Penelitian dilakukan untuk menjelaskan tentang faktor-faktor penyebab, hambatan dalam mengatasi tindak pidana penyelundupan dan penegakan hukum terhadap tindak pidana penyelundupan pakaian bekas. Hasil penelitian menunjukan bahwa faktor penyebab pelaku dalam melakukan tindak pidana penyelundupan pakaian bekas impor karena faktor ekonomi, faktor kurangnya kesadaran dan pemahaman hukum, faktor lemahnya sarana atau fasilitas yang tidak memadai seperti kurangnya tempat pengecekan barang penumpang dan faktor rendahnya kualitas produk industri dalam negeri. Hambatan dalam mengatasi tindak pidana tersebut dikarenakan kurangnya partisipasi masyarakat, sulitnya mencari barang bukti dan kurangnya pemahaman masyarakat terhadap hukum kepabeanan terhadap tindak pidana penyelundupan pakaian bekas impor, penegakan hukum terhadap tindak pidana penyelundupan pakaian bekas yaitu dengan upaya preventif dan represif. Disarankan kepada pihak Kantor Pengawasan dan Pelayanan Bea dan Cukai (KPPBC) Tipe Madya Pabean C Banda Aceh agar dapat memperketat pengawasan dan melakukan upaya preventif serta pemberian sanksi tegas agar meminimalisir tindak pidana tersebut dan meningkatkan sosialisasi peraturan kepabeanan kepada masyarakat.

The research was conducted to analyse the causative factors, obstacles in overcoming the crime of smuggling and the law enforcement against the crime of smuggling secondhand clothes. The results of this research showed that the factors causing the perpetrators to commit the crime of smuggling imported secondhand clothes are due to the economic factors, lack of awareness and understanding of the law, weak facilities or inadequate facilities such as the lack of a place to check passenger goods and the low quality of domestic industrial products. The obstacles in overcoming these crimes are due to the lack of public participation, the difficulty of finding evidence and the lack of public understanding of customs law against the crime of smuggling of imported secondhand clothing, law enforcement against the crime of smuggling secondhand clothing, namely with preventive and repressive efforts. It is recommended to the Customs and Excise Supervision and Service Office (KPPBC) Madya Pabean C Type Banda Aceh should be able to increase the supervision and take preventive measures and provide strict sanctions in order to minimize these crimes and increase the dissemination of customs regulations to the public.
