Ya'kub Aiyub Kadir) 2023 According to Law No. 48 of 2007 concerning the Stipulation of Government Regulation in Lieu of Law No. 2 of 2007 concerning the Handling of Legal Issues in the Context of Implementing the Rehabilitation and Reconstruction of Areas and People's Lives in Aceh Darussalam Province and Nias Island North Sumatra Province Became Law in article 1 paragraph 6 mentioning Baitul Mal Aceh as a watch guardian for Muslim and article 1 paragraph 7 mentioning Heirloom Board as a watch guardian for non-Muslim in Aceh and Muslim outside Aceh. Both have similarities and differences when performing duties as a watch guardian and in addition the existence of these two institutions as a watch guardian is also rarely known by the public. The purpose of this research is to explain the implementation of Baitul Mal Aceh as a watch guardian since it was appointed in Law No. 48 of 2007 after Tsunami and until now and to know in detail the differences and similarities of two institution (Baitul Mal Aceh and Heirloom Board) support each other especially in Watch Guardian to protect children from abuse guardian. This research uses normative legal research by using secondary data that consist the primary and secondary legal material. Primary legal material was gathered through regulation regarding the topics, while secondary legal material was obtaining by reviewing relevant books and journals. The result of this study found that Baitul Mal Aceh has not been able to carry out its duties because there is no governor regulation as an implementing regulation of Qanun Baitul Mal, however the similarities and differences between these two institutions have not been able to support each other. This is because the field of guardianship in Baitul Mal Aceh has not become the focus and Heirloom Board itself only takes care of guardianship for non-Muslim resident in Aceh. Therefore, Baitul Mal should immediately issue the governor regulation to avoid a legal vacuum in Aceh. As an institution that has advances in dealing with guardianship issues, it is better for Baitul Mal to follow the steps taken by Heirloom Board such as forming a team to perform the task. For Heirloom Board it is better to cooperate with another institution so that the Heirloom Board become more popular among community and it can help many children from abuse guardian.
