Indonesian law on nuclear power under the Law No. 10 of 1997 is currently regulate quite a lot of matters relating to the use of nuclear energy but it still considered lack of regulations on the various aspects in some implementing regulations in accordance with the IAEA which are still not adequately regulated by existing laws and regulations. Indonesia’s government efforts to formulate and harmonized the whole regulations regarding energy has surface long debate in the parliament particularly to include nuclear power in the new and renewable energy bill decision to finalized the law on nuclear power as expected despite challenges on the refusal from various parties and Indonesia as NPT signatory country to implement nuclear power in Indonesia. This research is expected to addressed legal concerns that are projecting to build and operating nuclear as the source of energy and be a consideration for the Indonesian government to move toward nuclear energy in order to have a firm energy reserve to protect the stabilization of Indonesian economic and development. So that the Indonesian state has written legal instrument to safely utilize nuclear energy for peaceful use in Indonesia without violating NPT. This research conducted using Normative-Judicial method which is researching document study or data research on secondary data, namely Laws, Regulations, Court Decisions, and Legal Theory based on the concerning factor of primary data in the constitutions, Jurisprudence. And also, supported by tertiary data that provides details regarding primary and secondary data such as mass media or internet sources. The results on this research have shown that there are many international aspects of nuclear regulations that have been adopted or ratified which needs to be accommodated in national legislation and there are many oppositions of the following bill in the fear with the nuclear mismanagement and the past nuclear fatality and the lack of human and technology resources in Indonesia and also the restrictions on utilizing nuclear power by Non-proliferation convention that only allow for peaceful use under the heavily regulated circumstances. Suggestions to fix several implementing regulations for laws and international laws that have not been adequately regulated and as well as nuclear security and Indonesian government has to take serious step to implement this bill to be imposed as soon as possible and conclude nuclear power in the bill. The NPT should enforce its regulations for every ratified country and guarantee the security of nuclear power without any compromise.
