIBILITIES AFTER THE END OF THEIR TERM OF OFFICE AGAINST TYPOGRAPHICAL ERRORS IN MAKING THE AUTHENTIC DEED Royes Ruslan Darmawan Teuku Saiful ABSTRAK Based on Article 8 of Law Number 2 of 2014 on the Amendment to Law Number 30 of 2004 on the Position of Notary, the responsibility of duties and authority remains even though the term of office of the Notary has ended until the Notary dies. In practice, it is found that a Notary whose term of office has expired and the deed made by the Notary has a typographical error, so corrections must be submitted to the Court by the Notary concerned. The research method used is normative juridical and sourced from secondary data, namely literature study. The analysis method used is the qualitative analysis method. This study aims to explain the responsibility of notaries after the end of their term of office for typographical errors in making authentic deeds. It also aims to explain the efforts made and those who change typographical errors in authentic deeds whose notaries have retired. Based on the research results, it is found that the responsibility of a notary whose term of office has ended is still responsible for typographical errors, even though the Notary has ended his term of office. The effort made is that the client can ask the Notary whose term of office has ended to apply for permission from the District Court to permit the Notary Protocol holder to correct the deed. If it has been corrected, the deed can be corrected by making a Deed of Minutes of Correction, and a copy must be submitted to the parties. It is recommended that the Government and the Indonesian Notary Association regulate the Notary Position Law regarding the limitations of legal responsibility for notaries who are elderly or retired due to the absence of rules governing this matter and the Government and the Indonesian Notary Association to make new rules regarding legal protection for notaries who are elderly or retired.
